01-06-87SpMtg JANUARY 6, 1987 A Special Meeting of the City Commission of the City of Delray Beach, Florida, was called to order by Mayor Doak S. Campbell in the Commission Chambers at City Hall at 7:00 P.M., Tuesday, January 6, 1987. Roll call showed: Present - Commissioner Malcolm T. Bird Commissioner Richard J. Dougherty Commissioner Marie Horenburger Commissioner Jimmy Weatherspoon Mayor Doak S. Campbell Absent - None Also present were - City Manager James L. Pennington and City Attorney Herbert W.A. Thiele. Mayor Campbell called the meeting to order and announced that this meeting has been called for the purpose of (1) First Reading of Ordinance No. 1-87 clarifying the use of the additional 1% utility services tax. 1. Ordinance No. 1-87 - Amending Code - Utilities Services Tax. Ordinance No. 1-87, amending Chapter 25, "Taxation", of the Code of Ordinances clarifying the use of the additional 1% utility services tax, is before the Commission for consideration on First Reading. If passed, Public Hearing will be held January 20. The City Manager presented Ordinance No. 1=87: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 25, "TAXATION", OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, BY AMENDING ARTICLE III, "UTILITY SERVICES", SECTION 25-23, "LEVIED; PURCHASER TO PAY", TO CLARIFY THE INTENT OF THE CITY COUNCIL FOR THE USE OF REVENUES DERIVED FROM THE 8.5% UTILITIES SERVICES TAX AS SAME REGARDS UTILITY TAX OBLIGATIONS OF THE CITY; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE. The City Attorney read the caption of the ordinance. Mr. Bird moved for the adoption of Ordinance No. 1-87 on First Reading, seconded by Mrs. Horenburger. Upon roll call the Commission voted as follows: Mr. Bird - Yes; Mr. Dougherty - Yes; Mrs. Horenburger - Yes; Mr. Weatherspoon - Yes; Mayor Campbell - Yes. Said motion passed with a 5 to 0 vote. Before roll call, the City Attorney advised this is on the agenda to do a technical clarification to the utility tax section of the Code. They recently enacted an ordinance which earmarked an increase of 1% in the utility services tax for beautification purposes. In light of the City's past utility service tax certificates, and the upcoming bond issue, the City's Bond Counsel, Mudge, Rose, felt that it was necessary to clarify in the terms of the ordinance itself that the bond covenants would prevail. That is, that you as a holder of a bond would have a first priority on the utility tax to pay the debt service on the bonds. It will do nothing to affect the manner by which the funds will be distributed, nor will it do anything to affect the tax rate itself. At this point the roll was called to the motion. Mayor Campbell declared the meeting adjourned at 7:04 P.M.
