09-24-81SpMtg 161 SEPTEMBER 24, 1981 A Special Meeting of the City Council of the City of Delray Beach, Florida, was held in the Council Chambers at 11:00 A.M., Thursday, September 24, 1981, with Mayor Leon M. Weekes, presiding and Interim City Manager Robert H. Fisk, Assistant City Attorney Herbert W.A. Thiele, and Council members James H. Scheifley and Malcolm T. Bird, present. Mayor Weekes called the meeting to order and announced that this meeting has been called for the purpose of canvassing the returns and declaring the results of the September 22, 1981, Referendum Bond Election. The City Clerk reported that she has compared the informa- tion on the voter's certificate on the back of the absentee ballot with the registration information furnished by the County Supervisor of Elections to determine that the elector casting the absentee ballot is duly registered in the precinct referred to and that he or she has not otherwise voted in this election. Also, she has compared the ballots being presented with the record of such ballots, which includes the date that a request for the absentee ballot was made, the date the ballot was delivered or mailed, and the date the ballot was received by the City Clerk's office, as required by Florida Statute 101.62(3) and it has been determined that we have received all ballots required except 16 which were not returned as reflected on the Absentee Elector's Record and that the other ballots being presented are properly accounted for. Eight ballots have been received which should be considered invalid by the Canvassing Board. They are the ballots of Barbara A. Bishop, Arthur W. Bishop, Doris E. McGuire, Patrick H. McGuire and Charles B. Knappen received on September 23, 1981 which were too late; the ballot of Dorothy W. Parr on which the voters certificate was not witnessed or notarized; the ballot of · Katherine M. Lanchantin who is not a registered elector; and the ballot of Edward T. Glatzmeyer which was not properly witnessed. Mr. Bird moved to approve the Clerk's comparison of the absentee ballots presented with the record required by Florida Statutes 101.62 as prepared by the City Clerk's office and to have the record of absentee electors as prepared by the City Clerk's office attached to and made a part of the minutes of this meeting and further to declare in- valid the absentee ballots of Barbara A. Bishop, Arthur W. Bishop, Doris E. McGuire, Patrick H. McGuire, Charles B. Knappen, Dorothy W. Parr, Katherine M. Lanchantin and Edward T. Glatzmeyer for the reasons stated by the City Clerk, seconded by Mr. Scheifley. Said motion passed unani- mously. The City Clerk presented the absentee ballots and noted that 126 absentee ballots were issued and 16 were not returned and in accord- ance with Council's adopted motion, eight of the absentee ballots have been declared invalid. The results of the absentee ballots are as follows: Proposal ~1 Pr'oposal ~2 For 7 For 25 Against 94 Against 77 Mr. Bird moved to approve the results of the absentee bal- lots as follows: for Proposal 91 - 7 , against Proposal #1 - 94 ; for Proposal ~2 - 25 , against Proposal #2 - 77 , and noted, for the record, that one envelope did not contain a vote on Proposal ~1, seconded by Mr. Scheifley. Said motion passed unanimously. The City Clerk reported that concerning the regular vote other than absentee votes for the two proposals, the results are as follows: 162 Proposal #1 P_/~oposal #2 For 357 For 905 Against 3,573 Against 3,228 and that she has the Certificates of Elections signed by the Clerks and a majority of the inspectors indicating these totals. Mr. Bird moved to approve the results of the voting other than the absentee voting which has already been approved as the results have been indicated by the City Clerk and that the Certificates of Election be attached to and made a part of the minutes of this meeting, seconded by Mr. Scheifley. Said motion passed unanimously. The City Clerk reported on the number of the total votes on each proposal received as follows: TOTAL Proposal #1 For 357 + 7 Absentee 364 Against 3,572 + 94 Absentee 3,666 Prgposal #2 For 905 + 25 Absentee 930 Against 3,228 + 77 Absentee 3,305 Mr. Scheifley moved to approve the results of the elction in total, including all the regular and absentee votes, seconded by Mr. Bird. Said motion passed unanimously. The City Clerk presented Resolution No. 78-81: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, CANVASSING THE RESULTS OF A BOND ELECTION HELD IN THE CITY OF DELRAY BEACH, FLORIDA, ON SEPTEMBER 22, 1981, AND DECLARING AND CERTIFYING THE RESULTS THERE- OF (Copy of Resolution No. 78-81 is on file in the official Resolution Book) Mr. Bird moved for the adoption of Resolution No. 78-81 and to include under Section l(a) the number 364; under Section l(b) the number 3,666; under Section 2(a) the number 930; and under Section 2(b) the number 3305, seconded by Mr. Scheifley. Upon roll call Council voted as follows: Mr. Scheifley - Yes; Mr. Bird - Yes; Mayor Weekes - Yes. Said motion passed with a 3 to 0 vote. Mayor Weekes declared the meeting adjourned at 11:44 P.M.
