A Special Meeting of the City Council of the City of Delray
Beach, Florida, was called to order by Mayor Doak S. Campbell in the
Council Chambers at City Hall at 7:05 P.M., Tuesday, January 8, 1985.
Roll call showed:
Present - Council Member Malcolm T. Bird
Council Member Marie Horenburger
Council Member Arthur Jackel
Council Member Jimmy Weatherspoon
Mayor Doak S. Campbell
Absent - None
Also present were - City Manager James L. Pennington, and
City Attorney Herbert W.A. Thiele.
M~ayor Campbell called the meeting to order and announced
that this meeting has been called for the purpose of (1) Second Reading
and PUBLIC HEARING on Ordinance No. 101-84 changing the City's Land Use
Plan Designation for a parcel of land in Section 20, Township 46 South,
Range 43 East; and (2) Second Reading and PUBLIC HEARING on Ordinance
No. 110-84 establishing a Department of Planning.
1. Ordinance No. 101-84, relative to changing the City's Land
Use Plan Designation in the Comprehensive Plan for a 20-acre parcel of
land located north of Linton Boulevard between Germantown Road and 1-95
(Sunny Acres), is before Council for consideration on Second and FINAL
Reading. Prior to consideration of passage of this ordinance on Second
and FINAL Reading, a public hearing has been scheduled to be held at
this time.
The City Manager presented Ordinance No. 101-84:
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, CHANGING THE CITY'S LAND USE PLAN DESIG-
NATION IN THE COMPREHENSIVE PLAN FOR A PARCEL OF LAND IN
SECTION 20, TOWNSHIP 46 SOUTH, RANGE 43 EAST FROM SF-
SINGLE FAMILY TO I-INDUSTRIAL; AMENDING THE LAND USE
PLAN; PROVIDING AN EFFECTIVE DATE.

The City Attorney read the caption of the ordinance. A
public hearing was held having been legally advertised in compliance
with the laws of the State of Florida and the Charter of the City of
Delray Beach, Florida. The public hearing was closed.
Mr. Jackel moved for the adoption of Ordinance No. 101-84 on
Second and FINAL Reading, seconded by Mr. Weatherspoon. Upon roll call
Council voted as follows: Mr. Bird - Yes; Mrs. Horenburger - Yes; Mr.
Jackel - Yes; Mr. Weatherspoon - Yes; Mayor Campbell - Yes. Said motion
passed with a 5 to 0 vote.
2. Ordinance No. 110-84, establishing a separate Department of
Planning is before Council for consideration on Second and FINAL Read-
ing. Prior to consideration of passage of this ordinance on Second and
FINAL Reading, a public hearing has been scheduled to be held at this
time.
The City Manager presented Ordinance No. 110-84:
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, AMENDING CHAPTER 2, "ADMINISTRATION", OF
THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH,
FLORIDA, BY AMENDING SECTION 2-1.5, "MUNICIPAL DEPART-
MENTS ENUMERATED", BY ADDING A NEW SUBSECTION (k) TO
ESTABLISH A PLANNING DEPARTMENT AND RELETTERING OTHER
SUBSECTIONS IN CONFORMITY THEREWITH; PROVIDING A SAVING
CLAUSE; PROVIDING AN EFFECTIVE DATE.

The City Attorney read the caption of the ordinance. A
public hearing was held having been legally advertised in compliance
with the laws of the State of Florida and the Charter of the City of
Delray Beach, Florida. The public hearing was closed.
Mr. Bird moved for the adoption of Ordinance No. 110-84 on
Second and FINAL Reading, seconded by Mr. Jackel. Upon roll call Coun-
cil voted as follows: Mr. Bird - Yes; Mrs. Horenburger - Yes; Mr.
Jackel - Yes; Mr. Weatherspoon - Yes; Mayor Campbell - Yes. Said motion
passed with a 5 to 0 vote.
Before roll call the following discussion was had:
Mr. Jackel stated he would like to make a few comments
concerning creating a Department of Planning. He made reference to a
remark made by Councilman Weatherspoon when this ordinance was passed on
first reading wherein Mr. Weatherspoon asked how much more will this
cost; the answer from the City Administration was "nothing extra". Mr.
Jackel stated this may be true initially, but within a year or two it
may not; a Department Head will always receive a higher pay scale than
someone heading a division under the Building Department. The Depart-
ment Head may also need a secretary and perhaps additional staff. The
second point he wished to make is, to his way of thinking, there is
nothing wrong with the present setup; it has worked effectively for the
past two or three years. Thirdly, as to the selection of a City Plan-
ner, he believed this person should come from the State of Florida, and
preferably, South Florida with knowledge of this County.
Mr. Bird advised, for Council's consideration, that when it
was a free standing department it had no more people than it does today;
in fact, it had fewer. He would agree with Mr. Jackel with regard to
getting the highest quality planner that is available at the price we
are willing to pay. He believes one of the enticements to be an ap-
plicant for the job is to have some autonomy; to be the planner, not a
subordinate to someone else and have a direct interface with the City
Manager.
Upon question by Mr. Weatherspoon as to the benefit of
making this a separate department directly reportable to the City Man-
ager and if this is consistent with the format of other municipalities,
the City Manager advised the benefit is primarily to the City Manager.
This is no reflection on the existing organization and personnel in-
volved; it happens to be a personal preference, a preference of the way
he has organized his operations in the past. He stated this varies from
community to community, but normally the Planning Director does have a
function such as this. With reference to a comment by Mr. Jackel, the
City is in the process of interviewing and the four finalists are from
South Florida.
Mr. Weatherspoon questioned the salary difference between a
Department Head and a subordinate. The City Manager advised that they
will be hiring strictly within the range that is set up; once that
individual is hired he is not going to come in and be raising that
person's salary 10 or 15 percent. The range now is from $28,000 to
right at $40,000.
Mr. Jackel stated he will defer to the judgment of the City
Manager, but he will be watching the budget very closely this year and
next to see how this develops.
At this point the roll was called to the motion.
