03-13-85SpMtg (2) MARCH 13~ 1985 A continuation of a Special Meeting of the City Council of the City of Delray Beach, Florida, was called to order by Mayor Doak S. Campbell in the Council Chambers at City Hall at 5:30 P.M., Wednesday, March 13, 1985. Roll call showed: Present - Council Member Malcolm T. Bird Council Member Marie Horenburger Council Member Arthur Jackel Mayor Doak S. Campbell Absent - Council Member Jimmy Weatherspoon Also present were - Acting City Manager Robert A. Barcinski and City Attorney Herbert W.A. Thieleo The City Attorney stated that after going through the bal- lots with the Supervisor of Elections they have some revised vote counts and results. The total votes for each of the candidates, including absentee ballots are as follows: Council Member TOTAL Malcolm T. Bird 2~829 + 42 Absentee 2,871 James "Pete" Bowen lt862 + 32 Absentee 1,894 Charles E. "Ed" Dalton 1~725 + 27 Absentee 1,752 Marie Horenburger 3~455 + 57 Absentee 3,512 Edward L. Perry 771 + 14 Absentee 785 The City Attorney advised there were a total of 10,642 votes cast for two council candidates; however, there were 464 single votes. With the help of the Supervisor of Elections they determined how many voters only voted for two Council Members and arrived at a figure of 5,553; they then added in the 89 absentee ballots to make a total of 5,642. Therefore, the new 50% + 1 figure needed would be 2,822. Mr. Bird received 2,871 votes or 49 more than would be necessary to avoid a run-off election. The City Attorney advised Council is going to have to make a motion amending the final vote count for each of the candidates, both regular, absentee and total, then adopt a motion which declares the one absentee ballot to be invalid and make a third motion declaring Mr. Bird elected to a Council seat of two years. Mr. Bird moved to amend the City Clerk's report concerning the regular vote, other than absentee votes, for the office of two Council Members and that the results will now read: Council Member Malcolm T. Bird 2~829 James "Pete" Bowen 1~862 Charles E. "Ed" Dalton lt725 Marie Horenburger 3,455 Edward L. Perry 771 Seconded by Mr. Jackel. Upon roll call Council voted as follows: Mr. Bird - Yes; Mrs. Horenburger - Yes; Mr. Jackel - Yes; Mayor Campbell - Yes. Said motion passed with a 4 to 0 vote. Mr. Bird moved to change the final vote tallies for each candidate to reflect the following figures: . ouncil Member Total Malcolm T. Bird 2,871 James "Pete" Bowen 1,894 Charles E. Upon roll call Council voted as follows: Mr. Bird - Yes; Mrs. Horenburger - Yes; Mr. Jackel - Yes; Mayor Campbell - Yes. Said motion passed with a 4 to 0 vote. Mrs. Horenburger moved to declare that Malcolm T. Bird has been elected as a Council Member for a two-year term commencing March 28, 1985 and ending in accordance with the City Charter, seconded by Mr. Bird. Upon roll call Council voted as follows: Mr. Bird - Yes; Mrs. Horenburger - Yes; Mr. Jackel - Yes; Mayor Campbell -Yes. Said motion passed with a 4 to 0 vote. Mrs. Horenburger moved to indicate that there were 89 valid absentee ballots cast and 1 invalid absentee ballot cast as they over- voted, seconded by Mr. Jackel. Upon roll call Council voted as follows: Mr. Bird - Yes; Mrs. Horenburger - Yes; Mr. Jackel - Yes; Mayor Campbell - Yes. Said motion passed with a 4 to 0 vote.
