01-07-80SpMtg JANUARY 7, 1980 A Special Meeting of the City Council of the City of Delray Beach, Florida, was held in the Council Chambers at 7:00 P.M., Mon- day, January 7, 1980, with Mayor Leon M. Weekes presiding, City Manager J. Eldon Mariott, City Attorney Roger G. Saberson and Council Members Malcolm T. Bird, James H. Scheifley and Willard V. Young present. Council Member Charlotte G. Durante was absent. Mayor Weekes called the meeting to order and announced that same had been called for the purpose of (1) Considering passage of Resolution No. 1-80 amending Resolution No. 77-79, which determined certain details of $4,000,000 Water and Sewer Revenue Bonds, Series 1979; (2) Considering passage of Resolution No. 2-80 authorizing execution and delivery of official statement in connection with the issuance of $4,000,000 Water and Sewer Revenue Bonds, Series 1979; and (3) Considering authorizing the City Attorney's office to exe- cute a stipulation with High Point of Delray Builders, Inc. 1. The City Attorney reported that Resolution No. 1-80 changes the interest date on the bonds from November 1, 1979, to December 1, 1979. The City Attorney presented Resolution No. 1-80: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING RESOLUTION NO. 77-79, WHICH DETERMINED CERTAIN DETAILS OF $4,000,000 WATER AND SEWER REVENUE BONDS, SERIES 1979, OF THE CITY OF DELRAY BEACH, FLORIDA, TO CHANGE THE DATE FROM WHICH INTEREST IS TO BE PAID. (Copy of Resolution No. 1-80 is on file in the official Resolution Book) Mr. Bird moved for the adoption of Resolution No. 1-80 amending Resolution No. 77-79, seconded by Mr. Scheifley. Upon roll call Council voted as follows: Mr. Bird - Yes; Mr. Scheifley - Yes; Mr. Young - Yes; Mayor Weekes - Yes. Said motion passed with a 4 to 0 vote. 2. The City Attorney reported that Resolution No. 2-80 approves the final form of official statement which is being issued by the City in connection with the Water and Sewer Revenue Bonds. The City Attorney presented Resolution No. 2-80: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AUTHORIZING THE EXECUTION AND DELIVERY OF AN OFFICIAL STATEMENT IN CONNECTION WITH THE ISSUANCE OF $4,000,000 WATER AND SEWER REVENUE BONDS, SERIES 1979, AND AUTHORIZING PROPER OFFICERS TO DO ALL OTHER THINGS DEEMED NECESSARY OR ADVISABLE IN CONNECTION WITH THE DE- LIVERY OF THE BONDS. (Copy of Resolution No. 2-80 is on file in the official Resolution Book) Mr. Bird moved for the adoption of Resolution No. 2-80, seconded by Mr. Young. Upon roll call Council voted as follows: Mr. Bird - Yes; Mr. Scheifley - Yes; Mr. Young - Yes; Mayor Weekes - Yes. Said motion passed with a 4 to 0 vote. 3. The City Attorney reported that his office has been authorized to execute a stipulation with High Point of Delray Builders, Inc. The stipulation was provided for in a previous agreement that has been exe- cuted between the City and High Point dated December 17, 1979. The City Attorney advised that the reason the stipulation is being pre- sented to Council, in addition to the agreement, is that High Point did not submit the stipulation within the required 30 day period. The City Attorney's office, therefore, felt that additional authorization was necessary from Council to execute the stipulation. The City Attor- ney further advised that the City could possibly take the position that there W~'s a termination of the agreement if there had been some prejudice. He (City Attorney) knows of none and in conversation with the Utilities Director, he knows of none; therefore, the City Attorney recommends that a motion be made to authorize the stipulation. Mr. Bird moved that the City Attorney's Office be authorized to execute the stipulation with High Point of Delray Builders, Inc., seconded by Mr. Young. Said motion passed unanimously. Mayor Weekes declared the meeting adjourned at 7:05 P.M.
