A Special Meeting of the City Commission of the City of Delray
Beach, Florida, was called to order by Mayor Doak S. Campbell in the
Commission Chambers at City Hall at 7:02 P.M., Tuesday, December 30,
1986.
Roll call showed:

Mayor Campbell called the meeting to order and announced that
this meeting has been called for the purpose of:
1. Ordinance No. 86-86 - Amending Zoning Code - Off-Street Parking
- Community Facilities. Ordinance No. 86-86, amending Chapter 30
"Zoning" of the Code of Ordinances relative to off-street parking
regulations for Community Facilities, is before the Commission for
consideration on Second and FINAL Reading. Prior to consideration of
passage of this ordinance on Second and FINAL Reading, a public hearing
has been scheduled to be held at this time.
The Assistant City Manager presented Ordinance No. 86-86:

Mr. Bird moved for the adoption of Ordinance No. 86-86 on
Second and FINAL Reading, seconded by Mrs. Horenburger. Upon roll call
the Commission voted as follows: Mr. Bird - Yes; Mrs. Horenburger -
Yes; Mr. Weatherspoon - Yes; Mayor Campbell - Yes. Said motion passed
with a 4 to 0 vote.
2. Ordinance No. 90-86 - Changing the City's Land Use Plan Desig-
nation (Lehman). Ordinance No. 90-86, relative to changing the City's
Land Use Plan Designation in the Comprehensive Plan for a 2.317-acre
parcel from MF-10 (Multiple Family), 10 units/acre to C (Commercial),
located on the south side of Lindell Boulevard, between U.S. Highway 1
and Dixie Highway, is before the Commission for consideration on Second
and FINAL Reading. Prior to consideration of passage of this ordinance
on Second and FINAL Reading, a public hearing has been scheduled to be
held at this time.

The City Attorney read the caption of the ordinance. A public
hearing was held having been legally advertised in compliance with the
laws of the State of Florida and the Charter of the City of Delray
Beach, Florida.
Don Hassler, 644 Jaeger Drive, stated they are opposed to the
automobile dealership being proposed for this property. They were told
that there was to be a meeting on January 13th when they could discuss
this matter.
Mayor Campbell advised that there is no automobile dealership
being discussed tonight; they are only discussing the land use plan
designation and rezoning. An automobile dealership cannot be allowed in
the City unless it goes through the conditional use approval process;
this will not be done until they have had a full hearing and listen to
the public to determine if it is appropriate. The conditional use
approval has been scheduled for the January 13th meeting.
The public hearing was closed.
Mr. Bird moved for the adoption of Ordinance No. 90-86 on
Second and FINAL Reading, seconded by Mr. Weatherspoon. Upon roll call
the Commission voted as follows: Mr. Bird - Yes; Mrs. Horenburger -
Yes; Mr. Weatherspoon - Yes; Mayor Campbell - Yes. Said motion passed
with a 4 to 0 vote.
3. Ordinance No. 91-86 - Lehman Rezoning. Ordinance No. 91-86,
relative to rezoning a 2.317-acre parcel from RM-10 (Multiple Family
Dwelling) District to SC (Specialized Commercial) District, located on
the south side of Lindell Boulevard, between U.S. Highway No. 1 and
Dixie Highway, is before the Commission on Second and FINAL Reading.
Prior to consideration of passage of this ordinance on Second and FINAL

