A Special Meeting of the City Commission of the City of Delray
Beach, Florida, was called to order by Mayor Doak S. Campbell in the
Commission Chambers at City Hall at 7:00 P.M., Tuesday, September 15,
1987.
Roll call showed:

Absent - None
Also present were - Acting City Manager Robert A. Barcinski
and City Attorney Herbert W.A. Thiele.
Mayor Campbell called the meeting to order and announced that
this meeting has been called for the purpose of (1) Adoption of Resolu-
tion No. 41-87 to establish a City Board/Commission/Committee Membership
Selection Process and (2) Request for Noise Variance for Night Pile
Driving at Atlantic Avenue Bridge.
1. The caption of Resolution No. 41-87 is as follows:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, ADOPTING AND SETTING FORTH ITS POLICIES
AND PROCEDURES WITH REGARD TO SELECTION OF MEMBERS FOR
THE CITY'S BOARDS, COMMISSIONS, AND COMMITTEES; PROVIDING
FOR THE TRANSMITTAL OF COPIES OF THIS RESOLUTION.
Helen Coopersmith, 1222-D South Drive Way, stated she felt the
term "Council watcher" is denigrating to those who regularly attend
meetings. Many who attend are on City boards or active in civic or
community organizations; they come to learn and take back to their own
groups information as to what is happening in the City. Mrs.
Coopersmith advised that in her opinion these are the people who should
be considered for vacancies on boards; when you advertise you don't
really know who you are getting. The boards are very important and need
knowledgeable, caring and well informed people to serve.
Jay Slavin also spoke in opposition to advertising; she was in
favor of applications being received by recommendations.
Mr. Weatherspoon advised that by going to advertising it is
letting the citizens know there is a vacancy; it does not preclude any
group or anyone from submitting or having someone submit their name for
a board.
Mrs. McCarty stated she does not feel that only the people who
attend the meetings should know about the board vacancies; the more
information we can disseminate to the whole community, which is who the
Commission represents, the better off we will be. In regard to the
applications going to the different boards and then the boards short-
listing those applications, she would rather see the applications go to
the board chairman as well as the City Manager to keep on file, and for
the board to go through these in a very objective way to make sure they
meet the minimum criteria before the Commission receives the applica-
tion; the subjective nature can then be left to the Commission.
Mr. Dougherty stated he opposed the boards making the decision
for the Commission, as in a sense they are giving the Commission a
priority list. Looking at the way the City operates he feels they have
downgraded the Mayor's position, to almost a perfunctory type position,
and he doesn't think that is quite right; the Mayor should have a
stronger position and function in the selection process for boards and
committees, as well as in general. Mr. Dougherty advised he cannot
agree with the resolution as drafted. One of the items that had been
discussed, and which was not included in the resolution, is that the
Commission adopt some form of appointments to be made by each Commis-
sioner. They talked about the possibility of having a pecking order so
that each Commissioner would have the opportunity to appoint someone to
a board or committee. Mr. Dougherty reiterated he was not in agreement
with having the priority list submitted to the board itself.
Mrs. Horenburger advised she was in agreement with the adver-
tising; as they have seen in the past everyone wants to sit on the
Planning and Zoning Board or a couple of the other boards and the rest
go begging. She is in favor of getting the word out to working people
who can't always be at the Commission meetings. Mrs. Horenburger stated
that other than advertising she was not sure any of the rest of the
resolution was satisfactory.
Mayor Campbell stated he would not be in favor of advertising;
those of the Commission who should be familiar with the community and
the people in it and those who are qualified to serve should have no
difficulty in making an appointment. The only time the City has had
vacancies that are not fulfilled are very technical in nature. He
advised he is not ready to solicit people to serve on a board when he
knows he could make a qualified appointment. Mayor Campbell stated he
never wants to be in a position, however, of having people to politic
him and to tell someone they are more qualified than someone else.
Discussion followed among the Commission.
Mrs. Horenburger left the Commission Chambers at 7:33 P.M.
Mrs. McCarty moved to approve Resolution No. 41-87 as it
applies to paragraph A, eliminating B, C and D, seconded by Mr.
Weatherspoon. Upon roll call the Commission voted as follows: Mr.
Dougherty - No; Mrs. McCarty - Yes; Mr. Weatherspoon - Yes; Mayor
Campbell - No. Said motion FAILED by a 2 to 2 vote.
Mr. Dougherty suggested that Mayor Campbell prepare what he
thinks is in the best interest of the City and the Commission as to a
format that should be followed.
Mr. Weatherspoon moved to reconsider this item at the end of
the Workshop meeting, seconded by Mrs. McCarty. Upon roll call the
Commission voted as follows: Mr. Dougherty - No; Mrs. McCarty - Yes; Mr.
Weatherspoon - Yes; Mayor Campbell - Yes. Said motion passed with a 3
to 1 vote.
The City Attorney advised Mayor Campbell to not close the
special meeting when going into the workshop items.
2. The Assistant City Manager reported that the Commission had
previously approved this request for the dates of July 14th to September
16th; the contractor was unable to perform the work during that time
frame and is requesting new approval from September 16th to November
18th between the hours of 8:00 P.M. and 6:00 A.M. for the work required
on the Atlantic Avenue bridge. This involves pile driving so there is a
waiver request of the Noise Ordinance.
Mr. Weatherspoon moved to approve a waiver of the Noise Ordi-
nance for night pile driving at the Atlantic Avenue bridge, seconded by
Mrs. McCarty. Upon roll call the Commission voted as follows: Mr.
Dougherty - Yes; Mrs. McCarty - Yes; Mr. Weatherspoon - Yes; Mayor
Campbell - Yes. Said motion passed with a 4 to 0 vote.
Before roll call, upon question by Mr. Dougherty, the Assistant
City Manager advised that this has not been discussed with the residents
of the nearby condominiums. It was recommended that staff post notice.
At this point the roll was called to the motion.
(Note: The Special Meeting was recessed at 7:40 P.M., to be
reconvened at the end of the Workshop Meeting which ended at 11:30 P.M.
Due to the lateness of the meeting, the Commission concurred in not
reconvening the Special Meeting~
