A special meeting of the City Council of the City of Delray
Beach, Florida, was held in the Council Chambers at 4:40 P.M., Thursday,
September 6, 1979, with Mayor Leon M. Weekes, presiding, City Attorney
Roger Saberson, and Council members Malcolm T. Bird and Willard V.
Young, present.
Mayor Weekes reported that this meeting has been called for
the purpose of considering retaining an attorney to represent the Civil
Service Board in an action in the courts on Monday.
The City Attorney reported that yesterday the City
Attorney's Office filed a Writ of Prohibition in Circuit Court seeking a
ruling clarification on the Civil Service Act, that which pertains to
the investigation relating to the Scadlock matter. Now that that has
been filed, the Civil Service Board members have been served with a copy
of those papers and the question arises as to whether or not an attorney
should be retained at City expense to argue the Civil Service Board's
position at that matter. He thinks that the Civil Service Board should
be allowed the opportunity to retain counsel, at City expense, at a rate
not to exceed $60 an hour.
Mr. Bird moved that Council authorize the Civil Service
Board to retain counsel of their choice at a rate not to exceed $60 an
hour, seconded by Mr. Young. Said motion passed unanimously.
Mayor Weekes declared the meeting adjourned at 4:45 P.M.