Paul Smith, 924 Jasmine Drive, stated that if the Commission is
going to put a commercial zoning on the property this evening they
should leave it as commercial, not specialized commercial which would
open it up to the possibility of a conditional use.
Jean Beer, 945 Tropic Boulevard, stated she can see no reason
why they have to designate this property specialized commercial at this
time.
Dr. Brent Carper, 932 Jasmine Drive, concurred with Mr. Smith
and Mrs. Beer that this property should be commercial; however, he would
request that the Commission postpone a decision in making it specialized
commercial until they have the meeting on January 13th.
The public hearing was closed.
Mrs. Horenburger questioned if there is anything to prevent
them from postponing this rezoning until after January 13th when the
conditional use will be discussed. The City Attorney advised there is
not.
Mrs. Horenburger moved to postpone this item until the next
regular meeting after January 13th, seconded by Mr. Weatherspoon. Upon
roll call the Commission voted as follows: Mr. Bird - No; Mrs.
Horenburger - Yes; Mr. Weatherspoon - Yes; Mayor Campbell - Yes. Said
motion passed with a 3 to 1 vote.
Before roll call the following discussion was had:
Roger Saberson, representing Mr. Lehman, stated that the entire
parcel is approximately 10 acres and is already zoned specialized
commercial; the portion of the property proposed to be rezoned tonight
is only 2.1 acres. If the Commission decides, for any reason, at a
later date that the automotive use is not something they want, then they
will have the authority to back down the conditional use approval and
the property would be available for other uses under specialized commer-
cial.
Mr. Weatherspoon stated he has no problem delaying this rezon-
ing until after January 13th.
At this point the roll was called to the motion.
4. Ordinance No. 95-86 - Changing the City's Land Use Plan Desig-
nation (Weir). Ordinance No. 95-86, relative to changing the City's
Land Use Plan Designation in the Comprehensive Plan for a 10-acre parcel
from SF to PCC, located on the east side of Germantown Road, between
Queens Avenue and Georgia Avenue, is before the Commission for con-
sideration on Second and FINAL Reading. Prior to consideration of
passage of this ordinance on Second and FINAL Reading, a public hearing
has been scheduled to be held at this time.

for an 18-acre City-owned parcel from P to RM, located at the southwest
corner of S.W. 8th Avenue and S.W. 4th Street, is before the Commission
for consideration on Second and FINAL Reading. Prior to consideration

Alice Finst, 707 Place Tavant, questioned if there has to be
any semblance of a family before you have the three unrelated adults.
The City Attorney advised that any three unrelated adults would consti-
tute a family.
Mr. Bird stated he is still not happy with the definition of
family as each of the adults could have five children. He has asked
staff to review, in accordance with the Federal guidelines, how many
people can sleep in a bedroom. He feels they can draw the line at how
many unrelated children there can be.

is before the Commission for consideration on Second and FINAL Reading.

65. Possible purchase of additional parking for new Civic center
and City Hall.
Mayor Campbell advised they have received some appraisals from
staff. He found them to be very high and, personally, would like a
chance to digest the information and reappraise the situation before
saying yes or no.
Mrs. Horenburger stated she feels they need to workshop this
item and look at the possibility of buying some of the land, not all of
it.
It was the consensus of the Commission to pass over this item
tonight and place it on a workshop agenda.
66. Settlement of City of Delray Beach vs. Georgia Town Tavern.

The City Attorney advised that subsequent to filing the lawsuit
against the corporate entity, Gulfbrook, Inc., who is the owner of the
Georgia Town Tavern, they were approached by one of the principals, Mr.
Thomas, who offered to settle the case with the City, rather than
litigate the matter to conclusion. This would avoid the upcoming
temporary injunction hearing, and the legal fees and costs, by them
agreeing to close down operations of the tavern immediately. For that
permanent closure, the City would agree to purchase the property and the
liquor license. The settlement offer is $110,000 for the liquor license
and $65,000 for the .property. Mr. Thomas had also offered that these
two issues were severable from each other, i.e., that the City could
purchase either or both of these two items. He delivered copies of a
proposed stipulation to Mr. Thomas's attorney this afternoon and was
informed that the severability offer is withdrawn and they would only be
willing to settle the case if the City purchases both the liquor license
and the property. They had negotiated not only the sale of the property
with Mr. Thomas, but also his agreement that neither he nor Gulfbrook
would use the liquor license anywhere else within the limits of the City
of Delray Beach or sell it to any other individual or corporation who
would use it. This was acceptable to Mr. Thomas; however, either he has
had a change of heart or his attorney is not clear as to what Mr. Thomas
had discussed with the City. The City is obligated to take the position
this evening that his attorney's comments are the final offer, unless
they wish to make a counter proposal. Therefore, what the Commission
has before them is an offer from the defendants, through their attorney,
to settle the case provided the City will purchase from them both the
liquor license and the real property for $175,000.
Upon question by Mrs. Horenburger, the City Attorney stated he
believes they will not be at issue, and to trial, until the latter part
of 1987 or early 1988 and would anticipate that the City's indirect and
direct costs would probably be around $5,000 to $10,000 to successfully
litigate the case. However, even though they might be successful in
getting the Court to find that that property is a public nuisance, the
Court would issue an injunction which would require Gulfbrook to abate
that nuisance. Gulfbrook would then have the ability, in the future, to
petition the Court to dissolve the injunction if they could show that
the establishment had gotten rid of those things the City claimed were a
public nuisance.
Mrs. Horenburger stated she, personally, would like to see the
City take this property and begin to redevelop the area.
Mr. Bird stated they have a high incidence of unacceptable
behavior at several other bars in the immediate area and there is
nothing to suggest to him that that will abate as a result of them
buying the Georgia Town Tavern. He feels that much of the problem will
be forced to migrate to other locations and that will impose a burden on
people who didn't have a problem before. He feels that being willing to
go to court to abate a problem sends a very clear message to others. He
is prepared to pursue this through the courts and would be of a mind
that they direct the City Attorney to continue on that course.
Mr. Weatherspoon stated that he feels closing the doors of the
Georgia Town Tavern will not address the real problem which is the lack
of enforcement of rules and regulations. He does not believe the City
is in a position to become the owner of a tavern and should be more
concerned about the "crack" houses which are spreading throughout the
City. He feels that the City should spend no money going to court to
try and solve the problem and that there are a lot of other alternatives
they could address.
Mrs. Horenburger stated that she feels the Georgia Town Tavern
is a nuisance spot and magnet and if they do not do something dramatic
to clean it up then they are not keeping the commitments they made to
the community, the County and the people who live around that area.
Mayor Campbell stated he would not be in favor, at this time,
of the stipulation as drawn. There may be a point at which negotiations
could result in a stipulation which may be favorable to the City;
however, he is not prepared to support this one.

