A Special Meeting of the City Council of the City of Delray
Beach, Florida, was called to order by Mayor Doak S. Campbell in the
Council Chambers at City Hall at 7:00 P.M., Tuesday, September 16, 1986.
Roll call showed:
Present - Council Member Malcolm T. Bird
Council Member Richard J. Dougherty
Council Member Marie Horenburger
Council Member Jimmy Weatherspoon (Arrived 7:10 PM)
Mayor Doak S. Campbell
Absent - None
Also present were - City Manager James L. Pennington, City
Attorney Herbert W.A. Thiele and
Assistant City Attorney Jeffrey Kurtz
Mayor Campbell called the meeting to order and announced that
this meeting has been called for the purpose of (1) considering the
waiver of Chapter 4 of the Delray Beach Code of Ordinances so that the
Boynton/Delray Beach Exchange Club may sponsor a circus within the City
limits of Delray Beach, Florida, on October 29, 1986, and consideration
of emergency exception to notice requirements; and (2) considering
approval of agreement with Waste Management, Inc., for special trash
pickup October 6 through October 25, 1986.
1. The Assistant City Attorney advised that Council will have to
decide whether or not to waive the notice requirements of the City's
waiver ordinance; to do that they must make the determination that there
is an emergency nature to this request not of the applicant's doing.
Larry Sweatte, Boynton/Delray Beach Exchange Club, advised that
the location for the circus will be at Layer's international Resort; he
has received approval from the Engineering Department and Public Utili-
ties. He stated if they do not get the emergency approval this evening
they would not have time to promote the circus, get in their telephone
lines, or get tickets, brochures and billboards printed.
Mr. Dougherty moved to approve this as an emergency considera-
tion, seconded by Mr. Bird. Upon roll call Council voted as follows:
Mr. Bird - Yes; Mr. Dougherty - Yes; Mrs. Horenburger - Yes; Mayor
Campbell - Yes. Said motion passed with a 4 to 0 vote.
Mr. Sweatte displayed a diagram of the location for the circus.
There is almost five acres of land, plenty of room for parking and
activity will be on Layer's Circle, not on Linton Boulevard.
Mr. Dougherty moved to waive Chapter 4 of the City Ordinances
which preclude a circus in the City limits of Delray, seconded by Mr.
Bird. Upon roll call Council voted as follows: Mr. Bird - Yes; Mr.
Dougherty - Yes; Mrs. Horenburger - Yes; Mayor Campbell - Yes. Said
motion passed with a 4 to 0 vote.
Mr. Weatherspoon arrived at this time.
2. Mr. Bird moved for approval of agreement with Waste Management,
Inc., for special trash pickup October 6 through October 25, 1986,
seconded by Mr. Dougherty.
Mrs. Horenburger stated there are at least two or three trash
piles just east of here that have not only been there for a considerable
amount of time, but in fact have grown; one is just back of Publix on
N.E. 3rd Street between Swinton and 1st Avenues. She stated she felt
Council should see a recommendation to speed up the process for removing
these piles of trash from the City Manager or City Attorney's Office.
Mr. Bird advised that about the time of the City Manager's
arrival they were all to be issued some sort of a book of tickets that
said here is where there is a problem and turn them in and get action;
all City employees driving around the City would have these. It would
seem to him the failure is in our system.
Elizabeth Matthews, 1024 White Drive, advised that last year
the City made a concerted effort to clean up all the weeds which were
along Federal Highway, where they sprout through the edge of the curb.
On North Federal, north of the City's well kept median, the weeds are
extremely high and she would hope that the City forces could get out and
spray them.
Mr. Dougherty questioned why the figure of $6.75 per cubic year
is used. The Assistant City Manager advised that the tonnage figure and
the cubic yard are going up October lat. The cubic yardage figure could
probably be eliminated because everything is based on tonnage. Mr.
Dougherty recommended that this be eliminated.
The City Manager reminded Council that the City budgeted
$135,000 in this coming year's budget and will not be able to do three
pickups with this amount; before the years end they will ask for a new
appropriation.
Mr. Bird amended his motion to show that it is their intention
that the billing shall be done and the records kept on the basis of
tonnage and man-hours, Mr. Dougherty amended his second. Upon roll call
Council voted as follows: Mr. Bird - Yes; Mr. Dougherty - Yes; Mrs.
Horenburger - Yes; Mr. Weatherspoon - Yes; Mayor Campbell - Yes. Said
motion passed with a 5 to 0 vote.
Mayor Campbell declared the meeting adjourned at 7:20 P.M.
