A Special Meeting of the City Council of the City of Delray
Beach, Florida, was called to order by Mayor Doak S. Campbell in the
Council Chambers at City Hall at 7:05 P.M., Tuesday, December 9, 1986.
Roll call showed:
Present - Council Member Malcolm T. Bird
Council Member Richard J. Dougherty
Council Member Marie Horenburger
Council Member Jimmy Weatherspoon
Mayor Doak S. Campbell
Absent - None
Also present were - City Manager James L. Pennington and
City Attorney Herbert W.A. Thiele.
Mayor Campbell called the meeting to order and announced that
this meeting has been called for the purpose of:
(1) Considering selection of Beautification Consultant - 10 minutes
allowed each:
Sasaki Associates, Inc.
H. Kurt Kettelhut & Associates
Urban Design Studios
Chris O'Hare
Mayor Campbell stated that after they have heard from the four
consultants they can then decide if they want to vote on any kind of
ranking or whether they want to have additional consideration and vote
on it next week.
Following discussion, it was the consensus of Council to have
the oral presentation tonight and have the formal ranking next Tuesday.
a. George Botner, representing Sasaki Associates, Inc., introduced
Dick Sheremeta and Mollie Feltham who would provide civil engineering,
surveying and project management services if they were to be chosen. He
outlined the background and organization of Sasaki Associates, Inc. and
presented slides to show representative examples of their streetscape,
redevelopment and landscape work. He stated that they pride themselves
on having a wide array of information at their disposal as it relates to
redevelopment for coastal communities like Delray.
Dick Sheremeta, Sheremeta Associates Consulting Engineers,
stated they are honored, as a local Delray beach firm, to be part of
this project team and to be considered for the street beautification
program. Their part in this team effort will be to act as a local
liaison between the project team and the City.
b. Kurt Kettelhut, representing H. Kurt Kettelhut & Associates,
stated that they have spent a great deal of time familiarizing them-
selves with the road system in Delray and some of the problems which
will have to be dealt with. He outlined the background and credentials
of the firm and presented some slides showing some of their previous
work.
c. Frank Maroni, representing Urban Design Studios, advised that
his office functions in three distinctive divisions; urban planning,
landscape architecture and graphic design. He feels this is important
as they interrelate and will cause the process to be streamlined. He
presented the firm's credentials and presented slides showing the
different types of streets and how they landscaped them.
Mr. Dougherty stated that they have a hold harmless clause in
their proposal and questioned why. Mr. Maroni stated that the clause
would only be effective if the City does not allow them to participate
in the last phase of the work.
Upon question by Mr. Weatherspoon, Mr. Maroni stated that there
will be no heavy engineering in this project; for any electrical or
plumbing engineering they do have an in-house consultant they would use.
Therefore, they do not contract with any independent engineering firm.
d. Chris O'Hare, representing Christopher F. O'Hare, Inc., stated
the beautification of Delray's roadways is an opportunity to reveal and
enhance the uniqueness which is Delray Beach. He stated that being a
member of this community means that they have been able to observe the
conditions of the roadways and have a real concern for, and a vested
interest in, the successful completion of this project. He believes
this project is the single most important undertaking in Delray's recent
history. He advised that his firm is committed to Delray Beach and is
concerned that this project achieves the highest standards of design,
gets the best value for the City's dollars, uses local labor and materi-
als to keep the dollars circulating in the community, is completed as
quickly as possible, is well conceived and planned and is spread out
equally throughout the community. If chosen, they will do their utmost
to achieve these goals.
Upon question by Mr. Dougherty as to whether or not he has
sufficient base data available to get underway, Mr. O'Hare stated that
he would like to keep the limit of surveying to a minimum. Hopefully, a
lot of the base maps will be available through the County and State.
Mayor Campbell stated that Council has also received a recom-
mendation from staff that they separate some of this work into two
phases; one, basically on Atlantic Avenue and then the remainder of the
project. They should decide if this is something they want to follow
through with; if so, they should have two rankings.
(2) Considering transfer of $55,000 from the Recreation Impact Fee
Fund to the 1985 Community Development Fund for the Carver Park Improve-
ment Project. Transfer will supplement Block Grant Funds ($78,240) and
School Board Funds ($45,000).
Mr. Bird moved to transfer $55,000 from the Recreation Impact
Fee Fund to the 1985 Community Development Fund for the Carver Park
Improvement Project, seconded by Mrs. Horenburger. Upon roll call
Council voted as follows: Mr. Bird - Yes; Mr. Dougherty - Yes; Mrs.
Horenburger - Yes; Mr. Weatherspoon - Yes; Mayor Campbell - Yes. Said
motion passed with a 5 to 0 vote.
(3) Considering award of contract to McTeaque Construction Co.
Inc., in the amount of $171,375 for the construction of three baseball
fields, a soccer field, asphalt exercise trail, and water fountain.
Award includes base bid and alternates 1 and 3.
Mr. Bird moved to award a contract to McTeague Construction Co.
Inc., in the amount of $171,375, seconded by Mrs. Horenburger. Upon
roll call Council voted as follows: Mr. Bird - Yes; Mr. Dougherty -
Yes; Mrs. Horenburger - Yes; Mr. Weatherspoon - Yes; Mayor Campbell -
Yes. Said motion passed with a 5 to 0 vote.
(4) Considering appointment of a member to the Planning and Zoning
Board to the unexpired term of John Vislocky - ending September 28,
1988.
Mayor Campbell stated that he will abstain from voting at this
time. He appreciates the recommendations from the Planning Department
staff; however, he does not know the three people and he has not had the
opportunity to meet them.
Mrs. Horenburger stated they did discuss the whole concept of
the Planning and Zoning Board and the possibility of making two separate
agencies. She does not know if the timing is right to appoint someone
else and she would like to further discuss that concept.