It was the consensus of the majority of the Commission to
reject the stipulation.
The City Attorney stated he will inform the defendants and will
pursue the case.
67. Adoption of a resolution authorizing issuance of Utility Tax
Revenue bonds in an amount not exceeding $10.5 million.

68. Competitive bids vs. negotiated sale of Utility Revenue Certif-
icates Issue.
Upon question by Mrs. Horenburger, the City Attorney stated
what they are looking for tonight is direction from the Commission as to
whether they want staff to put together a bid spec or seek proposals for
a negotiated sale.
Mrs. Horenburger stated she would like to look at the negotiat-
ed sale and get some facts and figures. Mr. Weatherspoon stated he
would concur with Mrs. Horenburger.
Mr. Bird stated he feels, if they put this Out for bid, they
will be confident that they have gotten the best they can for the
citizens of Delray Beach; however, should they go with the negotiated
settlement they will only have one opinion in this rather unsettled time
in the financial market.
Mayor Campbell stated his personal inclination is to go with
the negotiated sale as he would feel more comfortable in being able to
deal with individuals and there is less of a risk factor.
Upon question by Mayor Campbell, the City Attorney advised that
although Mudge, Rose and himself do not say it is mandatory, they would
recommend that they validate this issue. They could close with the
underwriter subject to the validation or the appeal period carrying out
before they change monies.
It was the consensus of the majority of the Commission to
proceed towards the negotiated sale and to have the bonds validated.
69. Formal granting of extension until January 31, 1987, for
Highland Park - Water Service Agreement.
Mrs. Horenburger moved to grant the extension until January 31,
1987 for Highland Park Water Service Agreement, seconded by Mr. Bird.
Upon roll call the Commission voted as follows: Mr. Bird - Yes; Mrs.
Horenburger - Yes; Mr. Weatherspoon - Yes; Mayor Campbell - Yes. Said

70. Conditional Use and Site Plan Approval - Office Building for
Dr. Chapman. The Commission is to consider a request for conditional
use and site plan approval for an office building for Dr. Chapman, a
proposed 1,098 square foot professional office building in an RM-10
Multiple Family Zoning District, located on the north side of N.E. 4th
Street, between N.E. 2nd Avenue and Swinton Avenue. The Planning and
Zoning Board and Planning Department recommend approval, subject to the
following conditions:
(1) Dedicate fifteen (15) feet of right-of-way for N.E. 4th
Street prior to Certificate of Occupancy.
(2) Maintain special setback of sixty-four (64) feet from
centerline of N.E. 4th Street for signage.
Procedural Requirements
(3) Replat is required, final plat recordation required prior
to certificate of occupancy.
(4) That all improvements be completed in accordance with the
approved site plan.
(5) This approval will expire within eighteen (18) months
unless at least twenty-five (25%) percent of the total
cost of improvements are made by that time. If the
approval expires, request for extension must be made in
accordance with Section 30-21(E) of the Zoning Code.

