04-21-80SpMtg APRIL 21, 1980 A Special Meeting of the City Council of the City of Delray Beach, Florida, was held in the Council Chambers at 7:00 P.M., Mon- day, April 21, 1980, with Mayor Leon M. Weekes presiding, City Manager J. Eldon Mariott, City Attorney Roger Saberson and Council Members Malcolm T. Bird, Charlotte Go Durante, James H. Scheifley and Willard V. Young present. Mayor Weekes called the meeting to order and announced that same had been called for the purpose of (1) Considering extension of site plan approval, First Encounter; (2) Considering Resolution No. 39-80 regarding purchase of boat for the Police Department; and (3) Considering authorizing sale of "Holly ~'. 1. The City Manager advised that the Planning and Zoning Board recommended by unanimous vote that the site plan approval extension for First Encounter be granted for a period of 60 days from April 26, 1980. Mr. Scheifley moved to sustain the recommendation of the Plan- ning and Zoning Board, seconded by Mr. Young. Said motion passed unanimously. 2. The City Manager reported that this item was discussed at a prior workshop meeting, the idea being to use the funds from the. future sale of a confiscated vessel for the purchase of a boat for use by the Police Department. The other vessel has not been sold yet, so temporary financing according to the resolution, would be from the General Fund ContingencY Account. The City Manager further ' advised that a boat has been located that would be satisfactory for Police Department use in a purchase amount not to exceed $6500. Ap- proval of this resolution is recommended. The City Manager presented Resolution No. 39-80. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, RATIFYING THE NEGOTIATIONS OF THE ADMINISTRATION AND AUTHORIZING THE PURCHASE OF A 1977 CUDDY CABIN CRUISER FOR USE BY THE DELRAY BEACH POLICE DEPARTMENT, PURSUANT TO CHAPTER 2, "ADMINISTRATION", ARTICLE III, "PURCHASES", OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA. (Copy of Resolution No. 39-80 is on file in the official Resolution Book) Mr. Young advised that he has investigated 'the boat and be- lieves it to be an excellent buy - its power is 175 h.p. with only 157 hours on the engines, good fuel capacity which would give it quite a range for the Police Department and is equipped with such items as a depth finder and ship-to-shore radio. Mr. Young moved for the adoption of Resolution No. 39-80, seconded by Mrs. Durante. Upon roll call Council voted as follows: Mr. Bird - Yes; Mrs. Durante - Yes; Mr. Scheifley - Yes; Mr. Young - Yes; Mayor Weekes - Yes. Said motion passed with a 5 to 0 vote. The City Manager advised it is recommended Council authorize submitting the "Holly M" to sale. Mr. Bird moved to submit the "Holly M" to sale, seconded by Mr. Scheifley. Said motion passed unanimously. Before roll call the following discussion was had: Mr. Young stated he had taken the liberty of contacting Richard Bertram & Company, the largest shipbrokers in Miami who handle vessels of this type, and according to them this boat's resale value is listed from $135,000 to $150,000 depending on its condition. Mr. Young recommended that the City turn this sale over to a broker who is used to handling yacht sales; the fee would be 10% of the sale price. ~ Upon question by Mayor Weekes, the City Attorney replied that the boat must be sold at auction, but it could be sold by a yacht broker at auction. _ Mayor Weekes recommended that Council authorize the sale of and advertising of the vessel and at the same time authorize Mr. Young to have the broker come talk with the City Manager and if neces- sary, the City Attorney. At this point the roll was called to the motion.
