07-24-80SpMtg 145 JULY 24 1980 A special meeting of the City Council of the City of Delray Beach, Florida, was held in the Council Chambers at 11:45 A.M., Thursday, July 24, 1980, with Mayor Leon M. Weekes, presiding and Acting City Manager Thomas Weber, Assistant City Attorney Herbert Thiele, and Council members Malcolm T. Bird, Charlotte G. Durante, James H. Scheifley, and Willard V. Young, present. Mayor Weekes announced that this meeting has been called for the purpose of (1) acceptance of the bids for the sale of LUHRS Yacht "DIANA"; (2) acceptance of the bids for the sale of HATTERAS Sport Fisherman "HOLLY M"; (3) Authorizing City Attorney's Office to settle Nuisance Abatement and Demolition claim with Delray Septic Tank and ~uilding Specialties Company. The Acting City Manager reported that the best bid for the ~IANA was in the amount of $8,500; the bid was submitted by Nancy Newman of 920 Iris Drive, Delray Beach. It is recommended that the bid be accepted. Mr. Young moved to accept the bid of $8,500 by Nancy Newman for the DIANA, seconded by Mr. Bird. Said motion passed unanimously. 2. The Acting City Manager reported that the best bid for the HOLLY M was in the amount of $117,500; the bid was submitted by Elmer Parker of 1050 Lugo Ave., Coral Gables. It is recommended that the bid be accepted. Mr. Scheifley moved to accept the bid of $117,500 by Elmer Parker for the HOLLY M, seconded by Mr. Young. Said motion passed unanimously. Before roll call the following discussion was had: Mr. Bird stated that he would like to see the funds from these vessels separately maintained if that option is open to them, Mayor Weekes suggested that they instruct the Administration to hold these funds aside until Council has an opportunity to discuss how they wish to dispose of them. The Acting City Manager stated that in the funding of the 1979-80 budget, it did .provide about $50,000 to fund the balance of the General Fund budget. Anything over and above whatever is necessary to meet that budget estimate might be appropriate, to which Council agreed. Mrs. Durante asked if the amount that they have is net? 'The Acting City Manager replied, no, there are other expenses. Council will receive an account of the net figure when they have it available. At this point the roll was called to the motion. 3. Assistant City Attorney Thiele reported that John H. Adams, an attorney in town, represents clients who are attempting to sell a )iece of property. As they went about the process of getting the title ready, they discovered a $2500 special assessment lien on the property. It is their contention that they had no knowledge of such an assessment. in researching the question, it has come to the attention of the City Attorney's office that although there appears to be sufficient notice for portions of that assessment; that is, it was a piece of property on which land clearing was done and a structure was demolished at a total cost of $2500. It appears as though the notice for the clean-up work was sufficient, but as for the demolition of the building it was not necessarily so. The City Attorney's office is asking for authorization to satisfy the lien for a lesser amount, around $400 to $500. They are assuming that the amount for lot clearing at the time was approximately $100 per lot; there are five lots involved on the subject property. The clients would be willing to pay that amount to satisfy the lien. Mr. Bird moved to authorize the City Attorney's office to settle this matter in the manner they deem most appropriate, seconded by Mr. Bird. Said motion passed unanimously. Mayor Weekes declared the meeting adjourned at 11:55 A.M.
