A special meeting of the City Council of the City of Delray
Beach, Florida, was held in the Council Chambers at 11:45 A.M., Wednes-
day, September 24, 1980, with Mayor Leon M. Weekes, presiding and City
Manager J. Eldon Mariott, Assistant City Attorney Herbert Theile, and
Council members Charlotte G. Durante, and Willard V. Young, present.
Council members Malcolm T. Bird and James H. Scheifley were absent.
Mayor Weekes announced that this meeting has been called for
the purpose of considering accepting or rejecting of the bids for the
sale of the vessel "Randy VI".
(1) Mr. Jim Graham, auctioneer, reported that they advertised
the boat in the same manner they always do. The top bid today was
$80,000.00.
Mayor Weekes stated that Mr. Graham has convinced him; he
did a good job of promoting it and it had good exposure. Mrs. Durante
echoed the Mayor's statements.
Mr. Young moved that the City accept the bid of $80,000 by
Nicam Publishing Company, Inc., as presented at the auction, seconded by
Mrs. Durante. Said motion passed unanimously.
Mayor Weekes announced that there are several other items,
not on the agenda, which he would like to discuss briefly.
(1) Mayor Weekes stated, in regard to the conditional use for
the Church of God, that after the meeting last night he thinks Mr. Young
had some second thoughts about continuing it and he's told it puts the
Church in a very tenuous position to delay it.
Mr. Young stated that the reason he asked that it go to
workshop is the fact that he had some conversation with several owners
in the Chatelaine area and they wanted to get more information. He was
able to get that information by talking to the Reverend last night. His
feeling for a workshop has been satisfied and he will go along with the
vote in favor of the project.
Mayor Weekes suggested that Council have a special meeting
solely for the purpose of passing this conditional use. He added that
he will be gone all of next week; they can have the meeting Friday.
It was the consensus of Council to hold the special meeting
Friday, September 26, 1980, at 11:45 A.M.
(2) Mayor Weekes stated that this item is the one they tabled at
last night's meeting, regarding the furnishing of water outside the City
limits to a development in South Ridge. The problem is that the de-
velopment is not in accord with the City's Land Use Plan but is in
accord with the County's use of the property.
The City Manager reported that the property is located at
South Ridge Road and S.W. 4th Avenue and the request was that they enter
into the standard annexation/water service agreement. He reported to
Council last night that the applicant wished to build multiple family
dwellings on the land and the land shows as single family on the City's
Land Use Plan. He had a call this morning from Mr. McTeague inquiring
about it.
Mr. McTeague stated that the County Commission is meeting on
October 8th or 9th and they are on that agenda. The only thing that is
preventing their permit is the approval of their application to the City
for the use of water. If City Council doesn't act on it now, they are
delayed another month. They have already been delayed two months be-
cause of some errors which the County gave them in their submissions.
He is asking for some determination as to what the City will do.
Mrs. Durante noted that they referred this to Planning and
Zoning and added that the County could approve this project subject to
their getting the utilities from the City. Mr. McTeague replied that
the County won't make a move until they get the City's approval and
added that they have agreed to annex.
Mayor Weekes stated that they have a dilemna because Council
feels that it should defend the Land Use Plan; a lot of time and study
went into it and they don't take lightly anything that is not in accord
with that Plan. The City has the option of furnishing the applicant
with water under a contract and not annexing but that's self-defeating
for the City. Mr. McTeague asked how the City handled the Fall Ridge
property, a multi-family development right next to his. Council members
didn't recall the Fall Ridge property coming before them; Mayor Weekes
asked the Planning Director to check into it.
Mayor Weekes suggested entering into a water service agree-
ment and an agreement to annex at the option of the Council.
It was the consensus of Council to discuss this at the
special meeting on Friday at 11:45 A.M.
Mayor Weekes declared the meeting adjourned at 12:05 P.M.
