A Special Emergency Meeting of the City Council of the City of
Delray Beach, Florida, was called to order by Mayor Doak S. Campbell in
the Council Chambers at City Hall- at 8:45 P.M., Tuesday, December 9,
1986.
Roll call showed:
Present - Council Member Malcolm T. Bird
Council Member Richard J. Dougherty
Council Member Marie Horenburger
Council Member Jimmy Weatherspoon
Mayor Doak S. Campbell
Absent - None
Also present were - City Manager James L. Pennington and
City Attorney Herbert W.A. Thiele.
The City Manager reported this meeting is called due to the
collapse of the seawall at the City Marina. City forces have been
working on this since 7:30 A.M., Saturday morning trying to restore the
existing seawall; they went back with the City's consulting engineer,
Coastal Planning & Engineering, and negotiated with the two low bidders
for the actual replacement of 500 feet of seawall. The total bid for
both companies was $112,500. The consultant recommended the bid be
awarded to B.K. Marine Construction at the rate of $225 per foot; the
main reason they were selected was due to the timeframe which takes 60
days to complete. The City Manager advised he needs Council authoriza-
tion to proceed.
Mrs. Horenburger moved to declare an emergency and to conduct a
special emergency meeting this date, seconded by Mr. Weatherspoon. Upon
roll call Council voted as follows: Mr. Bird - Yes; Mr. Dougherty -
Yes; Mrs. Horenburger - Yes; Mr. Weatherspoon - Yes; Mayor Campbell -
Yes. Said motion passed with a 5 to 0 vote.
Mrs. Horenburger advised she received a phone call from a
resident on N.E. 2nd Street that deadends at a seawall; apparently there
has been an ongoing problem there as well. She suggested assessing
other spots where there are small pieces of seawall that are posing
problems and include them in this contract.
The City Manager stated he would have a problem with that since
the contract they negotiated with is coming out of the Marina Fund and
negotiated specifically for this one section; most of those other
problems the City can probably handle by itself.
Mrs. Horenburger stated her point is that since they are
calling the collapse of the Marina seawall an emergency she would
venture to say that the people that live where these other problems are
occurring would consider that an emergency as well; she believed their
problems need to be addressed just as quickly as possible.
Mr. Bird moved to approve the contract with B.K. Marine Con-
struction for 500 feet of seawall at $225 per foot for a total of
$112,500, funds to come from the Marina Fund, seconded by Mrs.
Horenburger.
Mr. Dougherty asked if there was that much money in the Marina
Fund. The City Manager advised right now there is $96,083; the remain-
der would have to come from either surplus or Council contingency.
Mr. Bird amended his motion to state that $96,083 would come
from the Marina Fund and the remainder would come from surplus, Mrs.
Horenburger amended her second. Upon roll call Council voted as fol-
lows: Mr. Bird - Yes; Mr. Dougherty - Yes; Mrs. Horenburger - Yes; Mr.
Weatherspoon - Yes; Mayor Campbell - Yes. Said motion passed with a 5
to 0 vote.
The City Manager reported he wanted Council to be aware that
they are looking at roughly $25,000 additional to reinstall the utility
lines, remounting the pedestals and another $10,000 to do repair to the
seawall at the south end of the Marina.
Mayor Campbell declared the meeting adjourned at 8:50 P.M.
