03-28-77 1.61 March 28, 1977 A regular meeting of the City Council of the City of Delray Beach, Florida, was held in the Council Chambers at 7:00 P. M., Monday, March 28, 1977, with.Mayor James H. Scheifley presiding, and City Manager J..Eldon Mariott, City Attorney Roger Saberson and Council members John E. Gomery, Jr., and David E. Randolph, present. Aaron I. Sanson, IV and Leon M. Weekes were absent. 1. The opening prayer was delivered by Rev. Mary Kupferle of Unity Ch'urch of Delray Beach. ~2. The Pledge of Allegiance to the Flag of the United States of Ar~erica was given. ;. Mr. Randolph moved for the approval of the minutes of the regular leeting of March 14,.1977, seconded 'by Mr. Gomery, said motion passing ~nanimously. 4.a. Mr. Gomery stated that the League of Women Voters has scheduled a meeting on Thursday, March 31, 1977 at 7:30 P. M. at the Adult Recreation Complex.on the Intracoastal Waterway north of Atlantic Avenue, at which time all the Councilmen will be present and the public can come, meet them and question them. The League thinks it is a good idea to let the citizens get more and better acquainted with their Councilmen. 5.a. Mr. Frank Ellis, 553 Jaeger Drive., Delray Beach, spoke concerning the outward appearance of the model structure located at the junction of Curlew Road and Albatross Road, Tropic Palms Subdivision, Delray Beach. The City Manager stated the Chief Building Official consulted with the City Attorney's office and was advised as to the City's legal responsibility and action was taken accordingly. ~ Mayor Scheifley asked what action Would be taken by the Police Department i£ 'they received a call in reference to someone building a house on Sunday. The City Manager stated that the Police Department would immediately send someone out to determine if there is actually a violation of the City's ordinance in progress. 5.b. Mr. Paul Friend, 1320 Si W. 20th Terrace, Delray Beach, thanked Mr. Jack Gomery for his services as Councilman of the City of Delray Beach~ 6.a. The City Manager spoke concerning the method of the Transfer of ~--~ Funds to the Sewer Board Treasury. He stated that at a workshop meeting it was agreed that in the future transfers can be made without specific Council approval and a memorandum dated February 23, 1977 was sent to the FinanCe Department to that effect. It was noted that Council would have a chance to question any item of that nature as they appear on the bills for approval and the sum of $300,625, which is not on the bills for approval, has ~een asked to be transferred from City Treasury to the Sewer Board. Unless something to the contrary is indicated, then the City would make ~he transfer prior to April 4, 1977 as provided by contract between Delray leach and the Sewer Board for the city's supervision of construction of the ~ewerage Treatment Plant. He stated that there is a possibility that it ~ay not be necessary to transfer the full amount, but in case it is needed, along with a large sum from Boynton Beach to pay the obligations to the contractors, then that transfer would be made. 6.b. The City Manager recommended that Council set the first regular meeting to be held during the month of April for 7:00 P. M., Tuesday, April 12, as the second Monday will be observed by the City as a holiday (Easter Monday). Mr. Gomery moved for the approval of the first regular meeting of Council to be held during the month of April for 7:00 P. M., Tuesday, April 12, seconded by Mr. Randolph, said motion passing unanimously. The City Manager stated he sent out a letter to approximately 12 to 14 parties advising that the Board and Care matter would be on the agenda at the next regular council meeting, April 11, 1977. He stated he would be sending out another notification advising that the council meeting will be held on Tuesday, April 12. 6.c. The City Manager reported that Council informally decided at its March 21st workshop meeting to appoint Ron Oprzadek as a member of the Community Appearance Board to the unexpired term of Robert Stafford ending August 25, 1977. Mr. Gomery.moved for the appointment of Ron Oprzadek as a member of.the Community Appearance Board to the unexpired term of Robert Stafford ending August 25, 1977, seconded by Mr. Randolph, said motion passing unanimously. 