03-08-78SpMtg 269 MARCH 8, 1978 A Special Meeting of the City Council of the City of Delray Beach, Florida, was held in the Council Chambers at 11:07 A.M., Wednesday, March 8, 1978, with Mayor James H. Scheifley presiding, City Manager J. Eldon Mariott, City Attorney Roger Saberson, and Council members David E. Randolph, Aaron I. Sanson, IV., present. Council members Robert D. Chapin and Leon M. Weekes were absent. Mayor Scheifley called the meeting to order and announced that same had been called for the purpose of canvassing and approving the returns of the First Nonpartisan Election held on Tuesday, March 7, 1978. The City Clerk reported the results of the First Nonpartisan Election held on Tuesday, March 7, 1978, for the office of two (2) Council members for the term of two years were as follows: OFFICE OF COUNCIL MEMBER(TWO SEATS) Charlotte G. Durante 2,382 James H. Scheifley 3,021 Charles L. Soelch 1,450 Willard V. Young 2,371 TOTAL VOTES CAST 9,224 TOTAL BALLOTS CAST 4,942 TOTAL ELIGIBLE VOTERS 14,724 OFFICE OF MAYOR Leon M. Weekes - unopposed The City AttOrney stated that the listing by precincts of the vote for each candidate, is a document which is in front of Council and this document will! be incorporated into the minutes. It was noted, by the City Clerk, that 34% of the eligible voters in the City voted in the election. The City Attorney noted there is a certificate that is supposed to.be presented to Council signed by the clerks and %he-majority of the inspectors certifying the results of the election. This meeting should be adjourned, after the absentee votes are counted, until these certificates are signed and presented to Council. The City Clerk reported that she has compared the information on the voters certificate with the information on the registration book to determine that the elector casting the absentee ballot is duly registered in the precinct referred to and that he or she has not otherwise voted in this election. The City Clerk informed Council that she has compared the ballots being presented with the record of such ballots required by Florida Statute 101.62(3) and she has determined that we have received al~'~a±~ots r~quirea and they are properly accounted for. The City Clerk presented the absentee ballots and noted that 63 absentee ballots were issued, 62 were received and one was never returned. The ballot that was not returned was for Harry G. Bowles of Precinct #190. Upon advice of the City Attorney, Council counted the absentee ballots and counted the request for the absentee ballots. The results of the absentee ballots are as follows: Charlotte G. Durante 24 James H. Scheifley 39 Charles L. Soelch 23 Willard V. Young 26 TOTAL ABSENTEE VOTES CAST: 112 TOTAL BALLOTS CAST: 62 Mr. Randolph moved that the tabulation of the absentee ballots for the First Nonpartisan Election held March 7, 1978, as provided by the City Clerk, be added to th°se ~votes previously received, seconded by 27,0 Mr. Sanson. The motion passed unanimously. Mr. Sanson asked the City Attorney if there are further questions as to his (City Attorney's) opinion~as to how this election is run. The City Attorney replied once-'the returns are canvassed, and having received the certificate from the City Clerk, the election would be official. Mayor Scheifley informed Council that there has been discussion among the Council candidates that they would accept the opinion as rendered and added he is going to make a suggestion to instruct the City Attorney, at the next regular Council meeting, to review the language in the election code. Upon question by Mr. Sanson, the City Attorney advised that Charles L. Soelch's name will be removed from the March 21st run-off election. Mrs. Charlotte G. Durante and Mr. Willard V. Young will be in the run-off election. Mr. Sanson moved that the meeting be reconvened when the Mayor gives such a notice, seconded by Mr. Randolph.