Mr. Bird stated he feels it is appropriate to fill the position
on the Board. If they later choose to change the composition they can
do so.
Mr. Dougherty moved to appoint Bill Andrews to the Planning and
Zoning Board to a term ending September 28, 1988, seconded by Mr. Bird.
Upon roll call Council voted as follows: Mr. Bird - Yes; Mr. Dougherty
- Yes; Mrs. Horenburger - Yes; Mr. Weatherspoon - Yes; Mayor Campbell -
Abstained. Said motion passed with a 4 to 0 vote, with Mayor Campbell
abstaining.
(5) Ordinance No. 96-86 - Changing the City's Land Use Plan Desig-
nation (Urban Homesteading Program). Ordinance No. 96-86, relative to
changing the City's Land Use Plan Designation in the Comprehensive Plan
for an 18-acre City-owned parcel from P to RM, located at the southwest
corner of S.W. 8th Avenue and S.W. 4th Street, is before Council for
consideration on First Reading. If passed, Second Public Hearing will
be held December 30th, 1986. (The First Public Hearing was held Decem-
ber 2, 1986).

The City Attorney stated he has a concern with regard to the
number of times these ordinances may be considered to be a change to the
Land Use Plan. He would recommend that all of the second readings and
public hearings on land use ordinances occur on the same day. There-
fore, all the second readings and second public hearings on these
ordinances, as listed on the agenda, and those which had otherwise been
noticed for the 16th or 23rd will be renoticed for second reading and
second public hearing on the 30th of December at 7:00 P.M., in the
Council Chambers.

Mr. Bird stated that the problem he has with this ordinance
goes back to the issue of the existing trailer park on the north end of
town, just south of the Drive-In. That land is divided with the east
section to be multi-family and the west section to be commercial. His
concern is that they are going to make it difficult to put a quality
project on the waterway side if they have it butting up against commer-
cial. He feels they should decide whether the land is going to be all
commercial or all residential. They have residential abutting the
entire parcel on the south side and he feels a buffer of residential
would make more sense.
Mr. Bird stated that if they agree the commercial should go
then the next item, Ordinance No. 103-86, would be defeated. If they
did not pass either Ordinance Nos. 102-86 or 103-86 then they would end
up with MF-10 on the entire parcel.

Dan Burns stated he is the owner of this property and he
disagrees with the office designation; he would like to see a commercial

Mr. Bird requested that staff redraft this ordinance for first
reading changing it from office to commercial.
Mr. Weatherspoon noted that the ordinance should read S.W. 4th
Avenue, not S.W. 4th Street.
(11) Ordinance No. 129-86 - changing the City's Land Use Plan
Designation. Ordinance No. 129-86, relative to changing the City's Land
Use Plan Designation in the Comprehensive Plan for a parcel from MF-10
to MF-M, located west of Congress Avenue, east of Davis Road, north of
the L-32 Canal and south of Lake Ida Road, is before Council for consid-
eration on First Reading. If passed, Second Public Hearing will be held

not feel it was appropriate to have further commercial type activity

in part, and C, in part, to C, located west of Fredrick Boulevard,
between Avenue F and LaMat Avenue, is before Council for consideration
on First Reading. If passed, Second Public Hearing will be held Decem-

UNITS/ACRE), IN PART, AND C (COMMERCIAL, IN PART, TO C
(COMMERCIAL). THE SUBJECT PROPERTY IS LOCATED WEST OF
FREDRICK BOULEVARD, BETWEEN AVENUE F AND LAMAT AVENUE;
AMENDING THE LAND USE PLAN; PROVIDING AN EFFECTIVE DATE.

Mr. Bird moved for the adoption of Ordinance No. 145-86 on
First Reading, seconded by Mr. Weatherspoon. Upon roll call Council
voted as follows: Mr. Bird - Yes; Mr. Dougherty - No; Mrs. Horenburger
- Yes; Mr. Weatherspoon - Yes; Mayor Campbell - Yes. Said motion passed
with a 4 to 1 vote.
Before roll call, Mr. Dougherty stated that he disagrees with
creating any more commercial in this area.
At this point the roll was called to the motion.
Mayor Campbell declared the meeting adjourned at 8:44 P.M.
