03-10-78ReconvSpMtg MARCH 10, 1978 A reconvened Special Meeting of the City Council of the City of Delray Beach, Florida, was held in the Council Chambers at 2:07 P.M., Friday, March 10, 1978, with Mayor James H. Scheifley presiding, City Manager J. Eldon Mariott, Assistant City Attorney Clifford Shandy, and Council members David E. Randolph and Aaron I. Sanson, IV., present. Council members Robert D. Chapin and Leon M. Weekes were absent. Mayor Scheifley called the meeting to order and announced that same had been called for the purpose of reconvening the meeting which was held on March 8, 1978. This meeting is for the purpose of canvassing the ballots of the March 7th First Nonpartisan Election. The City Clerk reported on the number of the total votes that ~ch candidate received as follows: TOTAL Charlotte G. Durante 2,382 + 24 Absentee 2,406 James H. Scheifley 3,021 + 39 Absentee 3,060 Charles L. Soelch 1,450 + 23 Absentee 1,473 Willard V. Young 2,371 + 26 Absentee 2,397 TOTAL VOTES CAST: 9,224 +112 Absentee 9,336 TOTAL BALLOTS CAST: 4,942 + 62 Absentee 5,004 TOTAL ELIGIBLE VOTERS: 14,724 The Assistant City Attorney stated the record should show that the returns have been submitted to Council and Council has a copy of the certified returns. Assistant City Attorney Shandy noted council should canvass the the returns and declare the results of the election, as shown by those returns. Mr. Sanson moved, that in accordance with the Assistant City Attorney's statements, Council declare the results of the election as presented, seconded by t!4r. Randolph. The motion passed unanimously. The City Clerk informed Council that she has given the Mayor his copy of the ~ertificationsof election, and noted the votes as shown by the attached certificates of election when considered along with the opinion of the City Attorney dated March 7, 1978, wherein he interprets Section 5.04 (b) (1) which is as follows: (Copy attached to the original.) (b) Majority to elect in first nonpartisan election. (1) Any candidate who receives in the first nonpartisan election the number of votes constituting a majority of all the ballots cast for that office, shall be declared to be elected to the office for which he is a candidate, and no further elections shall be held for that office. ShoUld more candidates receive the number of votes constituting a majority of all the ballots cast than there are offices to be filled, then those candidates equal in number to the offices to be filled receiving the highest number of votes shall be declared to be elected. 'xnis resulted in James H. Scheifley being elected in the first nonpartisan election having received a number of votes in excess of a majority of the ballots cast for that office and shall serve for a term of two years commencing on the first Monday of April, 1978 and ending in accordance with the City Charter. Since none of the other candidates received a number of votes constituting a majority of all the ballots cast, it will be necessary to hold a second nonpartisan election. In the second nonpartisan election, only the names of Charlotte G. Durante and Willard V. Young will appear on the ballot,in'.accordance with Section 5.04(c) (1) of the City Charter which reads as follows: (c~ Candidates for second nonpartisan election. [1) In the second nonpartisan election, there shall be on the ballot twice as many names of candidates as there are remaining council offices to be filled. The names of the candidates to be voted upon at the second nonpartisan election shall be those of the unelected candidates polling the largest number of votes in the first nonpartisan election. In the event of two (2) or more candidates qualifying for the second nonpartisan election with an equal number of votes, then all such tied candidates shall qualify for the second nonpartisan election. Leon M. Weekes being the only candidate for the office of Mayor is hereby declared elected ko that office in accordance with Section 5.04 (b) (2) of the City Charter which reads as follows: (b) Majority to elect in first nonpartisan election. (2) In the event not more than one person qualifies as a candidate for each vacancy on the city council or mayor in the first nonpartisan election, than an election shall not be held. Each candidate is deemed to have voted for himself. Mr. Weekes shall serve for a term of two years commending on the 1st Monday of April 1978, and ending in accordance with the City Charter. Mr. Randolph moved to adopt the report that has been read by the City Clerk certifying the election, i seconded by Mr. Sanson. The motion passed unanimously. Mr. Randolph moved, at 2:12 P.M., for the adjournment of the meeting, seconded by Mr. Sanson, said motion passing unanimously.
