A special meeting of the City Council of the City of Delray
Beach, Florida, was held in the Council Chambers at 7:00 P.M., Monday,
March 31, 1980, with Mayor Leon M. Weekes, presiding and City Manager J.
Eldon Mariott, City Attorney Roger Saberson, and Council members Malcolm
T. Bird, Charlotte G. Durante, James H. Scheifley, and Willard V. Young,
present.
Mayor Weekes called the meeting to order and announced that
same has been called for the purpose of considering five items, the
first being consideration of passage of Resolution No. 32-80 regarding
bridge openings.
(1) The City Manager presented Resolution No. 32-80:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, REAFFIRMING ITS POSITION IN SUPPORT OF
SPECIAL DRAWBRIDGE REGULATIONS REQUIRING CONTROLLED
OPENINGS OF THE ATLANTIC AVENUE BRIDGE OVER THE INTRA-
COASTAL WATERWAY; REQUESTING THAT THE UNITED STATES COAST
GUARD APPROVE SUCH REGULATIONS; AUTHORIZING AND DIRECTING
TIIE CITY CLERK TO FURNISH COPIES OF THIS RESOLUTION TO~
THE UNITED STATES COAST GUARD AND ALL OTHER APPROPRIATE
PUBLIC OFFICIALS AND AGENCIES.

Mr. Bird moved for the adoption of Resolution No. 32-80,
seconded by Mr. Young. Upon roll call Council voted as ~follows: Mr.
Bird - Yes; Mrs. Durante - Yes; Mr. Scheifley - Yes; Mr. Young - Yes;
Mayor Weekes - Yes. Said motion passed with a 5 to 0 vote.
(2) The City Manager reported that Ordinance No. 20-80 annexing
the Minter Property (Lot 7, Lake Shore Estates) is before Council for
consideration on First Reading.
The City Manager presented Ordinance No. 20-80:
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, ANNEXING TO THE CITY OF DELRAY BEACH LOT
7, LAKE SHORE ESTATES, AS RECORDED IN PLAT BOOK 25, PAGE
26 OF THE PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA,
SAID LAND BEING IN SECTION 5, TOWNSHIP 46 SOUTH, RANGE 43
EAST, WHICH LAND IS CONTIGUOUS TO EXISTING MUNICIPAL
LIMITS OF SAID CITY; REDEFINING THE BOUNDARIES OF SAID
CITY TO INCLUDE SAID LAND; PROVIDING FOR THE RIGHTS AND
OBLIGATIONS OF SAID LAND; AND PROVIDING FOR THE ZONING
THEREOF.
The City Manager read the caption of the ordinance.
Mr. Bird moved for the adoption of Ordinance No. 20-80 on
First Reading, seconded by Mr. Young. Upon roll call Council voted as
follows: Mr. Bird - Yes; Mrs. Durante - Yes; Mr. Scheifley - Yes; Mr.
Young - Yes; Mayor Weekes - Yes. Said motion passed with a 5 to 0 vote.
(3) The City Manager reported that there are two items involved
in Change Order No. 4. One is an add on of $138,838.29 and the other
item is a reduction in the amount of $21,518.88 for a net increase of
$117,319.41, all of which will be covered by an EPA grant with the
exception of $29,329.86 which will be the City's share. The City's
share would be financed from proceeds of the five million dollar Water
and Sewer Revenue Bond Issue. Approval is recommended.
Mr. Scheifley moved for approval of Change Order No. 4 in
the amount of $117,319.41, seconded by Mrs. Durante. Said motion passed
unanimously.
.(~) The City Manager reported that Council is to consider rati-
fication of SCR~D Board Resolution No. 2-80 authorizing commencement of
competitive negotiations for an engineer.
Mr. Bird moved for the ratification of the SCR~D Board's
adoption of Resolution'No. 2-80 authorizing commencement of competitive
negotiations for an engineer, seconded by Mr. Young. Said motion passed
unanimously.
(5) The City Manager reported that Council is to consider rati-
fication of ~CRWTD Board Resolution No. 3-80 authorizing the Board to
make application for a Step II grant for federal assistance.
Mr. Bird moved for the ratification of the SCRWTD Board's
adoption of Resolution No. 3-80 authorizing the Board to make application _
for a Step II grant for federal assistance, seconded by Mr. Young. Said
motion passed unanimously.
Mayor Weekes declared the meeting adjourned at 7:09 P.M.