an office building for Dr. Chapman, seconded by Mrs. Horenburger. Upon

71. Consideration by City Council of the request of Bob Redmon for
a waiver/variance of the sign code, Section 9-208(D) Roof Signs for
"Doc's Soft Serve".
Mrs. Horenburger questioned if they are going to look at this
individually or look at all the sign code requirements.
The Assistant City Manager advised the Commission can proceed
with this in either one of two ways: (1) individually for "Doc's Soft
Serve" or (2) direct staff to proceed with some amendments to the
current code to take into consideration any other changes or waiver
process to go through CAB or the Board of Adjustment.
Mr. Bird stated he has a couple of legal concerns and one of
them is that they are talking about a sign which is located above a
,parapet. He noticed that several other signs similarly located have now
been removed by their owners having been put on notice by the City.
The City Attorney stated he feels they have a legitimate
defense to that if they make a modification to the ordinances; however,
he would have a different concern if they grant exceptions on an indi-
vidual basis.
Mr. Bird suggested that they have staff provide each Commis-
sioner with a list of every sign in the City which is still in violation
and what the specific problem is. If they are going to make a change,
they should do it once and for all and be done with it. He feels they
should review them all before they make any specific relief available to
anyone; then if they decide there are those which are meritorious they
can do them all at one time.
Upon question by Mrs. Horenburger, Mr. Bird stated he believes
such a list has been prepared by staff. Mrs. Horenburger stated she
would like to have the CAB members given a copy of the list and receive
their comments.
Mrs. Horenburger stated that the list of signs they will be
receiving are now in violation and she questioned if they are going to
put something in place, like a temporary relief, so that they do not
have to go before the Code Enforcement Board. The City Attorney advised

they have done something similar in the past where they directed staff
not to take them to the CEB, although they would be cited.
It was the consensus of the Commission not to grant a waiver
this evening, they will further investigate the issue and until they
have addressed the issue the signs will be cited but they will have an
abatement of any action by the CEB until the Commission has made their
final decision on the matter.
Mayor Campbell requested that they have this issue placed on
the workshop agenda of January 20th.
The City Attorney stated there is no other procedure currently
in the code other than a person having to come before the Commission
each time to request a waiver/variance from the sign code. He ques-
tioned if they would like to see these requests on a group or individual
basis or would they like to give the Board of Adjustment or Community
Appearance Board the authority to grant variances on signs.
Mr. Bird stated he feels that the Commission should be the
final word and they should get on with identifying just what those
parameters are.
72. Authorization by motion for the use of the City's Eminent
Domain authority by the CRA for acquisition of certain property in Block
53.

The City Attorney advised that this resolution would approve of
an agreement wherein they would be loaning, on a bridge loan basis, the
funds which would eventually be coming out of the bond issue. The
amount of the advance would be up to $400,000. The City would have a

mortgage on the properties which the CRA would acquire with those
monies. When the bond proceeds come in they will satisfy those mort-
gages and issue new ones.
75. Applicability of the City's Solicitation Ordinance to an
invitation-only type of charitable fund raisinq event.
The City Attorney stated he was contacted on the 24th of
December by a representative from the Leukemia Society requesting the
Commission's clarification of an ordinance. The charitable solicita-
tions ordinance is written quite broadly and, when asked to review it,
it was his opinion that despite what he believes the Commission's intent
to be, the ordinance was so broad as to require them to get the standard
approval. He did not believe that was the Commission's intent; however,
he thought he would confirm that with them before he told that to the
Leukemia Society and then draft the appropriate amendment.
Mr. Bird moved that they grant a waiver in this instance and
instruct staff to amend the ordinance so that those solicitations which
are by invitation by mail, or in person, as long as not door to door,
are exempted, seconded by Mr. Weatherspoon. Upon roll call the Com-
mission voted as follows: Mr. Bird - Yes; Mrs. Horenburger - Yes; Mr.
