12-21-82SpMtg DECEMBER 21, 1982 A special meeting of the City Council of the City of Delray Beach, Florida, was called to order by Mayor Willard V. Young in the Council Chambers at City Hall at 5:05 P.M., Tuesday, December 21, 1982. 1. Roll call showed: Present - Council Member Malcolm T. Bird Council Member Leo A. Blair Council Member Arthur Jackel Council Member Edward L. Perry Mayor Willard V. Young Absent - None Also present were - Assistant City Manager Bonita Gooch and City Attorney Herbert W.A. Thiele. Mayor Young called the meeting to order and announced that this meeting has been called for the purpose of considering (1) Resolu- tion No. 113-82 regarding the issuance of $4,000,000 Water and Sewer Revenue Bonds, Series 1983, and (2) considering approval of insurance settlement for the Delray Beach Country Club. 1. The City Attorney advised that the resolution is in final form, more or less; there are two corrections to be made. On page 31, line 16, the phrase beginning "the Barnett Bank of Delray Beach, Florida, or such other" should be deleted and the word "certain" inserted in its place. Also, on page 33, line 7, the phrase beginning "on May 15 and November 15 of each year" is deleted and "at least one day prior to the payment dates" inserted. The Assistant City Manager presented Resolution No. 113-82: A RESOLUTION AUTHORIZING THE ISSUANCE OF NOT EXCEEDING $4,000,000 WATER AND SEWER REVENUE BONDS OF THE CITY OF DELRAY BEACH, FLORIDA, TO FINANCE THE COST OF CONSTRUC- TION OF ADDITIONS, EXTENSIONS AND IMPROVEMENTS TO THE CITY'S COMBINED PUBLIC UTILITY; AND PROVIDING FOR THE TERMS OF SAID WATER AND SEWER REVENUE BONDS, AND THE RIGHTS, REMEDIES AND SECURITY OF THE HOLDERS OF SAID %~ATER AND SEWER REVENUE BONDS. (Copy of Resolution No. 113-82 is on file in the official Resolution Book) The City Attorney read the caption of the resolution. Mr. Perry moved for the adoption of Resolution No. 113-82 as corrected, seconded by Mr. Blair. Upon roll call Council voted as follows: Mr. Bird - Yes; Mr. Blair - Yes; Mr. Jackel - Yes; Mr. Perry - Yes; Mayor Young - Yes. Said motion passed with a 5 to 0 vote. 2. Mr. Perry asked if this settlement is typical with about 20 percent.lacking. Mr. Bird advised that what happens is the policy is written which covers full cost or replacement less a negotiated amount which equates to wear and tear, depreciation, etc. The City Attorney stated that some of the carts were quite old. Mr. Blair moved to approve the insurance settlement for the Delray Beach Country Club, seconded by Mr. Bird. Said motion passed unanimously.
