A Special Meeting of the City Council of the City of Delray
Beach, Florida, was called to order by ~ayor Willard V. Young in the
Council Chambers at City Hall at 10:30 A.M., Monday, January 16, 1984.
Roll call showed:
Present - Council Member Malcolm T. Bird
Council Member Doak S. Campbell
Council Member Arthur Jackel
Council Member Edward L. Perry
Mayor Willard V. Young
Absent - None
Also present were - City ~anager James L. Pennington and
City Attorney Herbert W.A. Thiele.
Mayor Young announced that this meeting has been called for
the purpose of (1) considering passage of Resolution No. 6-84 opposing
the Florida Unitary Tax.
1. The City Manager presented Resolution No. 6-84:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, VOICING THE OPPOSITION OF THE CITY COUN-
CIL TO THE UNITARY TAX I~POSED ON CORPORATIONS BY THE
STATE OF FLORIDA AND CALLING FOR A REPEAL AND REPLACEMENT
OF THAT UNITARY TAX; PROVIDING FOR THE FURNISHING OF
COPIES OF THIS RESOLUTION.

Mayor Young advised he had requested the City Attorney
prepare this resolution in time to present it at the meeting of the
Florida Unitary Tax Study Commission. He stated they are going to send
the resolution with a letter he has written to Dr. Lanzilotti, Chairman
of the Commission, either through 5~. Howard Davidson, who will be at
that meeting, or by' courier.
~=. Bird moved for the adoption of Resolution No. 6-84,
seconded by ~z. Jackel. Upon roll call Council voted as follows: ~.
Bird - Yes; ~. Campbell - Yes; ~. Jackel - Yes; ~. Perry - Yes; Mayor
Young - Yes. Said motion passed with a 5 to 0 vote.
Before roll call the following discussion was had:
F~. Jackel stated he feels the Unitary Tax is detrimental to
Florida business and he would like to see it revoked. In addition to
this resolution going to Tallahassee he would also like it added to
their list of items going before the local Legislatures meeting next
month.
Mayor Young stated he can see no reason why this can not be
done and it is very much in order that they do so. He feels the Unitar~
Tax is a very serious situation and will adversely affect not only the
City of Delray Beach but every municipality within the State.
Mr. Campbell stated that he is in full agreement with hayor
Young. He feels that cities looking to expand their employment opportu-
nities, which for so long had been merely retirement havens, are going
to be particularly hit hard by the effects of this tax. He advised that
the original purpose of this tax was to benefit education; he does not
feel the actions of this Council should be deemed to be interfering with
the Governor's progressive program on education. What they are tryin9
to say by sending the resolution is that this is the wrong approach to
take in raising the necessary revenue dollars to support education;
there are other alternate means which the Legislature and the Governor
should look at.
At this point the roll was called to the motion.
