A Special Meeting of the City Commission of the City of Delray
Beach, Florida, was called to order by Mayor Doak S. Campbell in the
Commission Chambers at City Hall at 12:04 P.M., Tuesday, March 12, 1987.
Roll call showed:
Present - Commissioner Richard J. Dougherty
Commissioner Marie Horenburger
Commissioner Jimmy Weatherspoon
Mayor Doak S. Campbell
Absent - Commissioner Malcolm T. Bird
Also present were - City Manager James L. Pennington and
Assistant City Attorney Jeffrey Kurtz
Mayor Campbell called the meeting to order and announced that
this meeting has been called for the purpose of (1) Canvassing the
returns and declaring the results of the March 10, 1987 First Nonparti-
san Election and (2) Discussion of memorandum from Frances Bourque re:
Old School Square.
1. The City Clerk reported that she has compared the information
on the voter's certificate on the back of the absentee ballot with the
registration information furnished by the County Supervisor of Elections
to determine that the elector casting the absentee ballot is duly
registered in the precinct referred to and that he or she has not
otherwise voted in this election. She also has compared the ballots
being presented with the record of such ballots, which include the date
that a request for the absentee ballot was made, the date the absentee
ballot was delivered or mailed and the date the ballot was received in
the City Clerk's office, required by Florida Statute 101.62(3) and has
determined that we have received all ballots required.
Mr. Weatherspoon moved to approve the Clerk's comparison of the
absentee ballots presented with the record required by Florida Statutes
101.62 as prepared by the City Clerk's office, seconded by Mr. Dougher-
ty. Upon roll call the Commission voted as follows: Mr. Dougherty -
Yes; Mrs. Horenburger - Yes; Mr. Weatherspoon - Yes; Mayor Campbell -
Yes. Said motion passed with a 4 to 0 vote.
The City Clerk presented the absentee ballots, and noted that
82 absentee ballots were issued.
The results of the absentee ballots are as follows:

Mr. Weatherspoon moved to approve the results of the absentee voting as
follows:

Seconded by Mr. Dougherty. Upon roll call the Commission voted as
follows: Mr. Dougherty - Yes; Mrs. Horenburger - Yes; Mr. Weatherspoon -
Yes; Mayor Campbell - Yes. Said motion passed with a 4 to 0 vote.
The City Clerk presented the regular votes other than absentee
votes for the office of Commission Member - Seat No. 1 and Seat No. 3 as
follows:

Mr. Weatherspoon moved to approve the results of the voting
other than absentee voting which has already been approved as indicated
above, seconded by Mr. Dougherty. Upon roll call the Commission voted
as follows: Mr. Dougherty - Yes; Mrs. Horenburger - Yes; Mr. Weather-
spoon - Yes; Mayor Campbell - Yes. Said motion passed with a 4 to 0
vote.
The City Clerk reported that the total votes for each candidate
for Commission Member - Seat No. 1 and Seat No. 3, including all the
regular and absentee votes is as follows:

Mr. Dougherty moved to approve the total votes for Commission
Member - Seat Nos. 1 and 3 including all the regular and absentee votes
as indicated above, seconded by Mr. Weatherspoon. Upon roll call the
Commission voted as follows: Mr. Dougherty - Yes; Mr. Weatherspoon -
Yes; Mrs. Horenburger - Yes; Mayor Campbell - Yes. Said motion passed
with a 4 to 0 vote.
Mr. Dougherty moved that, based upon the above and foregoing,
it is hereby declared that Mary McCarty, is elected as Commission Member
- Seat No. 1, and Marie Horenburger is elected as Commission Member -
Seat No. 3, for a two-year term commencing March 26, 1987, and ending in
accordance with the City Charter, seconded by Mr. Weatherspoon. Upon
roll call the Commission voted as follows: Mr. Dougherty - Yes; Mrs.
Horenburger - Yes; Mr. Weatherspoon - Yes; Mayor Campbell - Yes. Said
motion passed with a 4 to 0 vote.
2. Mayor Campbell stated that even though the Commission is not
going to ratify everything Frances Bourque has requested in her memo,
she has a time constraint in regard to an application to allow some
design work to be done on the Old School Square from the State Depart-
ment. She would like that the Old School Square Foundation, Inc.,
Directors be recognized as the lead agency in making and coordinating
plans for the site, for financing of the site and returning to the
Commission with those recommendations. At that time she would also like
that they be recognized as an official agency to deal with other govern-
mental bodies and the public in coordinating such plans. He also
recommended, with the approval of the City Manager, that Kathy Daley
work with the Old School Square Foundation as the City's representative.

Mr. Weatherspoon moved to designate the Old School Square,
Inc., together with Kathy Daley, as the lead agency in the activities
surrounding the Old School Square, seconded by Mrs. Horenburger. Upon
roll call the Commission voted as follows: Mr. Dougherty abstained;
Mrs. Horenburger - Yes; Mr. Weatherspoon - Yes; Mayor Campbell - Yes.
Said motion passed with a 3 to 0 vote, with Mr. Dougherty abstaining.
Mayor Campbell declared the meeting adjourned at 12:30 P.M.
