A Special Meeting of the City Council of the City of Delray
Beach, Florida, was held in the Council Chambers at 7:00 P.M., Mon-
day, May 1, 1978, with Mayor Leon M. Weekes presiding, City Manager
J. Eldon Mariott, City Attorney Roger Saberson and Council Members
Robert D. Chapin, Charlotte G. Durante, Aaron I. Sanson, IV., and
James H. Scheifley present.
Mayor Weekes called the meeting to order and announced that
same had been called for the purpose of considering solicitations re-
quest from Muscular Dystrophy and considering Emergency Ordinance
Amendment to Chapter 27 of the Code of Ordinances.
City Manager Mariott advised that the City's Solicitations
Committee has recommended approval of the application from the Muscu-
lar Dystrophy Association for solicitation from May 7 to May 11, 1978.
Mr. Chapin moved for the approval of the solicitation appli-
cation from the Muscular Dystrophy Association for the period of May 7
to May 11, 1978, seconded by Mr. Sanson, said motion passing unani-
mously.
The City Manager presented Emergency Ordinance No. 24-78:
AN EMERGENCY ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 27,
"WATER AND SANITARY SEWERAGE", OF THE CODE OF ORDI-
NANCES OF THE CITY OF DELRAY BEACH BY ENACTING A
SECTION 27-8 RESTRICTING CERTAIN USES OF WATER FROM
THE CITY WATER SUPPLY SYSTEM NOT ESSENTIAL TO THE
PUBLIC HEALTH, SAFETY AND WELFARE DURING WATER
SHORTAGE EMERGENCY SITUATIONS; AUTHORIZING TERMINATION
OF WATER SERVICE FOR VIOLATIONS; PRESCRIBING ENFORCE-
MENT PROCEDURES IN THE EVENT OF VIOLATION OF ITS PRO-
VISION; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFEC-
TIVE DATE.

The City Manager read the caption of the ordinance.
The City Attorney stated that on pages two and three of the
ordinance there are sections to be filled in relating to the fine on
the second and third violation. The City Attorney recommended $50 on
the first and $100 on the second violation.
Mr. Scheifley moved to insert $50.00 under Section i(E) (b)
and $100.00 under Section i(E) (c) of Emergency Ordinance No. 24-78,
seconded by Mr. Sanson. The motion passed unanimously.
Mr. Chapin stated that this has been reported to be a ration-
ing ordinance, but under Section i(C) it gives the City Manager authority
to restrict the use of water or "absolute curtailment"; in other words,
no water for lawn sprinkling, car washing, etc. The City Attorney,
upon question by the City Manager, advised that deleting the words
"absolute curtailment" would not do great harm to the ordinance.
Mr. Chapin moved for the adoption of Emergency Ordinance No.
24-78 as presented with the fines added and striking the words "or
absolute curtailment of the use of water" in Section i(C), seconded
by Mr. Sanson. Upon roll call Council voted as follows: Mr. Chapin -
Yes; Mrs. Durante - Yes; Mr. Sanson - Yes; Mr. Scheifley - Yes; Mayor
Weekes - Yes. The motion passed with a 5-0 vote.
City Attorney Saberson advised that this ordinance will be
coming back at a future Council meeting to be passed and adopted as
a permanent ordinance.
The City Manager stated that under the authority delegated
to him by the ordinance he wished to announce the institution of the
rationing schedule in order to start saving water just as quickly as
possible. Until further notice the area of the City north of Atlantic
Avenue will be permitted to water lawns and vegetation on Wednesday
and Saturday of each week beginning May 3, 1978; south of Atlantic Ave-
nue the watering days permitted will be Thursday and Sunday of each
week beginning on May 4, 1978, until further notice or rescinded.
Mr. Torre Wallin spoke from the audience stating that he did
not know if Council was aware of how much it takes to reset all the
clocks at the large condominiums; in his case there are 18 different
clocks that would have to be reset and retimed for watering. This
cannot possibly be done in two or three days; it would be at least
a week or ten days to get the parts necessary and the labor to do it.
The City Manager stated he would defer an announcement of
the schedule until after the completion of Item 6 on the Workshop
Agenda. (The new schedule, commencing May 17th, was instituted at
the Workshop Meeting immediately following the Special Meeting).
Mayor Weekes advised he would encourage those people who are
able to do so to restrict their watering for those dates set forth by
the City Manager initially.
Mr. Chapin stated that he had spoken to the Mayor of Gulf-
stream and he indicated that the Town of Gulfstream is ready, willing
and anxious to cooperate in full with the City of Delray Beach con-
cerning this water rationing.
The City Attorney advised that under our contract with Gulf-
stream we have the right to restrict their use of water due to inade-
quate supply; also this is included in the contracts with other people
outside the City receiving City water. The City Attorney felt that it
would be very helpful if the Town of Gulfstream would also pass a like
ordinance.
Mr. Chapin moved at 7:20 P.M., for the adjournment of the
meeting, seconded by Mr. Scheifley, said motion passing unanimously.
