06-04-86SpMtg JUNE 4, 1986 A Special Meeting of the City Council of the City of Delray Beach, Florida, was called to order by Mayor Doak S. Campbell in the Council Chambers at City Hall at 5:10 P.M., Wednesday, June 4, 1986. Roll call showed: Present - Council Member Richard J. Dougherty Council Member Marie Horenburger Mayor Doak S. Campbell Absent - Council Member Malcolm T. Bird Council Member Jimmy Weatherspoon Also present were - City Manager James L. Pennington and City Attorney Herbert W.A. Thiele. Mayor Campbell called the meeting to order and announced that this meeting has been called for the purpose of (1) considering approval of "First Rider to Agreement"/Revised Final Draft of Agreement between City, School Board, Flemings/Coury Investments, Ltd. regarding Barwick Road School Site. 1. Mayor Campbell reported that at last night's meeting it was the consensus of Council that the form of the contract, which would require the City to be responsible for all aspects of the dredging for the drainage pond on the Fleming property, was unacceptable to the City. Unfortunately, they have been unable to reach an agreement with the seller or transferer and at this time they need some action by Council with regard to the contract. Mrs. Horenburger moved to approve the contract as presented by the June 2nd letter and rider, seconded by Mr. Dougherty. Upon roll call Council voted as follows: Mr. Dougherty - No; Mrs. Horenburger - No; Mayor Campbell - No. Said motion FAILED with a 3 to 0 vote. Before roll call, Mrs. Horenburger stated that she does not believe the City is in a position to commit the extra funds for the dredging work and for that reason she will have to vote against the contract as it is written. At this point the roll was called to the motion. Mayor Campbell declared the meeting adjourned at 5:15 P.M.
