10-31-80SpMtg 25 OCTOBER 31, 1980 A Special Meeting of the City Council of the City of Delray Beach, Florida, was held in the Council Chambers at 11:50 A.M., Friday, October 31, 1980, with Mayor Leon M. Weekes, presiding and City Manager J. Eldon Mariott, Assistant City Attorney Herbert Thiele, and Council members Malcolm T. Bird, Charlotte G. Durante, and James H. Scheifley, present. Council Member Young was absent. Mayor Weekes called the meeting to order and announced that this meeting has been called for the purpose of (1) acceptance or rejec- tion of bids for the sale of three parcels of CitY-owned property; and (2) consideration of Resolution ~o. 104-80 to award a contract for the repair of a sewer trench and the resurfacing of Highland Avenue. (1) The Assistant City Attorney reported on Parcel A, which is '1.033 acres and zoned RM-10; the high bid was for $90,000 by Camino Forest, Incorporated. The bid was made by their Vice-President and Comptroller. Mr. Bird moved to accept the bid of $90,000 for Parcel A, seconded by Mrs. Durante. Said motion passed unanimously. Before roll call, upon question by Mr. Scheifley, Mayor Weekes stated that the bid is a little lower than what he had estimated but, under the circumstances, it is an acceptable bid. At this point the roll was called to the motion. The Assistant City Attorney reported that Mr. Louis Trebbits, who was the second highest bidder on Parcel A with a bid of $87,500, is requesting that Council make a motion to accept his bid, in the event that the high bidder defaults and does not close on the parcel. It was the consensus of Council not to make such a motion. The Assistant City Attorney reported on Parcel B, which is 5.49 acres and zoned R-iA; the high bid was for $60,390 by Reverend Keith Dennis; that was based on an amount of $11,000 per acre. Mrs. Durante moved to accept the bid on Parcel B in the sum of $60,390, seconded by Mr. Bird. Said motion passed unanimously. 'Before roll call the following discussion was had: Upon question by Mr. Bird, Mrs. Durante and Mayor Weekes stated that they feel that this is an acceptable bid. The City Manager noted that they sold 7% acres across the street from this parcel at $10,000 an acre in 1978, so $11,000 an acre, at this time, seems fair. At this point the roll was called to the motion. The Assistant City Attorney reported on Parcel C, which is 26.89 acres and zoned AG; the high bid was for $208,397.50 by Mr. Arthur Mirandi, based on a high bid of $7,750 per acre. Mrs. Durante moved to accept the bid on 'Parcel C in the amount of $208,397.50, seconded by Mr. Bird. Said motion passed unani- mously. Before roll call the following discussion was had: Upon question by Mr. Bird, Mayor Weekes stated that he thought this parcel would have brought about $9,000 to $10,000 an acre. This bid is about ten percent below what he considers to be the market for it, but this property may or may not be valuable. At this point the roll was called to the motion. Upon question by Mr. Bird, Mayor Weekes stated that the consensus of Council was to place this money in a separate fund. The City Manager added that, initially, all of it will be set aside in a separate fund. (2) The City Manager reported that Resolution No. 104-80 to award a contract to the low bidder, Dixie Asphalt Company, for the repair of a sewer trench and the resurfacing of Highland Avenue is before Council for consideration. The City Manager presented Resolution No. 104-80: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AUTHORIZING THE AWARD OF CONTRACT FOR THE REPAIR OF A SEWER TRENCH AND THE RESURFACING OF HIGHLAND AVENUE, FROM HOMEWOOD BLVD. TO THE DELRAY BEACH COUNTRY CLUB ENTRANCE. (Copy of Resolution No. 104-80 is on file in the official Resolution Book) Upon question by Mrs. Durante, the City Manager replied that the asphalt will be the same in all cases. Dixie Asphalt Co. plans to use a thicker asphalt in lieu of a portion of the base material that the other companies would use. Mrs. Durante moved for adoption of Resolution No. 104-80, seconded by Mr. Scheifley. Upon roll call Council voted as follows: Mr. Bird- Yes; Mrs. Durante- Yes; Mr. Scheifley- Yes; Mayor Weekes- Yes. Said motion passed with a 4 to 0 vote. Mayor Weekes declared the meeting adjourned at 12:05 P.M.
