12-02-86 DECEMBER 2, 1986 A Regular Meeting of the City Council of the City of Delray Beach, Florida, was called to order by Mayor Doak S. Campbell in the Council Chambers at City Hall at 7:06 P.M., Tuesday, December 2, 1986. 1. Roll call showed: Present - Council Member Malcolm T. Bird Council Member Richard J. Dougherty Mayor Doak S. Campbell Absent - Council Member Marie Horenburger Council Member Jimmy Weatherspoon Also present were - City Manager James L. Pennington and Assistant City Attorney Jeffrey Kurtz. 2. The opening prayer was delivered by Reverend Ralph Nygard, Barwick Road Baptist Church. 3. The Pledge of Allegiance to the flag of the United States of America was given. 4. Mayor Campbell stated that there are a lot of land use ordi- nances of the agenda tonight and this will be the third time they have considered these changes. He suggested that if any Council Member has a particular problem with any of the land use changes or they anticipate discussion and/or debate on any item they should postpone them until next week so that the full Council will have an opportunity to discuss it. The Assistant City Attorney advised that Council has been furnished four additional land use change ordinances; they are Ordinance Nos. 157-86, 158-86, 159-86 and 160-86. He requested that these be added to the agenda to become Items 63 a, b, c and d. Mr. Bird moved for agenda approval with the addition of Items 63 a, b, c and d. Mr. Dougherty requested that Item 63 be placed as first item on the Public Hearing portion of the agenda as he feels the Policy Guide to the Land Use Element of the Comprehensive Plan should be adopted prior to the land use changes. Mr. Bird amended his motion to approve the agenda with Item 63 placed as first item of business of the Public Hearings and the Public Hearings to read, sequentially, Items 5 through 63, adding 63 a, b, c and d, seconded by Mr. Doughertyo Upon roll call Council voted as follows: Mr. Bird - Yes; Mr. Dougherty - Yes; Mayor Campbell - Yes. Said motion passed with a 3 to 0 vote. PUBLIC HEARING 63. Ordinance No. 155-86 - Policy Guide. Ordinance No. 155-86, relative to adopting the Policy Guide to the Land Use Element of the Comprehensive Plan, is before Council for consideration on First Reading and First Public Hearing. If passed, Second Public Hearing will be held December 16th. Prior to consideration of passage of this ordinance on First Reading, a public hearing has been scheduled to be held at this time. Ordinance No. 95-86 - Changing the City's Land Use Plan Desig- nation (Weir). Ordinance No. 95-86, relative to changing the City's Land Use Plan Designation in the Comprehensive Plan for a 10-acre parcel from SF to PCC, located on the east side of Germantown Road, between Queens Avenue and Georgia Street, if extended eastward, is before Council for consideration on First Reading and First Public Hearing. If passed, Second Public Hearing will be held December 16th. Prior to consideration of passage of this ordinance on First Reading, a public hearing has been scheduled to be held at this time. Ordinance No. 96-86, relative to changing the City's Land Use Plan Designation in the Comprehensive Plan for an 18-acre City-owned parcel from P to RM, located at the southwest corner of S.W. 8th Avenue and S.W. 4th Street, is before Council for consideration on First Reading and First Public Hearing. If passed, Second Public Hearing will be held December 16th. Prior to considera- tion of passage of this ordinance on First Reading, a public hearing has been scheduled to be held at this time. Before roll call the following discussion was had: Mr. Dougherty stated that he noticed that the Planning and Zoning Board will reconsider these items tomorrow; he questioned why they are reconsidering them. Sheryl Stolzenberg, Planning Department, stated that Council requested that they return these ordinances to the P&Z Board for them to take a look at any comments received from the State or other review agencies. Mr. Bird explained that the reason he is deferring this item is that he asked staff to research this item with regard to the uses which were acceptable to the County at the time they transferred the property; at this point he is not sure what all those uses are. At this point the roll was called to the motion. 7. Ordinance No. 99-86 - Chanqing the City's Land Use Plan Desig- nation. Ordinance No. 99-86, relative to changing the City's Land Use Plan Designation in the Comprehensive Plan for a parcel of land from P to CF, located south of DeCarie Street and east of Seacrest Boulevard, is before Council for consideration on First Reading and First Public Hearing. If passed, Second Public Hearing will be held December 16th. Prior to consideration of passage of this ordinance on First Reading, a public hearing has been scheduled to be held at this time. Before roll call, Mayor Campbell stated that the reason they are deferring certain ordinances is that they need three votes to pass anything. If one Council Member votes it down the ordinance would die. Out of courtesy, they are postponing them to next week when they will have a full board. At this point the roll was called to the motion. 11. Ordinance No. 103-86 - Changing the City's Land Use Plan Designation. Ordinance No. 103-86, relative to changing the City's Land Use Plan Designation in the Comprehensive Plan for a parcel from MF-10 to C, located south of the Delray Drive-In and east of U.S. Highway No. 1, is before Council for consideration on First Reading and First Public Hearing. This particular property has a nursery on it so they have to bring it in making that a permitted use. Mayor Campbell stated that what they are doing tonight is saying that the permissible uses are going to be either agricultural or residential. The Planning and Zoning Board and the Acting Planning Director recommend approval, subject to the following conditions: Technical and Code Requirements 1. Alice Finst, representing the Board of Directors of the Home- owners League of Chatelaine, stated that in April of 1983 a conditional use was approved for this church with 14 conditions. She questioned if this approval will eliminate all the old conditions. Stan Weedon, Acting Planning Director, advised he will have to go and get the file on this item to be able to answer Mrs. Finst. At this point the roll was called to the motion. 67. Mr. Weedon advised that there are three items which would be deleted from the old conditions of approval. Those relate to the number of seats permitted, the number of parking spaces and that there be no further addition of parking to the site. The last condition is under reconsideration with this conditional use as they would have to provide additional parking to meet the additional seating. The other conditions would remain as originally stated.
