A Special Meeting of the City Council of the City of Delray
Beach, Florida, was called to order by Mayor Doak S. Campbell in the
Council Chambers at City Hall at 7:00 P.M., Tuesday, April 2, 1985.
Roll call showed:
Present - Council Member Marie Horenburger
Council Member Arthur Jackel
Council Member Jimmy Weatherspoon
Mayor Doak S. Campbell
Absent - Council Member Malcolm T. Bird
Also present were - City Manager James L. Pennington, and
City Attorney Herbert W.A. Thiele.
Mayor Campbell called the meeting to order and announced
that this meeting has been called for the purpose of (1) considering
award of contract for Barwick Park; and, (2) considering acceptance of
bids for sale of confiscated property.
The City Manager thanked everyone in Delray Beach for all
the wonderful, kind treatment he received during his absence. It cer-
tainly helped to get him back to work more quickly.
1. The City Manager stated that regarding the analysis of the
bids, there were four items which their consultant, Mr. Sanders, felt
could be cut to bring the total bid amount down to $71,827. Based on
that, Mr. Sanders and staff would recommend award of the contract.
Mrs. Horenburger questioned the charges and whether or not
they are going to relocate the Sabal Palms and Ficus trees. Mr. Sanders
replied that they can buy brand new Sabal Palms for $130 apiece. They
feel that if the contractor knocks the trees down the City should look
into some other means of disposal, such as reselling or relocating, at
that time. He feels they should keep that underneath the Clearing and
Grubbing and not have to pay the contractor to reestablish the trees and
water them. Regarding fencing of the park, they felt it was not neces-
sary to provide a construction barrier; that would be a duplicated item.
Upon further question, Mr. Sanders advised that the clearing and grub-
bing costs were higher than anticipated.
Upon question by Mr. Weatherspoon about the fill, Mr.
Church explained that one problem is that the contractor does not have a
ready market to sell the fill. Secondly, he has a time limit of having
completed and been paid for this job by June 1st. Mr. Weatherspoon
suggested extending the time for a week or so. If the fill is worth $5
per cubic yar~ they are talking about approximately $55,000. A company
like Shaw Trucking has the equipment to move the fill in 2-3 days. He
spoke to Shaw today and they are in the market to buy fill. He sug-
gested directing staff to try and work something out with the Shaw
company to purchase that fill.
Mr. Church stated that if the City wanted to give the con-
tractor another two or three months and put a sign up reading "fill
available", he feels they could. However, the fact that the City wants
it finished and paid for by June 1st makes it difficult for the con-
tractor to commit otherwise.
The City Manager asked if there is a place on the site to
put this material. Mr. Sanders replied that the area they are removing
it from is the only open area on the site. They looked into putting it
in at the Sewer Plant but it was not needed there. They are not sure
what volume of fill might be needed at Miller Park; this is something
that might happen months down the road. The City Manager stated it is
his understanding that they cannot negotiate with anyone else nor inter-
fere with his work. He questioned whether they are certain they will be
removing this amount of fill. Mr. Sanders replied they got the fill
analysis from their Engineer and they assume it is accurate.
Mr. Sanders stated further that the best they could do was
the break even situation. Mr. Weatherspoon questioned who was called
about purchasing the fill and why Shaw was not called. Mr. Sanders
stated he does not have the list at this time.
The City Manager recommended that they award the contract as
is with the understanding that the City will do one of two things: (1)
find out if anyone is interested in the fill and can coordinate with it;
or (2) stockpile it themselves at one of their own sites. It will cost
them some money to do that but they are going to be doing work in the
north field and several other sites.
Mrs. Horenburger asked where this project was advertised for
bids and why they only received one bid. Mr. Sanders advised he be-
lieved that they advertised in the Fort Lauderdale News and Palm Beach
Post. Also they called around to people. They had about half a dozen
people pick up the drawings but only one submitted. Mr. Sanders dis-
cussed the difficulties involved in completing a project such as this,
i.e., the number of subcontractors needed and the amount of the grant.
Mrs. Horenburger moved to award the contract with the under-
standing that the City will do one of two things: (1) find out if anyone
is interested in the fill and can coordinate with it; or, (2) stockpile
it themselves at one of their own sites, seconded by Mr. Weatherspoon.
Upon roll call Council voted as follows: Mrs. Horenburger- Yes; Mr.
Jackel - Yes; Mr. Weatherspoon - Yes; Mayor Campbell - Yes. Said motion
passed with a 4 to 0 vote.
2. The City Manager reported that Council should consider
confirming the sale of three confiscated vehicles at the joint auction
with Boca Raton and Boynton Beach held over the weekend. The Corvette
was sold for $10,000, the Dusky Boat for $19,100, and the 4-door Packard
for $5,100. Staff was very pleased with these bids and recommend ap-
proval by Council.
Mr. Jackel moved to accept the bids for the confiscated
property as listed, seconded by Mr. Weatherspoon. Upon roll call Coun-
cil voted as follows: Mrs. Horenburger - Yes; Mr. Jackel - Yes; Mr.
Weatherspoon - Yes; Mayor Campbell - Yes. Said motion passed with a 4
to 0 vote.
Mayor Campbell declared the meeting adjourned at 7:20 P.M.
