03-13-86SpMtg MARCH 13, 1986 A Special Meeting of the City Council of the City of Delray Beach, Florida, was called to order by Mayor Doak S. Campbell in the Council Chambers at City Hall at 1:34 P.M., Thursday, March 13, 1986. Roll call showed: Present - Council Member Malcolm T. Bird (Arrived 1:45 P.M.) Council Member Marie Horenburger Council Member Arthur Jackel Council Member Jimmy Weatherspoon Mayor Doak S. Campbell Absent - None Also present were - City Manager James L. Pennington and City Attorney Herbert W.A. Thiele. Mayor Campbell called the meeting to order and announced that this meeting has been called for the purpose of (1) Canvassing the returns and declaring the results of the March 11, 1986 First Non- partisan Election. The City Clerk reported that she has compared the information on the voter's certificate on the back of the absentee ballot with the registration information furnished by the County Supervisor of Elections to determine that the elector casting the absentee ballot is duly registered in the precinct referred to and that he or she has not otherwise voted in this election. She also has compared the ballots being presented with the record of such ballots, which include the date that a request for the absentee ballot was made, the date the absentee ballot was delivered or mailed and the date the ballot was received in the City Clerk's office, required by Florida Statute 101.62(3) and has determined that we have received all ballots required except 10 which were not returned as reflected on the absentee elector's record and that the other ballots being presented are properly accounted for. Mr. Jackel moved to approve the Clerk's comparison of the absentee ballots presented with the record required by Florida Statutes 101.62 as prepared by the City Clerk's office and to have the record of absentee electors as prepared by the City Clerk's office attached to and made a part of the minutes of this meeting, seconded by Mr. Weatherspoon. Upon roll call Council voted as follows: Mrs. Horenburger - Yes; Mr. Jackel - Yes; Mr. Weatherspoon - Yes; Mayor Campbell - Yes. Said motion passed with a 4 to 0 vote. The City Clerk presented the absentee ballots, and noted that 83 absentee ballots were issued, 10 were not returned. Mr. Bird arrived at this time. The results of the absentee ballots are as follows: Council Member Total Richard J. Dougherty 34 Sidney S. Soloway 17 Leonard Syrop 22 Mrs. Horenburger moved to approve the results of the absentee voting as follows: For Council Member - Seat No. 2 Richard J. Dougherty 34 Sidney S. Soloway 17 Leonard Syrop 22 Seconded by Mr. Jackel. Upon roll call Council voted as follows: Mr. Bird - Yes; Mrs. Horenburger - Yes; Mr. Jackel - Yes; Mr. Weatherspoon - Yes; Mayor Campbell - Yes. Said motion passed with a 5 to 0 vote. The City Clerk presented the regular votes other than absentee voted for the office of Council Member - Seat No. 2 as follows: Council Member Richard J. Dougherty 2,293 Sidney S. Soloway 958 Leonard Syrop 820 Mrs. Horenburger moved to approve the results of the voting other than absentee voting which has already been approved as indicated above, seconded by Mr. Jackel. Upon roll call Council voted as follows: Mr. Bird - Yes; Mrs. Horenburger - Yes; Mr. Jackel - Yes; Mr. Weatherspoon - Yes; Mayor Campbell - Yes. Said motion passed with a 5 to 0 vote. The City Clerk reported that the total votes for each candidate for Council Member - Seat No. 2, including all the regular and absentee votes as follows: Council Member - Seat No. 2 TOTAL Richard J. Dougherty 2,293 + 34 Absentee 2,327 Sidney S. Soloway 958 + 17 Absentee 975 Leonard Syrop 820 + 22 Absentee 842 Mrs. Horenburger moved to approve the total votes for Council Member - Seat No. 2 including all the regular and absentee votes as indicated above, seconded by Mr. Jackel. Upon roll call Council voted as follows: Mr. Bird - Yes; Mrs. Horenburger - Yes; Mr. Jackel - Yes; Mr. Weatherspoon - Yes; Mayor Campbell - Yes. Said motion passed with a 5 to 0 vote. Mrs. Horenburger moved that, based upon the above and fore- going, it is hereby declared that Richard J. Dougherty is elected as Council Member - Seat No. 2, for a two-year term commencing March 27, 1986, and ending in accordance with the City Charter, seconded by Mr. Bird. Upon roll call Council voted as follows: Mr. Bird - Yes; Mrs. Horenburger - Yes; Mr. Jackel - Yes; Mr. Weatherspoon - Yes; Mayor Campbell - Yes. Said motion passed with a 5 to 0 vote. OFFICE OF MAYOR Doak S. Campbell - unopposed The City Clerk reported that for the Office of Mayor, Candidate Doak S. Campbell was unopposed, therefore, being the only candidate for the Office of Mayor, he is hereby declared to be elected to that office in accordance with Section 5.04(b) (2) in that he is deemed to have voted for himself. Mr. Campbell's term is a two-year term commencing on March 27, 1986 and ending in accordance with the City Charter. Mr. Bird moved that Doak S. Campbell be declared as the winner as he was the only candidate who filed for the Office of Mayor, to be seated as of March 27, 1986 for a two-year term ending in accordance with the City Charter, seconded by Mrs. Horenburger. Upon roll call Council voted as follows: Mr. Bird - Yes; Mrs. Horenburger - Yes; Mr. - 2 - 3/13/86 Jackel - Yes; Mr. Weatherspoon - Yes; Mayor Campbell - Yes. Said motion passed with a 5 to 0 vote. COUNCIL MEMBER - SEAT NO. 4 Jimmy Weatherspoon - unopposed The City Clerk reported that for Council Member - Seat No. 4, Candidate Jimmy Weatherspoon was unopposed, therefore, being the only candidate for Council Member - Seat No. 4, he is hereby declared to be elected to that office in accordance with Section 5.04(b) (2) in that he is deemed to have voted for himself. Mr. Weatherspoon's term is a two-year term commencing on March 27, 1986 and ending in accordance with the City Charter. Mrs. Horenburger moved that Jimmy Weatherspoon be declared as the winner as he was the only candidate who filed for Council Member - Seat No. 4, to be seated as of March 27, 1986 for a two-year term ending in accordance with the City Charter, seconded by Mr. Bird. Upon roll call Council voted as follows: Mr. Bird - Yes; Mrs. Horenburger - Yes; Mr. Jackel - Yes; Mr. Weatherspoon - Yes; Mayor Campbell - Yes. Said motion passed with a 5 to 0 vote. Mayor Campbell declared the meeting adjourned at 1:53 A.M.
