06-05-84SpMtg JUNE 5~ 1984 A Special Meeting of the City Council of the City of Delray Beach, Florida, was called to order by Mayor Doak S. Campbell in the Council Chambers at City Hall at 7:07 P.M., Tuesday, June 5, 1984. Roll call showed: Present - Council Member Malcolm T. Bird Council Member Marie Horenburger Council Member Arthur Jackel Council Member Jimmy Weatherspoon Mayor Doak S. Campbell Absent - None Also present were - City Manager James L. Pennington, and City Attorney Herbert W.A. Thiele. Mayor Campbell called the meeting to order and announced that this meeting has been called for the purpose of (1) considering award of contract for Delray Beach Library alterations and additions; and, (2) considering additional matters relative to instituting the Delray Beach Library construction contract and the financing for same. 1. Mr. Norman Otto, Delray Beach Public Library Association, reported that there were eight bids submitted, ranging from a low bid of $244,000 to a high bid of $421,000. Unfortunately the low bidder of $244,000 had made an error and they are requesting that the City award this contract to the next lowest bidder, James Bushouse and Associates, Inc., at a bid price of $334,800. They have drafted an indemnification agreement which the City Attorney has looked over. They are also re- questing that Council release that erroneous low bidder, Seiple Corpora- tion, from his low bid; by doing so they would also be releasing his bid bond. Mr. Bird moved to release Mr. Seiple from his erroneous low bid and authorize him to recover his bid bond and to award the contract to the then low bidder, James Bushouse & Associates, Inc., seconded by Mrs. Horenburger. The City Attorney advised that the motion should include the waiver of the irregularity of the lack of the subcontractors list. Mr. Bird amended his motion as advised by the City Attorney, seconded by Mrs. Horenburger. Said motion passed unanimously. 2. Mr. Bird moved to authorize execution of and entering into the indemnification agreement with the Library Association in conjunc- tion with the construction contract, seconded by Mrs. Horenburger. Said motion passed unanimously. Mr. Otto stated that all contractors were required to submit a deposit of $50 per set of construction documents. For each contractor who returned the documents in good condition, they request that the City authorize the return of their $50 deposit. Mr. Bird moved to authorize the return of the $50 deposit to each contractor who returned the documents in good condition, seconded by Mr. Jackel. Said motion passed unanimously. Mr. Otto reported that financially they are in good condi- tion and they have enough to finish this construction with the help of the Division of Library Services Grant. They intend to seek a line of credit from Sun Bank, which, they feel, is a safe way to proceed should some unforeseen circumstances come up. Further, they would request that City Council consider waiving the building permit fees; they will be demolishing the Pignato Building and would include that in the request. Mr. Jackel moved to waive building permit fees, seconded by Mrs. Horenburger. Said ;notion passed unanimously. Mayor Campbell thanked all the members of the Library As- sociation who have worked so hard to get to this point and urged them to continue their efforts on behalf of the community. Mayor Campbell declared the meeting adjourned at 7:19 P.M.
