A special meeting of the City Council of the City of Delray
Beach, Florida, was called to order by Mayor Willard V. Young in the
Council Chambers at City Hall at 7:30 P.M., Wednesday, January 26, 1983.
Roll call showed:
Present - Council Member Malcolm T. Bird
Council Member Leo A. Blair
Council Member Arthur Jackel
Council Member Edward L. Perry
Mayor Willard V. Young
Absent - None
Also present were - City Manager Gordon D. Tiffany, and
City Attorney Herbert W.A. Thiele.
Mayor Young announced that this meeting has been called for
the purpose of (1) holding a public hearing to determine the type of
garbage and trash service to be provided to the various areas of the
City.
1. A public hearing was held having been legally advertised in
~6mpliance with the laws of the State of Florida and the Charter of the
City of Delray Beach, Florida.
The City Manager presented a map which outlined the dif-
ferent areas and explained the types of service they will be receiving.
Elizabeth Matthews, 1024 White Drive, stated that about two
years ago Council asked for a survey of various areas as to their pre-
ference for garbage services. The response of the beach property owners
was 10 to 1 in favor of back door service; as of this date that has not
changed.
Maude Thomas, 1020 N.W. 2nd Street, questioned the cost of
the different services and if there would be a reduction in the overall
billing. She also questioned how the distinction was made for the areas
to receive the roll-out carts.
Mr. Bird explained that the roll-out carts were tested in
areas with children and pets where curbside in bags was not feasible.
In the survey it was determined that the southwest area responded fa-
vorably to the roll-out cart system.
Upon question by members of the public, Mr. Bird explained
that garden debris will be placed at the curb no matter what type of
service is being provided. If people who have roll-out carts choose to
place their trash in them they may do so.
Mr. E.G. Miller, Tropic Palms, stated that when their area
was tested with the roll-out carts they were told that there would be a
tremendous savings to them by using the carts. On that basis they went
ahead with the test, but they have now found that the roll-out cart is
the second most expensive service. He is against using the carts.
Mr. Bird moved that the area lying east of Federal Highway
to the ocean be approved as presented in the public notice, seconded by
Mr. Blair. Said motion passed unanimously.
Mr. Jack Smith, 511 Curlew Road, Tropic Palms, spoke in
favor of the carts.
Mr. Bird moved that the Tropic Palms area continue using
roll-out carts, seconded by Mr. Blair. Upon roll call Council voted as
follows: Mr. Bird - Yes; Mr. Blair - Yes; Mr. Jackel - No; Mr. Perry -
Yes; Mayor Young - No. Said motion passed with a 3 to 2 vote.
Grace Krivos, 2101 Northridge Road, spoke in opposition of
the carts and stated she feels that people are being discriminated
against because of the method used in deciding which areas should re-
ceive carts and which areas should still have back door pickup.
Mr. Garelle, 228 N.E. 5th Street, stated that the only thing
that is going to help keep the City clean is to educate people on how to
take care of their garbage and trash and added that he is in favor of
back door pickup.
Mr. Bob Moss, 259 N.E. 22nd Street, stated that he would
prefer to stay with back door pickup.
When questioned how the idea of a new garbage service came
up in the first place, Mr. Bird stated that the Clean Community System
surveyed the entire community. There were some areas where they felt
because of the tendency of citizens to put garbage bags and other con-
tainers at the curbside which stayed there for days, those areas should
require some additional consideration by them. Those areas were looked
into and Council tried to draw some kind of realistic line to try and
get input from the citizens. If Council had wanted to take a unilateral
action and decide what level of services everyone would have then they
would not have had a public hearing tonight.
Mr. Bird moved that the area that lies to the east of 2nd
Avenue north and 4th Street bounded on the east by Federal Highway be
added to the rest of the northwest section as backdoor pickup, seconded
by Mr. Blair. Said motion passed unanimously.
Donna Cotton, 324 N.E. 3rd Avenue, stated that she is in one
of the test areas for the carts and finds it is difficult to get the
carts onto the street. She asked whether there could be any provision
made to place the carts in the alley where they usually put their gar-
bage; how long these carts will last and what the replacement cost
would be.
The City Manager stated that the carts will be placed in the
alley where they are now putting their garbage cans and the rear loading
trucks will pick them up there. The carts that the City are presently
using are guaranteed for two years and warranted for five years. The
expected life of a cart is in excess of five years and the way the
contract draft is written the original cost and replacement cost would
be the responsibility of the contractor. Any maintenance done to the
carts during the term of contract would also be his responsibility,
saving only proved negligence by the user.
Anne Mae Moore, 111 N.W. 12th Avenue, stated that she lives
next to a vacant lot and she has tried to call City Hall several times
to have someone come out and clear it off.
The City Manager advised that the Administration will check
into this matter.
Mr. Bird moved that the area bounded on the north by Lake
Ida Road (4th Street), on the south by 10th, on the west by 1-95 and the
east by Federal Highway be roll-out cart service, seconded by Mr. Blair.
