A Special Meeting of the City Council of the City of Delray
Beach, Florida, was called to order by hayor Willard V. Young in the
Council Chambers at City Hall at 7:00 P.M., ~onday, October 31, 19~3.
Roll call showed:
Present - Council Member Malcolm T. Bird
Council Member Doak Campbell
Council Member Arthur Jackel
Council hember Edward L. Perry
Mayor Willard V. Young
Absent - None
Also present were - City Manager William H. Law, Jr. and
City Attorney Herbert W.A. Thiele.
Mayor Young called the meeting to order and announced that
this meeting has been called for the purpose of (1) considering the
final selection process for City ~nager.
M~. Jackel stated that he does not mind 5~. Law's presence
during these meetings; however, it has been called to his attention that
as ~. Law is one of the applicants, it may not be fitting for him to be
here during meetings concerning the selection of a City hanager. 5~.
Jackel further'stated it is his understanding that tonight they are to
reduce the list from 5 to 3 and then invite the 3 top applicants to the
City as soon as possible for a public interview and then shortly after
make an evaluation and final decision. Council concurred.
F~. Bird stated that he assumes the interview process will
be at least a public meeting which does not preclude any private meet-
ings which may also be needed. Mr. Campbell suggested that if, after
the interviews, they deem none of the three to be appropriate, then t~ey
should go on down the list. Council ~iembers concurred.
F~. Jackel explained the selection procedures he used and
outlined the references he contacted as follows:
~r. James Pennington of Fairfield, Ohio -
Donald Leroy, Mayor of Fairfield - excellent, new ideas,
brought in good department heads, well thought of by the
public, he resigned because of political pressure and he
chose personal integrity instead.
Sterling Uhler, Council hember in Fairfield - excellent to
superlative, professional in every way, got alon9 well with
staff.
Harry Perkins of Fayetteville, N.C. -
Dan hcMillan, Chairman of ~ental Health Board - a rating of 9,
out of a possible 10.
M.M. Beard, former County Commissioner - a rating of 9, said he
related well to people.
~ry ~icAllister, County Commissioner - excellent budget man,
very good relationship with public, well organized, a ratin9
of 10.
Charles Spiegel, Chairman County Commission - fiscally respon-
sible, a rating of 8.
Richard Ellis of Palm Bay, Florida -
Mayor Bill Madden of Palm Bay - very knowledgable, very good
man.
Councilman Ed Culberson of Palm Bay - innovative, capable, fine
manager, rating of 9.
Mr. William Law of Delray Beach, Florida -
Bill Talbot, Executive Assistant to 51anager in Dade County -
good administrator, a rating of 10.
John Green, Assistant County Manager in Dade County - good, a
rating of 8.
Ruth Shack, Dade County Council - very rigid in his thinking,
military, a rating of 5.
Alan Alford, Boca Raton City Council - holds him in the highest
regard, excellent City I~ianager.
Norman Wymes, former Boca Councilman - very autocratic, a poor
manager, he thought he ran the show and the Council was
there to give him window dressin§', he made decisions which
should have been brought before Council for policy review.
Mark Byron, former Boca Councilman - 5~. Law was all for 5~r.
Law and never interested in helping anybody else; rating
between satisfactory and poor.
Martin Gainer of Coral Gables, Florida -
City Attorney of Coral Gables - excellent, fiscally conserva-
tive, solid person.
Jimmy Dunn, former ~ayor - fine person, dedicated, fiscally
responsible, excellent, cooperative.
~yor Chapman - ~. Gainer was dedicated, loyal, conscientious,
excellent, rating of '9½.
Bob Knight, former Councilman - very straight, honest, hard-
working, very thorough, good personal habits, smart, experi-
enced.
Bill Talbot, Executive Assistant to ~anager of Dade County -
very competent, a rating of 10.
John Green, Assistant County ~]anag'er in Dade County - very
good, rating of 9.
Mr. McDermott, Executive Director to ~]ayor Clark of Dade
County- very good reports on ~. Gainer.
Ruth Shack, Dade County Council - very good, rating of 9~.
State Senator Roberta Fox - excellent.
Each Council Member submitted his selections as follows (in
order of preference):
Mr. Jackel: Gainer - 98 Mr. Bird: Law
Pennington- 90 Perkins
Perkins - 90 Pennington
Ellis - 80
Law - 70

Council discussion was had relative to the references sub-
mitted by Mr. Jackel. ~. Campbell felt that ~. Gainer appeared to be
the most qualified of the group but he is not sure they could afford a
gentleman of his great stature in the community at this point. He feels
the others, in line with the development of their careers, would be
looking at Delray Beach as an opportunity and that they could get better
services out of them.
Mr. Jackel disagreed and stated that 5~. Gainer is aware of
the salary range being offered. ~. Perry stated that at th~s point they
are simply trying to get down to three candidates based on performance.
~4r. Bird stated that he would support ~. Campbell's comment that they
might find Mr. Gainer difficult to deal with; however, he agrees with
~. Perry that that is not why they are here tonight.
Mr. Jackel suggested that, at this point, they reduce their
list to four names, rather than three. Council concurred.

Mr. Bird moved to bring in Mr. Law, Mr. Gainer, Hr. Penning-
ton and 5~. Perkins, for interviews, seconded by ~. Perry. Said motion
passed unanimously.
Mr. Jackel suggested that the City Clerk send a letter to
the four candidates advising them that they are on the short list and
asking them how quickly they can appear, hayor Youn9 asked ~or a con-
sensus of Council as to when this public meeting should take place.
Council discussion was had as to how many meetings should be
held, when they should be held and whether they should hold them in the
Council Chambers or the Conference Room. It was Council's consensus
that these interviews be done at special meetings, rather than regular
meetings.
Mr. Bird moved to interview the four candidates as soon as
possible, commencing no later than next week and ending by the 15th of
November, seconded by 5~. Campbell. Said motion passed unanimously.
~. Perry stated that there are many groups in town that
will have specific questions for the City ~anager and he sug§ests that
these groups forward their questions to Council through their repre-
sentatives so they will have a broader scope of what they should be
asking. 5~. Jackel stated his phone number is 272-4824.
~r. Campbell moved that they provide ~. Law and ~. Gainer
with what the City normally pays in terms of mileage to attend the
interview, since they are both within commuting distance of be lray
Beach, and that they provide 5~. Perkins and ~. Pennington with round-
trip airfare and one night's lodging, seconded by ~. Bird. Said motion
passed unanimously.
Mayor Young stated that they have to depend on the press to
get out the message that they would like to have input from the citizens
of Delray Beach and he requested that the press do this and not editori-
alize on this matter.
