11-05-79SpMtg NOVE}'~ER 5, 1919 A Special Meeting of the City Council of the City of Delray Beach, Florida, was held in the Council Chambers at 7:00 P.H., ..~on- da'..,, Nove.T~er 5, 1979, with Mayor Leon M. Weekes presiding, City Manager J. Eldon Mariott, City Attorney Roger G. Saberson and Council Members Malcolm T. Bird, Charlotte G. Durante, James H. Scheifley and Willard V.. Young present. Mayor Weekes called the meeting to order and announced that same had been called for the purpose of considering settlement stipu- lation - BumPy and Stimpson, Inc., vs City of Delray Beach. 1.. The City Attorney advised that the stipulation that has been passed out differs only in a minor way from the other stipulation which Council has discussed. Bumby and Stimpson has agreed to pay the additional engineering fees and the concept of having either the City or Bu.~uby and Stimpson contract for the dredging as part of the stipulation has been removed. In place of that, paragraph three has been inserted simply saying that to the extent that the City does not use the funds for dredging, then the City would hold Bumby and Stimpson harmless to that extent. The City Attorney recommended that Council approve the settle- ment stipulation. Hrs. Durante moved that Council accept the settlement stipu- lation as presented, seconded by Mr. Young. Said motion passed unanimously. ..