Said motion passed unanimously.
Kenneth Gary, 128 N.W. 9th Avenue, spoke from the audience
stating that Council is not giving the people on the west side any
choice for garbage service and it was unfair and discriminating. He
stated that not all people in the black neighborhood have garbage and
trash in their yards.
Lonnie Cook, 2020 N.W. 4th Avenue, stated that until a few
days ago he had not realized that trash was also involved in the new
garbage services. He feels that Council should keep back door pickup,
trash and clam diggers and bid it out, without going to roll-out con-
tainers.

Dick Seneff, 209 Lake Terrace, stated that he is in favor of
the roll-out carts. They are helping keep the garbage off the ground
which used to be dropped by the garbage men if the cans were too full.
Roy Simon, stated that he likes the present system of back
door pickup and would like to see the City continuing with it; however,
he feels it could do with some reviewing regarding the trash pickup.
Robert French, 131 Mockingbird Lane, acknowledged the pre-
sence of Mr. Perrin and Mr. Davies who are on the Board of Directors for
Country Manors, and stated that he is here tonight representing the
residents. At present they have been extended the courtesy of an ordi-
nance allowing them to go to the private sector for their garbage. He
asked Council whether or not they will be allowed to continue with that.
Mayor Young stated that once their contract is finished
Country Manors will go on the same type of service as is set up by the
City.
Mr. French asked whether Council will be going out to con-
tract with more than one company to handle the different kinds of ser-
vices that are being thought of.
Mr. Bird stated that they expect to have one contractor
providing many different services.
Mr. Bird moved that the area described by N.W. 4th Street on
the south, Federal Highway on the east, 1-95 on the west and the north
City boundary be designated as back door service, the area to the west
of 1-95 to Military Trail north of Lake Ida Road be curbside with own-
ers' containers, with the exception of Country Manors which will be
curbside in bags at the time they start receiving garbage service from
the City, seconded by Mr. Blair. Said motion passed unanimously.
The City Manager stated that there is a cart test area in
this neighborhood. As Council has just expressed their intent not to
provide cart service there, he asked if they would be interested in
entertaining a motion or putting it on an agenda to terminate the test
and move the carts to an area which has been designated for cart ser-
vice.
Alice Finst, 707 Place Tavant, representing the Board of
Directors of the Homeowners' League of Chatelaine, stated that they are
very pleased with the service they presently have; they have pickup at
their garage door. The garbage men seem to be competent and very ad-
equately trained to do the job. For a number of years Chatelaine was
without trash pickup and they would like to request that bulk trash
pickup be included in the service. They would also like to have some
assurance that when Council bids the contract that service will not
begin until people get up in the morning and also that there is a firm
commitment on holiday pickup.
Mr. Bird moved that the area described on the east by 1-95,
on the north by Lake Ida Road, on the south by Atlantic Avenue and on
the west by Military Trail shall be curbside, with the exception of
Chatelaine and High Point. Chatelaine shall be rear door and for High
Point it shall be curbside in plastic bags, seconded by Mr. Perry. Said
motion passed unanimously.
Mr. Bird moved that the area described by Atlantic Avenue on
the north, 1-95 on the east, Military Trail on the west and Lowson
Boulevard on the south be curbside pickup, seconded by Mr. Blair. Said
motion passed unanimously.
Mr. Bird moved that the area south of Lowson Boulevard, west
of 1-95, north of C-15 Canal and east of Military Trail, with the excep-
tion of Sherwood Park and Lakeview, be curbside; Sherwood Park and
Lakeview to be back door pickup, seconded by Mr. Perry. Said motion
passed unanimously.

George Conley, 2380 Black Olive Boulevard, stated that he
feels Pines of Delray has the easiest pick up service by using dump-
sters. He would expect to get the same level of service that they are
now getting, but with no escalation in cost.
Mr. Bird stated that Council is in no position to address
cost at this time. They are just trying to get something that they can
go and bid. He cannot answer any questions with regard to cost, al-
though he would expect that it would be less than their current costs.
Mr. Bird moved that the area described as 10th Street on the
north, Federal Highway, including Pelican Harbor, on the east, 1-95 on
the west and the C-15 Canal on the south, be curbside with the exception
of Tropic Palms to be roll-out cart service, seconded by Mr. Perry.
Said motion passed unanimously.
The public hearing was closed.
The City Manager stated that he has completed meeting with
those potential contractors who have exhibited the most active interest
in bidding and has received their verbal input. He has completed his
review and modification to the draft contract based on that input. The
City Attorney has also completed his review and Council will receive the
second draft of the contract on Friday. He suggested that Council
schedule a workshop to look at the contract and he has tentatively set
aside 4:00 P.M., Thursday, February 3rd for that purpose.
Mayor Young declared the meeting adjourned at 9:30 P.M.
