12-13-79SpMtg DECEMBER 13, 1979 A Special Meeting of the City Council of the City of Delray Beach, Florida, was held in the Council Chambers at 11:00 A.M., Thursday, December 13, 1979, with Mayor Leon M. Weekes, presiding and City Manager J. Eldon Mariott, Assistant City Attorney Clifford Shandy, and Council members Charlotte G. Durante (arrived at 11:03 A.M.), James H. Scheifley, and Willard V. Young, present. Council member Malcolm T. Bird was absent. Mayor Weekes called the meeting to order and announced that same had been called for the purpose of canvassing the returns and de- claring the results of the December 11, 1979, Referendum Bond Election. The City Clerk reported on the number of votes for each precinct; the totals for the 12 precincts were as follows: Proposal No. 1 (City Hall) FOR 1,666 AGAINST 741 Proposal No. 2 (Fire Station) FOR 1,931 AGAINST 531 Proposal No. 3 (Police Station) FOR 1,714 AGAINST 725 Proposal No. 4 (Miller Park) FOR 1,630 AGAINST 891 The listing by precincts of the vote on each Proposal is a document which will be incorporated into the minutes. The City Clerk reported that she has compared the informa- tion on the voters certificate with the information on the registration book, as required by Florida Statute 101.62(3), to determine that the elector 'casting the absentee ballot is duly registered in the precinct referred to and that he or she has not otherwise voted in this election. She has determined that they have received all ballots required except one. One ballot received from Dorothy Yospin was not properly witnessed or notarized and a motion to declare it invalid is in order. Mrs. Durante moved that the ballot of Dorothy Yospin be declared invalid, for the reason that it was not witnessed by two wit- nesses or executed before a notary public, seconded by Mr. Scheifley. Said motion passed unanimously. The City Clerk stated that it would be appropriate for the Mayor to write across said ballot the word "Invalid". The City Clerk presented the absentee ballots and noted that 43 ballots were issued, one was not returned and Dorothy Yospin's was declared invalid. The results of the absentee ballots are as follows: Proposal No. 1 (City Hall) FOR 15 AGAINST 26 Proposal No. 2 (Fire Station) FOR 27 AGAINST 14 Proposal No. 3 (Police Station) FOR !9 AGAINST 22 Proposal No. 4 (Miller Park) FOR 16 AGAINST 23 Mrs. Durante moved that the tabulation of absentee ballots for the Referendum Bond Election held on December 11, 1979, as provided by the City Clerk, be added to those votes previously received, seconded by Mr. Young. Said motion passed unanimously. The Assistant City Attorney advised that Council should pass a motion adopting Resolution No. 102-79 and it should be pointed out in the motion that the election results as reported at this meeting will be inserted in the Resolution. The City Manager presented Resolution No. 102-79 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, CANVASSING THE RESULTS OF A BOND ELECTION HELD IN THE CITY OF DELRAY BEACH, FLORIDA, ON DECEMBER 11, 1979, AND DECLARING AND CERTIFYING THE RESULTS THEREOF. Mr. Scheifley moved for the adoption of Resolution No, 102-79 with the understanding that the numerical blanks will be filled in as provided by the City Clerk, seconded by Mrs. Durante. Said motion passed unanimously. Mayor Weekes informed Council that he talked to Stanley Ross yesterday regarding the sale of these Bonds and the normal time frame that it would take to get before the Court and get them certified. The advertising time and all of the other processes that they have to go through probably will run them into May or June for the actual delivery of the money. Mr. Ross thinks that during the late spring the Bond market is going to soften and the interest rate will probably tend to abate. Mayor Weekes suggested that they proceed poste haste to get the necessary documents together and to proceed with the sale as opposed to waiting. If Council agrees, the City Manager can set the wheels in motion to have the necessary documents prepared to employ Mr. Ross for his services. Mr. Ross has advised him that since this issue was over one million, it should be sold at public sale the same as they do their other bond issues. The City Manager advised that Mr. Ross has already been retained by the City for the Bond issue.
