A special meeting of the City Council of the City of Delray
Beach, Florida, was called to order by Vice-Mayor Bird in the Council
ChamDers at City Hall at 10:05 A.M., Saturday, October 2, 1982.
1. Roll call showed:
Present - Council Member Leo A. Blair
Council Member Edward L. Perry
Vice-Mayor Malcolm T. Bird
Absent - Council Member Arthur Jackel Mayor Willard V. Young
Also present were - City Manager Gordon D. Tiffany, and
City Attorney Herbert W.A. Thiele.
Vice-Mayor Bird announced that this meeting has been called
for the purpose of (1) holding a Public Hearing and Second and Final
Reading on Ordinance No. 69-82 relative to levying a tax on all prop-
erties within the City and (2) holding a Public Hearing and Second and
FINAL Reading on Ordinance No. 70-82 relative to making appropriations
of sums of money for all necessary expenditures of the City from October
1, 1982, to September 30, 1983.
1. The City Manager presented Ordinance No. 69-82:
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, TO LEVY A TAX ON ALL PROPERTIES WITHIN
THE CITY OF DELRAY BEACH, FLORIDA, FOR MAINTENANCE AND
OPERATION, AND TO LEVY A TAX FOR THE PAYMENT OF PRINCIPAL
AND INTEREST ON BONDED INDEBTEDNESS, AND TO ALLOCATE AND
APPROPRIATE SAID COLLECTIONS THEREUNDER.

The Czty Attorney read the ordinance in full. A public
hearing was held having been legally advertised in compliance with the
laws of the State of Florida and the Charter of the City of Delray
Beach, Florida. The public hearing was closed.
Mr. BlaZr moved for the adoption of Ordinance No. 69-82 on
Second and FINAL Reading, seconded by Mr. Perry. Upon roll call Council
voted as follows: Mr. Blair - Yes; Mr. Perry - Yes; Vice-Mayor Bird -
Yes. Said motion passed with a 3 to 0 vote.
2. The City Manager presented Ordinance No. 70-82:
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, MAKING APPROPRIATIONS OF SUMS OF MONEY
FOR ALL NECESSARY EXPENDITURES OF THE CITY OF DELRAY
BEACH, FLORIDA, FOR THE PERIOD FROM THE 1ST DAY OF OCTO-
BER, 1982, TO THE 30TH DAY OF SEPTEMBER, 1983; TO PRE-
SCRIBE THE TERMS CONDITIONS AND PROVISIONS WITH RESPECT
TO THE ITEMS OF APPROPRIATIONS AND THEIR PAYMENT; AND TO
REPEAL ALL RESOLUTIONS AND ORDINANCES WHOLLY IN CONFLICT
WITH THIS ORDINANCE AND ALL RESOLUTIONS AND ORDINANCES
INCONSISTENT WITH THIS ORDINANCE TO THE EXTENT OF SUCH
INCONSISTENCY.

The City Attorney read the caption of the ordinance. A
public hearing was held having been legally advertised in compliance
with the laws of the State of Florida and the Charter of the City of
Delray Beach, Florida.
Mrs. Elizabeth Matthews, 1024 White Drive, stated that the
fact that not many people ~ave protested does not mean that the heavy
tax burden should not be addressed; she is speaking for people whose
taxes have more than doubled. The City says that all it does is set the
millage and the Property Appriaser says that all she does is make ap-
praisals. Upward appraisals should not matter because the balance
should be in the millage; therefore, the tax reappraisal should not be a
vehicle for finding more taxes nor a vehicle to hide behind. She added
that taxes on buildings near water are out of control and she wants City
Council to be aware of that. She noted that although law requires that
t~s year the City take 40 percent of the ½ cent sales tax to reduce
property taxes, the law does not require it for future years. She and
other members of the community would expect the City to do the same next
year.
V~ce-Mayor Bird replied that he too would expect that. The
City Manager explained that the rollback rate is the rate figured after
the sales tax is put into it; so the rollback next year will reflect
th~s year's rollback due to the sales tax. They have to do the same
thing again next year. In response to Mrs. Matthews' comments, Vice-
Mayor Bird stated that some commercial properties were substantially
reappraised this year. This year for the first time he has heard people
say that they would sell at the appraised value. He pointed out that
they do not seem to get every property reappraised in the same year so
there is always somebody being abused.
Mr. Tom Hanlon, 124 Marine Way, discussed the reasons for
the high budget. He stated that the blame first goes to the general
public for sitting mute. Secondly, in the Administration they have what
appears to be a lethargic team that bands together in an effort of
· neffect~veness that leaves the public in continual want of appropriate
services. Lastly, in regard to the City Council, if the Mayor had been
healthy, he feels there would have been changes in this budget. Their
V~ce-Mayor is running for a County office and, apparently, does not have
the time for the mundane matters of a local nature. Mr. Jackel's con-
cern during this critical period was on a name change for the City golf
course. Mr. Perry's preoccupation was investigating police harassment.
Mr. Blair, like the Mayor, has shown the kind of concern that people
expect from a Council Member; his efforts to resolve problems and to
balance out costs in the construction of the new City Hall are com-
mendable. The partnership that should exist to make a vibrant and
healthy City, at least economically, is dismembered. The public, the
Council and the Administration are all to blame.
The public hearing was closed.
Mr. Perry moved for the adoption of Ordinance No. 70-82 on
Second and FINAL Reading, seconded by Mr. Blair. Upon roll call Council
voted as follows: Mr. Blair - Yes; Mr. Perry - Yes; Vice-Mayor Bird -
Yes. Sa~d motion passed with a 3 to 0 vote.
Vice-Mayor Bird declared the meeting adjourned at 10:22 A.M.