6.d. Mr. Gomery moved that this item (Board of Adjustment appointees) be tabled until the April 12, 1977 Council meeting when there would be a full attendance of Council, seconded by Mr. Randolph, said motion passing unanimous~ly. 6.e. The City Manager recommended that Council authorize by motion the execution of a Contract between the City and the International Associ- ation of Firefighters Local 1842, which Contract was discussed at the Counc~ workshop meeting on March 21st. Mr. Randolph moved for formal approval of a Contract between the City and the International Association of Firefighters Local 1842 with agenda modifications included in item 6e, seconded by Mr. Gomery, said motion passing unanimously. Mayor Scheifley stated he thinks the representatives of Council and th~ Firefighters should be highly commended for the job tha~ they did with successful negotiations and special commendation to the union represen- tatives for the spirit in which they negotiated this contract in good faith. 7.a. Mayor Scheifley acknowledged the minutes of the Beautification Committee for meeting held on March 2, 1977. Mr. Gomery mentioned that one item that was passed for Council attention by the Beautification Committee was the deDutizing of Mr. McCray, ~ho is the recently appointed nUisance inspector in the Building Department, for enfo~cement purposes. Mayor Scheifley asked the City Manager to give ~ reaction to this at the next Council workshop meeting. The City Manager stated that as of now he is not favorably inclined, but it will be put on the workshop agenda. Mayor Scheifley stated that, in the item where Council is requested to retain ownership of the west end of the beach bath house property, by taking no action of any kind, we are supporting their recommendation. Mayor Scheifley noted that action has been taken on the land- ~scaping and parking lot on the east side of the FEC Railroad between Atlantic Avenue and N. E. 1st Street. ~.b. The'City Manager reported that the City is in receipt of an Lpplication from Edward J. and Thomas A. Prouse for City water service to serve 1003 N. E. 9th Avenue, located outside the City. The City Manager stated that approval of the applicants' reques~ for water service is recommended as the standard contract has been executed by the applicants agreeing to annexation when the property is eligible for annexation in return for the City providing water service. Mr. Gomery moved for the approval of the application from Edward J. and Thomas A. Prouse for City water service to serve 1003 N. E. 9th Avenue, located outside the City subject to this property being annexed into the City when such is eligible for annexation, seconded by Mr. Randolph, said motion passing unanimously. $.a. The City Manager stated that Resolution No. 1D-77 opposing the P~'ssage of proposed House Bill 380 which would require non-union employees ~o pay a service fee in the amount of regular union dues was discussed at the Maruh 21st workshop meeting. - 2 - 3/28/77 163 The City Manager presented Resolution No. 19-77: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, OPPOSING THE PASSAGE OF PROPOSED HOUSE BILL NO. 380 WHICH WOULD RE- QUIRE NON-UNION EMPLOYEES TO PAY A SERVICE FEE IN THE AMOUNT OF REGULAR UNION DUES TO THE UNION WHICH REPRESENTS A BARGAINING UNIT WHICH THE EMPLOYEE MAY BE INCLUDED WITHIN, EVEN THOUGH THE EMPLOYEE DOES NOT DESIRE UNION REPRESENTATION, BECAUSE SUCH A SERVICE FEE REQUIREMENT VIOLATES ARTICLE I, ~SECTION 6 OF THE FLORIDA CONSTITUTION, BEING THE FLORIDA RIGHT TO WORK LAW. The City Manager stated Resolution No. 20-77 ratifying the con- tents of Resolution No. 50-76 relating to water service outside the City limits and the memorandum and agreement used in connection with annexation was discussed at the March 21st workshop meeting. The City Manager presented Resolution No. 20-77: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, RATIFYING THE CON- TENTS OF RESOLUTION NO. 50-76 RELATING TO WATER SERVICE OUTSIDE THE CITY LIMITS AND THE MEMORANDUM AND AGREEMENT USED IN CONNECTION THEREWITH AND ADDING TO SAID MEMORANDUM AND ACREEMENT A PROVISION INFORMING THE APPLICANT THAT HIS PROPERTY, UPON ANNEXATION, MAY BE SUBJECT