07-08-83SpMtg JULY 8, 1983 A special meeting of the City Council of the City of Delray Beach, Florida, was called to order by Mayor Willard V. Young in the Council Chambers at City Hall at 4:00 P.M., Friday, July 8, 1983. Roll call showed: Present - Council Member Malcolm T. Bird Council Member Doak S. Campbell Council Member Arthur Jackel Council Member Edward L. Perry Mayor Willard V. Young Absent - None Also present were - Acting City Manager Elizabeth Arnau and City Attorney Herbert W.A. Thiele. Mayor Young called the meeting to order and announced that this meeting has been called for the purpose of (1) considering appoint- ing Interim City Manager and (2) considering appointing members to Screening Committee for City Manager position. Mr. Perry stated that he would like to clarify a point which was made in one of the newspapers where he was misquoted as saying he would not vote for Mr. Gatchel because his resume was submitted to Mr. Bird. He did not say this; he only indicated there could possibly be a cloud. He would like to clarify this for Mr. Gatchel's sake. (2) Mr. Bird moved that they consider item (2) before item (1), seconded by Mr. Jackel. Said motion passed unanimously. Before roll call Mayor Young stated that for the Screening Committee he would suggest appointing Leo Blair as chairman, Ken David- son, Jack Kellerman, Anthony Newbold and Jack Pitts. Mr. Campbell stated that he would like to compliment Mayor Young on the choices he made and would support them. With regard to Mr. Davidson he was very impressed with the draft letter and criteria he submitted to each member of Council. At this point the roll was called to the motion. Mr. Perry suggested the names of John Henderson and Marie Horenburger as possible members to the Screening Committee. He would like to present Mr. Henderson in place of Mr. Davidson. Upon question by Mr. Perry, Mrs. Horenburger stated that she would not be willing to serve on the committee. Mr. Jackel stated that it is his understanding that in the near future Anthony Newbold will be transferred. He would like to suggest Fred McCoy, Chairman of the NSA, as a substitute. Mr. Jackel moved to appoint Mr. Ken Davidson, Mr. Leo Blair, Mr. Fred McCoy, Mr. Jack Kellerman and Mr. Jack Pitts to the Screening Committee for the City Manager position, the appointments to take effect immediately, seconded by Mr. Bird. Said motion passed unanimously. (1) Mayor Young stated the reason this meeting was called today instead of Monday was that he had received a call from one of the ex- officials of the City of Delray saying that one of the candidates for office was going to be out of town and it was suggested they step up the procedure. Mr. Perry stated that he feels very strongly that the good of the City comes far paramount to the needs of Mr. Law; he would not li~e to hasten this item. Mayor Young stated that it should be recalled that they are appointing an Interim City Manager. As Mr. Law was first choice the last time the City needed a City Manager and they are in the midst of budget procedure he feels it is urgent they do appoint an Interim City Manager. He feels they should make the appointment to someone who has shown an interest in becoming the City Manager, if, as and when they should appoint him to that job. Mr. Campbell stated that his only concern would be that he does not know Mr. Law. If he were in fact the paramount choice last time he is sure he must be highly qualified. He would like Mr. Law to have all due consideration by Council and the Screening Committee when they do some initial interviewing. If he were in Mr. Law's position he would think he would have a better chance of getting the permanent posi- tion if he were not the interim manager for two reasons: (1) being that it is a very volatile time right now and (2) going through the process of being interim manager is much like having a probation period and he would rather be hired to do the job and get on with it. Mr. Bird stated he would hope that some of the things he has heard in regard to Mr. Law were really aimed at himself. Mr. Law should not be tainted because of his acquaintance with him (Mr. Bird}. Mr. Jackel stated he agrees with Mayor Young's comments that they do need an Interim City Manager immediately. Waiting another week would not bring any further applicants into this process. He stated that delaying this any further will not be of any service to the City; therefore, he feels they should vote for one of the three whose resumes they have received. Mr. Perry stated that he is not against Mr. Law because of his knowing Mr. Bird, it is simply the way Mr. Law made himself avail- able for a job which was not then open. He has great doubts about Mr. Law's sense of responsibility to his professional peers, his sense of equity and his capability for judgement. He feels that if they were that desperate for a City Manager they should have thought about it be- fore. As for putting a candidate for full-time office in as Interim Manager he feels it is nothing but a bald-faced attempt at entrenching a.~crony and he will not be swayed from that view. Mr. Campbell stated that he does not want to be prejudiced against Mr. Law; however, with regard to taking a vote today he would have to defer approval since he has not met or interviewed him. He could not vote for anyone he has not had an opportunity to personally assess. Mr. Perry moved that they table this item until some time next week when Mr. Campbell and himself can have the opportunity to further examine the candidates. Said motion died for lack of a second. Mr. Jackel moved to appoint Mr. William Law, Jr. as Interim City Manager beginning 12:01 A.M., Tuesday, July 12th, seconded by Mr. Bird. Upon roll call Council voted as follows: Mr. Bird - Yes; Mr. Campbell - No; Mr. Jackel - Yes; Mr. Perry - No; Mayor Young - Yes. Said motion passed with a 3 to 2 vote. The City Attorney questioned whether there has been any thought given to how Mr. Law is to be placed on the employee rolls. Mr. Bird stated they have a salary for the position and that would be appro- priate. The City Attorney clarified that Mr. Law's salary would be from the budgeted position. Mayor Young declared the meeting adjourned at 4:30 P.M.
