08-17-79SpMtg AUGUST 17, 1979 A special meeting of the City Council of the City of Delray Beach, Florida, was held in the Council Chambers at 11:45 A.M., Friday, August 17, 1979, with Mayor Leon M. %;eekes, presiding and City Manager J. Eldon Mariott, Assistant City Attorney Clifford Shandy, and Council members Charlotte G. Durante and Willard V. Young, present. Mayor Weekes reported that this meeting has been called for the purpose of considering a water and sewer service agreement between the City of Delray Beach and High Point Builders. The City Manager reported that the contract is ready for approval at this point. There are a few minor changes that have been made since Council last saw the agreement. One has to do with the water tower; the City has determined that, quite likely, it would go to ground storage instead of a water tower up in the air. The second change has to do with when the first certification will be given; it was discussed at the last meeting that execution of the contract would constitute the first certification; they are not providing that in this contract. They think that they will be able to give the first certification within a short period of time and High Point is agreeable to this. The Assistant City Attorney stated that the agreement does not provide any protection against litigation relative to water and sewer service and related charges paid in the future; protection relates only to previously paid ~harges. The City Manager added that there was one paragraph in the agreement that could be interpreted to mean that the residents would pay their service charges directly to the City which would mean individual metering by the City; that is not the intent of the City or High Point. There was clarification made so that the residents would make their payments to the association and the association to the City. Mr. Young moved that the agreement for water and sewer service outside the Delray Beach City limits to High Point be accepted, seconded by Mrs. Durante. Upon roll call Council voted as follows: Mrs. Durante - Yes; Mr. Young - Yes; Mayor Weekes - Yes. Said motion passed with a 3 to 0 vote. Mayor Weekes declared the meeting adjourned at 11:50 A.M.
