A Special Meeting of the City Council of the City of Delray
Beach, Florida, was held in the Council Chambers at 4:00 P.M., Wednes-
day, May 6, 1981, with Vice-Mayor James H. Scheifley, presiding and City
Manager J. Eldon Mariott, City Attorney Roger Saberson, and Council
members Charlotte G. Durante, Leo A. Blair, and Malcolm T. Bird, pre-
sent. Mayor Weekes was absent.
Vice-Mayor Scheifley called the meeting to order and an-
nounced that this meeting has been called for the purpose of (1) con-
sidering passage of Emergency Ordinance No. 31-81; (2) considering
passage of regular Ordinance No. 34-81; (3) considering developments re:
utilities; and (4) considering authorizing appraisals for Hoffman/
Flack/Siemens property.
The City Attorney requested that Council skip over the
emergency ordinance.
..(2) The City Manager presented Ordinance No. 34-81:
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, A~NDING CHAPTER 30 "ZONING" OF THE CODE
OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, BY
AMENDING SECTION 30-1, "DEFINITIONS"; AND PROVIDING A
MORATORIUM ON SUCH RESORT DWELLING UNITS SO THAT NO
CONSTRUCTION OF NOR CHANGES TO NOR CONVERSION TO SUCH USE
SHALL BE PERMITTED ANYWHERE IN THE CITY OF DELRAY BEACH,
FLORIDA, FOR A PERIOD OF NINETY (90) DAYS FROM THE DATE
OF ENACTMENT; PROVIDING FOR CODIFICATION; PROVIDING A
SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE.
The City Manager read the caption of the ordinance.
The City Attorney advised that there has been a minor word
change in the definition of "resort dwelling unit".
It was the consensus of Council to hold a special meeting on
May 19th before the regular workshop meeting to consider Ordinance No.
34-81 on Second and Final Reading.
Mrs. Durante moved for the adoption of Ordinance No. 34-81
on First Reading, seconded by Mr. Bird. Upon roll call Council voted as
follows: Mrs. Durante - Yes; Mr. Blair - Yes; Mr. Bird - Yes; Vice-
Mayor Scheifley - Yes. Said motion passed with a 4 to 0 vote.
(3) Mr. Bird moved that they formally go on record as a Council
and to that end that they no longer grant water service to properties
lying west of Military Trail, seconded by Mr. Blair. Said motion passed
unanimously.
Mr. Bird moved that all persons applying for sewer service
shall be notified that the present customers of the City of Delray Beach
may have consumed the 7.5 million gallon per day sewer flow allocation
of the City of Delray Beach under the Interlocal Agreement with the City
of Boynton Beach dated December 26, 1974; and that there is no addi-
tional capacity currently available to the City of Delray Beach. Until
the City's consultant engineer can complete a study of sewer flows to
determine the residual capacity, if any, available to the City of Delray
Beach, sewer service request shall be approved only for individual
owners of single family lots being privately developed; other categories
of development shall have the sewer service requests deferred pending
the conclusion of the aforementioned study, seconded by Mrs. Durante.
Said motion passed unanimously.
Mr. Bird suggested that the Administration go back through
all those requests that are pending and that those people be notified.
(4) Mrs. Durante moved to authorize the City Manager to have an
appraisal made of the Hoffman/Flack/Siemens property, seconded by Mr.
Blair. Said motion passed unanimously.
Before roll call, Mr. Scheifley advised that Mr. Flack
presented him with a letter addressed to Mayor Weekes and Council which
he requested be read into the record. (See attached letter).
At this point the roll was called to the motion.
Vice-Mayor Scheifley declared the meeting adjourned at 4:15
P.M.

Dear Mayor Weekes:
We have applied for Site DeveloPment Plan Approval and Conditional
Use Approval for the property _consisting of approximately 20 acres
at the Northiwest intersection of Linton Blvd. and the Intercoastal
Waterway.
We understand that the City Council is planning to retain an appraiser
to determine the value of this property in connection with a possible
acquisition of the property by the City for park purposes.
We are requesting that the City advise the appraiser that the property
is zoned RlVl-15 and permits development at a density of 15 units per
acre. This zoning was arrived at in connection with the settlement
of litigation between the City and the Owner of the property.
