11-17-83SpMtg NOVE~iBER 17; '1983 A Special Meeting of the City Council of the City o~ Delray Beach, Florida, was called to order by 5~ayor Willard V. Young in the Council Chambers at City Hall at 5:05 P.M., Thursday, November 17, 19~3. Roll call showed: Present - Council 5~mber halcolm T. Bird Council hemDer Doak S. Campbell Council hember Arthur Jackel Council hember Edward L. Perry Mayor Willard V. Young Absent - None Also present were - City Attorney Herbert W.A. ~hiele. Mayor Young called the meeting to order and announced that this meeting has been called for the purpose of (1) selecting a City Manager. 1, Mayor Youn9 passed out ballots to each Council ~ember for them to mark their selection in order of preference. He advised that the one who has the lowest number of points will be the one selected. Upon question by ~. Jackel, hayor Young advised that this method is legal and it will be appended to the records. Council members marked their ballots at this time and re- turned them to Mayor Young. Mayor Young tallied the votes as follows: hr. Law - 14 points ~. Pennington - 6 points 5~. Gainer - 15 points ~. Perkins - 15 points ~myor Young noted that hr. Pennington had the low numer and stated that, if at all possible, he would like to have a unanimous vote on this selection. Mr. Jackel moved that P~. James Pennington be appointed permanent City Manager effective January 15, 1984 with a starting salary of $49,000 a year, with a contract similar to ~. Tiffany's contract three years, including a pension fund to the IC~ rather than the City pension fund, seconded by ~. Perry. hr. Bird stated that he has no problem with the selection ~'~. Pennington; however he would like to suggest a substitute motion. Since they do have two months, he suggests, as an alternative, that they leave the provisions of the contract open, infor~a ~. Pennington that he has been hired and then allow him to communicate directly with the hayor as to salary and other benefits of the ~ob. hr. Jackel pointed out that he spoke with ~. Penn~ngton, while he was in town, and they discussed the provisions of the ~ob, should he be selected. 5~. Pennington told him that he felt he deserved the $49,000, that he was making almost that amount in Ohio and the cost of living is considerably higher here. Also, he would like to have a three year contract and he mentioned something about the ICS~ pension rather than the City pension. Upon question by ~yor Young, Mr. Jackel stated that he has no objection to the hayor contacting ~. Pennington as lon9 as done in the open. ~r. Perry stated this is simply negotiatin9 of a contract for an employee and he sees no problem with the hayor con- tacting hr. Pennington directly. Council discusslon was had at this time with regard to the duration of a contract. Upon question by Mr. Jackel with regard to 5~. Tiffany's contract, the City Attorney advised that there were provisions for descending severance pay over a three year period but it was not a three year contract. He further advised that the duration of the contract with the City Manager and City Attorney is unlimited; they serve at the pleasure of the City Council. Mr. Jackel amended his motion as suggested by ~. sird, seconded by ~. Perry. Said motion passed unanimously. Mayor YOung advised that he will call ~. Pennin9ton with regard to the contract provisions, he will keep Council apprised o~ every move and he is sure they will come to agreement before lon9. Mayor Young declared the meeting adjourned at 5:15 P.M.
