A Special Meeting of the City Commission of the City of Delray
Beach, Florida, was called to order by Mayor Doak S. Campbell in the
Commission Chambers at City Hall at 7:00 P.M., Tuesday, February 7,
1989.
Roll call showed:
Present - Commissioner Patricia Brainerd
Commissioner Marie Horenburger
Commissioner Mary McCarty
Commissioner Jimmy Weatherspoon
Mayor Doak S. Campbell
Absent - None
Also present were - City Manager Walter O. Barry and
Assistant City Attorney Susan Ruby.
Mayor Campbell called the meeting to order and announced that
this meeting has been called for the purpose of (1) Termination of
Janitorial Contract: City Hall and (2) Consideration of Settlement Offer
Caban (Medina) versus City of Delray Beach et al.
1. Termination of Janitorial Contract: City Hall.
The City Manager advised they have had a contract for the past
several months with a cleaning service which has proven to be unsatis-
factory and they believe they have defaulted on their contract. There-
fore, staff is recommending termination of the contract. They would
then go back into the market to rebid with a new specification for
cleaning services. In the interim, they will bring on a firm with whom
they have had some good dealings in the past.
Ms. Brainerd moved to terminate the existing contract with J&R
Cleaning Service, and authorize the City Manager to prepare an RFP for a
new cleaning contract, seconded by Ms. Horenburger. Upon roll call the
Commission voted as follows: Ms. Brainerd - Yes; Ms. Horenburger - Yes;
Ms. McCarty - Yes; Mr. Weatherspoon - Yes; Mayor Campbell - Yes. Said
motion passed with a 5 to 0 vote.
2. Consideration of Settlement Offer Caban (Medina) versus City of
Delray Beach et al.
Assistant City Attorney Ruby advised the amount of settlement
is $50,000 with $25,000 coming from the City and $25,000 from Western
World Insurance Company. The City Attorney's Office is recommending
that the Commission approve the settlement.
Mr. Weatherspoon moved to ratify the settlement offer between
Caban (Medina) versus City of Delray Beach et al, seconded by Ms.
Brainerd. Upon roll call the Commission voted as follows: Ms. Brainerd
- Yes; Ms. Horenburger - Yes; Ms. McCarty - Yes; Mr. Weatherspoon - Yes;
Mayor Campbell - Yes. Said motion passed with a 5 to 0 vote.
Mayor Campbell declared the meeting adjourned at 7:06 P.M.
