A Special Meeting of the City Council of the City of Delray
Beach, Florida, was held in the Council Chambers at 7:00 P.M., Tuesday,
April 21, 1981, with Mayor Leon M. Weekes, presiding and City Manager J.
Eldon Mariott, Assistant City Attorney Herbert Theile, and Council
members James H. Scheifley, Charlotte G. Durante, Leo A. Blair, and
Malcolm T. Bird, present.
Mayor Weekes called the meeting to order and announced that
this meeting has been called for the purpose of (1) considering holding
a Public Hearing and Second Reading of Ordinance No. 21-81, amending
Chapter 26 "Traffic" relating to parking meters.
(1) The City Manager presented Ordinance No. 21-81:
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA AMENDING CHAPTER 26 "TRAFFIC" OF THE CODE
OF ORDINANCES OF THE CITY OF DELRAY BEACH BY ENACTING
DIVISION 3A "PARKING METERS" OF ARTICLE II "STOPPING,
STANDING AND PARKING" WHICH SHALL CONSIST OF NEW SECTIONS
26-63 THROUGH 26-71; ENACTING SECTION 26-63 "DEFINI-
TIONS''; ENACTING SECTION 26-64 "PARKING METER ZONE" TO
DESCRIBE THE AREA CONSTITUTING THE PARKING METER ZONE;
ENACTING SECTION 26-65 "DESIGNATION OF PARKING SPACES AND
INSTALLATION OF PARKING METERS" TO AUTHORIZE, RATIFY AND
CONFIRM THE MARKING OFF OF PARKING SPACES AND THE INSTAL-
LATION OF PARKING METERS; ENACTING SECTION 26-66 "OPERA-
TION OF PARKING METERS" TO REQUIRE THE DEPOSITING OF
MONEY INTO A PARKING METER IN ORDER TO LAWFULLY PARK IN A
PARKING METER SPACE; ENACTING SECTION 26-67 "PARKING TIME
LIMITS" TO PROVIDE THE METER CHARGE FOR PARKING IN A
PARKING METER SPACE; ENACTING SECTION 26-68 "PARKING
PERMITS" TO AUTHORIZE THE PURCHASE OF A PERMIT WHICH
ALLOWS THE FREE PARKING OF A VEHICLE IN CERTAIN PARKING
METER SPACES; ENACTING SECTION 26-69 "VIOLATIONS" TO
PROVIDE A LIST OF VIOLATIONS RELATED TO THE USE OF PARK-
ING METERS; ENACTING SECTION 26-70 "COLLECTIONS" TO
PROVIDE FOR THE COLLECTION BY THE CITY ADMINISTRATION OF
MONEY DEPOSITED IN THE PARKING METERS; ENACTING SECTION
26-71 "PENALTIES" TO PROVIDE THE PENALTIES FOR A VIOLA-
TION OF A PROVISION OF DIVISION 2A; PROVIDING A SAVING
CLAUSE; PROVIDING AN EFFECTIVE DATE.

The City Manager read the caption of the ordinance. A
public hearing was held having been legally advertised in compliance
with the laws of the State of Florida and the Charter of the City of
Delray Beach, Florida. The public hearing was closed.
Mr. Scheifley moved for the adoption of Ordinance No. 21-81
on Second and FINAL Reading.
Upon question by Mr. Scheifley, the City Manager replied
that enforcement of this ordinance will begin tomorrow. Also, decals
will go on sale tomorrow morning at the City Hall Finance office. Mr.
Scheifley added that these decals are for unlimited parking in Sandoway
Park, Anchor Park and Atlantic Dunes Park and they cost $25.
A gentleman from the audience noted that all the parks men-
tioned are at the south end of the beach and asked if there will be any
provisions for residents to park at the north end of the beach. Mayor
Weekes replied that no on-street meters are affected by the decals; only
the parking lots. The gentleman asked if that can be amended; he is a
resident who has a boat and to park at the other end of the beach and
have to walk up to the end where the boats are is not fair.
Mayor Weekes stated that the decals were designed to provide
space without having to feed the meter in the public parking lots. He
is not sure that it is economically viable for the City to include A1A.
The question has never really been seriously considered.
Mr. Scheifley added that he doesn't think it would be prac-
tical since there is no differentiation between the rates for Delray
Beach and non-residents. He explained that they cannot give Delray
Beach residents any preference due to their contract with the County,
State and Federal Government.
Mrs. Durante stated that if anyone here is going to attend
the Delray Affair which starts Friday, she has a newsletter and a sug-
gestion box; the newletter will be answers to questions from people last
year. One of the items addressed is why can't residents of Delray Beach
have preference in parking spaces at the beach. The box will be in
front of Mercer-Wenzel.
Mrs. Matthews stated that there is no other municipality
along this coast which allows boats to be stored on the public beaches.
Another gentleman from the audience suggested that the City
let them move their boats to the south end of the beach. Mayor Weekes
stated that that point is worth considering.
Mr. Bird stated that at their last discussion of where per-
mits would apply, as a result of input and because of the proximity of
the Atlantic Dunes Park to the Linton Bridge, it was determined that
permit parking would not be permitted there. He questioned this and
requested that a review of the ordinance be made.
The City Manager suggested that they go ahead and pass the
ordinance tonight and then they can make the review which Mr. Bird has
requested.
Mr. Bird recommended that they pass it with the elimination
of Section 26-63, Subparagraph B, and if they desire to put it back in
later, they can do it. Mr. Scheifley stated that he would be agreeable
to eliminating Atlantic Dunes Park.
The City Manager stated that the parking stickers name
Atlantic Dunes Park as being one of the three parks where decals can be
used for parking. So there will be an inaccuracy on the stickers until
they can get them reprinted or do something about it. Members of Coun-
cil suggested taking a magic marker to the stickers.
Mr. Scheifley amended his motion to adopt Ordinance No.
22-81 on Second and FINAL Reading with the deletion of Atlantic Dunes
Park for permit parking, seconded by Mrs. Durante. Upon roll call
Council voted as follows: Mr. Scheifley - Yes; Mrs. Durante - Yes; Mr.
Blair - Yes; Mr. Bird - Yes; Mayor Weekes - Yes. Said motion passed
with a 5 to 0 vote.
Mayor Weekes declared the meeting, adjourned at 7:15 P.M.
