A Special Meeting of the City Commission of the City of Delray
Beach, Florida, was called to order by Mayor Doak S. Campbell in the
Commission Chambers at City Hall at 7:00 P.M., Tuesday, October 4, 1988.
Roll call showed:
Present - Commissioner Patricia Brainerd
Commissioner Marie Horenburger (Arrived 7:05 P.M.)
Commissioner Mary McCarty
Commissioner Jimmy Weatherspoon
Mayor Doak S. Campbell
Absent - None
Also present were - City Manager Walter O. Barry and
City Attorney Herbert W.A. Thiele.
Mayor Campbell called the meeting to order and announced-that
this meeting has been called for the purpose of the following:
1. Ratification of Collective Bargaining Agreement between the
'~ity. o.f Delray Beach and Florida State Lodge, Fraternal Order of Polic~',
October 1, 1988,...through September 30, 1991. The Ci'%y Manager reported
this item was voted on affirmatively by the Police Union and is being
presented ~or Commission approval.
Ms. McCarty moved for ratification of Collective Bargaining
Agreement between the City of Delray Beach and Florida State Lodge,
Fraternal Order of Police, October 1, 1988 through September 30, 1991,
seconded by Ms. Brainerd. Upon roll call the Commission voted as
follows: Ms. Brainerd - Yes; Ms. McCarty - Yes; Mr. Weatherspoon - Yes;
Mayor Campbell - Yes. Said motion passed with a 4 to 0 vote.
2. Ratification of Collective Bargaining A~reement between the
City of Delray Beach and the Florida International Brotherhood of
Firemen and Oilers AFL-CIO, Local 1226, October 1, 1988 through Septemr
ber 30, 1991. The City Manager stated he wished to withdraw this item
as the IBF&O did not vote in favor of this agreement. There was some
confusion as to one of the items and the bargaining team and the City
Manager will be getting together next Monday to go back over it.
Depending upon the resolution, they may ask the Commission for an
additional Executive Session or simply go back to the Union for another
vote.
3. Ratification of Collective Bargaining A~reement between the
~it~ of Delra¥ Beach and the Professional Firefighters of Delray Beach,
Local 1842, IAFF. The City Manager reported the IAFF has approved the
City's contract offer and he recommends that the Commission accept the
contract as ratified.
Ms. McCarty moved for ratification of Collective Bargaining
Agreement between the City of Delray Beach and the Professional Fire-
fighters of Delray Beach, Local 1842, IAFF, seconded by Mr.
Weatherspoon. Upon roll call the Commission voted as follows: Ms.
Brainerd - Yes; Ms. McCarty - Yes; Mr. Weatherspoon - Yes; Mayor Camp-
bell - Yes. Said motion passed with a 4 to 0 vote.
4. Expression of City Commission position regarding location of
CRA Parking GaT.age.
The Commission was furnished and reviewed a letter from the
City Attorney dated October 4th.

Ms. Brainerd asked that this item be postponed until the
October llth Commission meeting for discussion. The Commission con-
curred.
5. Revisit of City Attorney's salary increase for clarification of
intended action.
Ms. Brainerd apologized to the Commission for her lack of
verbalizing this in a cohesive manner when it was discussed as last
week's meeting. What she sees, according to the City Attorney's memo
summarizing the Commission's action and what she intended to do, are two
different things. What she had in mind for the City Attorney was that
he be entitled to the 1% departmental increase, 2% cost of living, plus
2% and a 6% merit increase. The increase is meant to be in the form of
an increase, not a flat bonus payment.
Ms. Brainerd moved to rescind the compensation for the City
Attorney that was discussed at the last Commission meeting and adopt
instead the 2% plus 2% cost of living that the City is granting to all
employees, the 1% departmental bonus that is available to all employees
and a 6% merit increase which is the maximum available for all City
employees, seconded by Ms. Horenburger. Upon roll call the Commission
voted as follows: Ms. Brainerd - Yes; Ms. Horenburger - Yes; Ms. McCarty
- Yes; Mr. Weatherspoon - No; Mayor Campbell - Yes. Said motion p~ssed
with a 4 to 1 vote. ~
Before roll call the following discussion was had:
M~. McCarty commented she felt there needs to be some way of
evaluating the City Attorney; she has no problem with the 6% but be-
lieved when the Commission sits down with the evaluation process of the
City Manager they might want to discuss the City Attorney as well.
Mr. Weatherspoon stated he has a small concern with the 6%
increase. Just looking at the general employees, per se, he is not sure
what each of the Department Heads gives their employees, but he would
assume for the most part that it is a rarity that they receive the
maximum. Mr. Weatherspoon stated he would opt for perhaps a 5% not that
he doesn't think the City Attorney is doing a good job overall.
Mayor Campbell advised he believes the City is very compliment-
ed to have Mr. Thiele, recognizing the fact that he was a serious
finalist for the County Attorney job. Mr. Weatherspoon stated he agrees
100 percent that his performance has been outstanding; however, in
looking at the survey that was done for other cities for the same work,
he feels that this City pays their attorney quite well.
At this point the roll was called to the motion.
Mayor Campbell declared the meeting adjourned at 7:11 P.M.