TO CERTAIN ORDINANCE PROVISIONS REQUIRING THE REMOVAL OF NONCONFORMING SIGNS OR STRUCTURES. The City Attorney stated that ResolUtion No. 20-77 proposes.to amend the agreement in the memorandum submitted to applicants for water service indicating to them the possibility that certain signs, and or structures may have to be removed upon annexation and also generally informing them that they will be subject to all laws and regulations of the City of Delray Beach when annexed. The motion passed with a 3 to 0 vote. 8.c. The City Manager stated that Resolution No. 21-77 is awarding a contract to construct a left-turn lane at N. E. 7th Avenue for south bound traffic entering Atlantic Avenue and a contract with Florida Power & Light to relocate traffic poles. First Federal Savings & Loan of Delray Beach has executed an easement deed for the west 15 feet of Lot 10 of Subdivision of_ Block 124 for road right-of-way and utility purposes, This improvement will be funded with money from the $600,000 1974 Street Bond Issue. The City Manager presented Ordinance No. 19-77: AN ORDINANCE OF THE CITY COUNCIL OF THE-CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 7 "BEACHES" OF THE CODE.OF ORDINANCES OF THE CITY OF DELRAY BEACH BY AMENDING SECTION 7-1(16) TO EXEMPT NON-MOTORIZED BOATS NOT EXCEEDING -20 FEET IN LENGTH;~PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE. The City Manager read the caPtion of the 0~dinance. Mr.-J°hn W. Lane, 320 South Ocean Boulevard, Delray Beach, said he has had a long background in s~iling and a l°t of experience~and feet~ that-a-law allowing a somewhat unrestricted use of sailboats up to 20 feet on the beach should be given very careful thought and restrictions. Based on his experience in another state he feels this type law Will'attract~ a large number 0f'bOaters and u~less they are very carefully controlled with restrictions it can get out of had as well as create a hazard to the~swimmers ~ Mayor Scheifley asked'the City Attorney if council decided, as a result of several discussions~ to restrict-the area to Store~sailboats would it be a minor or major amendment to this ordinance; The CSty Attorney stated that it would be a major modification. Mr. Randolph suggested that the ordinance be passed ~n first reading and~at the public hearing on second reading he would like the input of Mr. Lane, due to the fact that at this time there are no professionals to counteract any questions or comments. Mr. Gomery moved for the passage~of Ordinance No. 19-77 on First Reading, seconded by Mr. Randolph. The City Manage~ reported the PlanningTand-~ning Board recom- mended by unanimous vote at a meeting held March 15th and discussed by Council at the March 21st workshop, that the conditional use request for an automobile paint shoP (Econo Auto Painting) located in Section 18-46-43 north of At~antic Avenue between N. W. 18th Avenue and the-Seaboard Coast tine Railroad be approved. This recommendation for approval has the ~ollowing contingencies: (1) That the applicant shall have one (1)-year to complete the improvements as shown on the approved site plan, and (2) That the Building Department shall not issue an'occupational license until all improvements as shown on'the site plan are complete. Mr. Gomery moved for the approval of the conditional use request for an automobile paint shop (Econo Auto painting) as~described and as limited in the agenda, seconded by Mr. Randolph. Said motion passed unanimously. - 7 - 3/28/77 168 10. The City Manager recommended authorization for payment of the ~-~y's bills. Mr. Gomery questioned whether or not the check made out to Mackle Nursery in the amount of $1,173.00 and the check made-out to Wooden Shoe Gardens, Inc. in the amount of $1,832.00 were for Miller Park and if so, isn't it to come out of a special f.und. The City Manager stated that he did not know if these plants will be used at Miller Park; however, if they are for Miller park the check will be taken from the General Funds and'later transferred from the account which will ultimately pay for it. He stated that many times the original check is not written on the funds that will ultimately pay for the item. Mr. Randolph moved for payment of the City's bills, seconded by Mr. Gomery.
