A Special Meeting of the City Commission of the City of Delray
Beach, Florida, was called to order by Mayor Thomas E. Lynch in the
Commission Chambers at City Hall at 6:00 P.M., Wednesday, November 7,
1990.
Roll call showed:
Present - Commissioner Jay Alperin
Commissioner William Andrews
Commissioner Mary McCarty
Commissioner David Randolph
Mayor Thomas E. Lynch
Absent - None
Also present were - City Manager David T. Harden and City Attorney Jeffrey S. Kurtz
Mayor Lynch called the meeting to order and announced that this
meeting has been called for the purpose of considering:
1. Appointments to the Board of Construction Appeals. The Commis-
sion is to consider the Mayor's appointment of a member to the general
contractor position to a term ending August 31, 1992, and a Seat 3
appointment of a member to the master plumber position to a term ending
August 31, 1991.
Mayor Lynch stated that he would like to recommend John Gwynn.
Mr. Andrews moved for the appointment of John Gwynn to the
general contractor position, seconded by Mr. Randolph. Upon roll call
the Commission voted as follows: Ms. McCarty - Yes; Dr. Alperin - Yes;
Mr. Andrews - Yes; Mr. Randolph - Yes; Mayor Lynch - Yes. Said motion
passed with a 5 to 0 vote.
Mr. Andrews moved for the appointment of Lee Wilder, Jr., to
the master plumber position, seconded by Ms. McCarty. Upon roll call
the Commission voted as follows: Dr. Alperin - Yes; Mr. Andrews - Yes;
Mr. Randolph - Yes; Mayor Lynch - Yes; Ms. McCarty - Yes. Said motion
passed with a 5 to 0 vote.
2. Appointment to the Board of Adjustment. The Commission is to
consider a Seat 3 appointment of a regular member to the Board of
Adjustment to fill the unexpired term of Anthony Veltri to a term ending
August 31, 1992.
Mr. Andrews requested this appointment be postponed until the
Regular Commission meeting to be held next Tuesday, November 13, 1990.
3. Canvassing Returns of the November 6, 1990, Referendum Election
~or the Charter Amendment. The Commission is to consider canvassing the
returns and declaring the results of the November 6, 1990, Referendum
Election for the City of Delray Beach's Charter Amendment.
The City Attorney presented the results of the voting for the
Referendum Election held on November 6, 1990, for the City of Delray
Beach's Charter Amendment, which showed:

CITY OF DELRAY BEACH - PROPOSED CHARTER AMENDMENT
AN AMENDMENT TO THE CITY CHARTER OF THE CITY OF DELRAY BEACH, FLORIDA,
PROVIDING THAT THE TERMINATION OF THE CITY MANAGER SHALL REQUIRE FOUR
(4) AFFIRMATIVE COMMISSION VOTES TAKEN AT A PUBLIC MEETING AFTER A
PUBLIC HEARING WHICH HAS BEEN NOTICED SEVENTY-TWO (72) HOURS IN ADVANCE
OF THE MEETING.
SHALL THE ABOVE-DESCRIBED CHARTER AMENDMENT BE ADOPTED?

Yes 9882 + 645 Absentee = 10,527
No 3576 + 112 Absentee = 3,688
Mr. Randolph moved to approve the total votes for the Ballot
Question - Proposed Charter Amendment, including all of the regular and
absentee votes as indicated above, seconded by Ms. McCarty. Upon roll
call the Commission voted as follows: Mr. Andrews - Yes; Mr. Randolph -
Yes; Mayor Lynch - Yes; Ms. McCarty - Yes; Dr. Alperin - Yes. Said
motion passed with a 5 to 0 vote.
From the foregoing results it was declared that the Referendum
Election for the City of Delray Beach's Charter Amendment, as stated
above, was approved.
The City Attorney further advised that the process now is for
the Commission, on a Consent Agenda, to direct the printer of the City's
Municipal Code to amend the Charter accordingly and forward it to the
Secretary of State. Upon his acceptance, it will be in effect, probably
by the last of November or the early part of December.
Mayor Lynch declared the meeting adjourned at 6:10 P.M.
