A Special Meeting of the C].ty Council of the City of Delray
Beach, Florida, was held in the~ Council Chambers at 7:05 P. M., Monday,
April 4, 1977, with Mayor James H. Scheifley presiding and City Manager
J. Eldon Mariott, City ALtorney Roger S~]berson and Council members John E.
Gomery, Jr., David E. Randolph (arrived at 7:11 P. M. having attended
opening memorial ceremonies in behalf of Dr. Martin Luther Klng, Jr.)
Aaron I. Sanson, I~ and Leon M. Weekes, present.
1. The opening prayer was delivered by Rev. Donald Clawson of St.
P--~ul's Episcopal Church.
The Pledge of Allegiance to the Flag of the United States o~
[erica was given.
Mr. Gomery moved for the approval of the minutes of the regular
)uncil meeting of March 28, 1977, seconded by Mr. Weekes. Mr. Weekes stated
that he would like. for the minutes of March 28, 1977 to reflect that he and
Mr. Sanson were absent because they were in Tallahassee on City business.
The motion passed unanimously.
4.a. Mr. Gomery stated he would like to thank the members of the Council
for appointing him as member of the Council a year ago. He also expressed
his appreciation to the City Attorney, the City Manager and through him .to
all the members of the City Administration for their many acts of assistance
and kindness in the past year.
4.b. Mr. Sanson conveyed his personal thanks as a 20 year resident of
the City of Delray Beach and one who loves the City as dearly as anyone
possibly could~ and thanked Mr. Gomery for stepping in at a time when there
was a lot of turmoil, a lot of problems, and a lot of questions before the
Council that required decision of much magnitude and much wisdom; also at a
time of sorrow, having lost one of our own, he stated he could not think of
anyone who could have performed more admirably and one that the citizens of
Delray Beach could have been prouder of for the job that he has done.
4.c. Mr. Weekes stated that he thinks the City of Delray Beach and the
Council owe Mr. Gomery a vote of gratitude for the wisdom and the counsel he
-has given during the past year, particularly in the area of beautification,
landscaping and things of that sort in which he is vitally interested.
Mr. Weekes stated that Mr. Gomery is not leaving the City and he is not
leaving his civic endeavors and the City of Delray Beach is very fortunate
to have someone like Jack Gomery who is willing to give unstintingly of his
time and his talent to help the citizens of this town.
4.d. Mayor Scheifley said he echoed the sentiments expressed by the
other Council members and would have more to say later.
4.e. Mr, Sanson moved for the adjournment of the meeting, seconded by
Mr. ~eekes, said motion passing unanimously. The Special meeting adjourned

ANNUAL ORGANIZATIONAL MEETING OF COUNCIL
±. Councilmen-elect Aaron I. Sanson, IV, and Robert D. Chapin sub-
~-~ribed to the Oath of Office administered by Judge Daniel Hurley.
2. Mr. Sanson asked Mr. Randolph if he would like to be considered
for the position of Vice-Mayor. Mr. Randolph thanked~Mr. Sanson for
considering him but, stated that with his present business arrangement and
.having accepted appointment to the Palm Beach County Charter Advisory
Commission he would decline, if so nominated. Mr. Sanson stated that he
has just finished serving a term as Vice-Mayor and it is more than an honorary
position as some people would think. He stated that being Vice Mayor has
a big de~ree of responsibility, in a sense like the Vice President of the
United States and if something did happen to the Mayor, th~ Vice-Mayor would
step in. He further stated that Mr. Randolph~ having served 4 years in the
City without being Vice-Mayor, would have been fully qualified and capable
of handling this position.

Mr. Leon M. Week,:~s was unanimously elected 'to the position of
'ii. ce-Mayor for one year on ~otJ..on by Mr. Sanson, seconded by Mr. Randolph,
~.:ith Mr. Weekes abstaining.
Mayor Scheifley stated that if the Charter Commission tries to
?repare a Charter as they did in 1972, Mr. Randolph has a very difficult,
complicatcd and time consuming job. Mayor Scheifley stated that about five
>'ears ago when the Commissio~ was chaired by Attorney Dick Burke of West
Palm Beach and the Vice-Chai]~man was John DeGrove of Florida Atlantic
University, they had several meetings a week sometimes lasting as long as
eight hours a day and that they literally interviewed hundreds of people,
and from this he could appreciate Mr. Randolph's position.
3.a. Mr. Chapin introduced his family who were in attendance at the
;~eeting. He then thanked Judge Dan Hurley for coming to install Mr. Sanson
and himself as members of Council. He stated that being installed by a judge-
is a first and that this is a tradition that should be carried into the
future. Mr. Chapin thanked Rev. Donald Clawson, the distinguished director.
of St. Paul's Episcopal dhurch for giving a very inspiring prayer and high
moral goal for all of us to attain. Mr. Chapin also thanked his fellow
Kiwanians and friends who helped him attain his chair on the City Council.
Mr. Chapin spoke on his views on the coming matters of Council
for 1977 as follows:

Mr. Chapin pledged to do all within his power to preserve, pro-
~'ect and promote the beauty and charm of'the community of D~lray Beach.
fi.b. Mr. Randolph welcomed Mr. Sanson back as a Councilman and stated
~ knows'Mr. Chapin will do a tremendous job during his two years on the
(~ouncil. Mr. Randolph stated that he would do everything within his power
%o see that the issues mentioned by Mr. ChaPin are carried through to the
~!!ullest. Mr. Randolph thanked Mr. Gomery for the very fine job he has
~ccomplished over the past year.
Mr. Sanson stated he welcomed the opportunity to be able to
'c~n{inue his service to the City. He also stated that after having served
~s a Councilman for two years, he could think of no greater honor than having
been able to serve as Delray Beach's elected representative. Mr. Sanson
'[~hanked the people for the opportunity to.serve them for the next two years.~
Mr. Sanson stated with the start of the new Council in the up-
coming year, he hopes they will try to bring in a new sense of vitality, a
new sense of enthusiasm, and some new creative thinking and be able to
approach all ideas and problems that they are confronted with with a
spirit of cooperation, favorable disagreement and come to a good, sound and
rational conclusion to problems. He stated that he hopes that Council will
always try to maintain a strong spirit of control in the City, that they
try to remember their positions as being the policymakers in the City and
that what is set as policy for the City Administration is to be followed
to the letter of the law and to be adhered to by the administration.
- ~ Mr. Sanson stated that in the next 2 years he hopes Council
can accomplish the following: that Delray Beach would make the use of
every opportunity to preserve Lhis community - continued strict control
of growth with amenities; code enforcement of ordinances; strive to increase
citizen participatio]~ in all levels of our government such as an annual

report to be added as a supplement to some newspaper giving what has happened
in the City and what the government is doing; consider having monthly
status reports given to the Council on basis of every department in the
City; completion of Miller Park and Pompey Park facilities; to have actively
figured out a way and have on the drawing board the new public works com-
plex which is desperately needed; a look into whether or not the western
section of the City desires and needsa new fire station and perhaps
additional police personnel; the expansion of the water plant which could
save a considerable amount of dollars if the City of Delray Beach can
receive approval for one method of treatment of the wa~er which is presently
under consideration by the State agency; a budget that is adopted this year
where no Federal Revenue Sharing Funds would be used for operating expenses
and that he would anticipate the fact with increases in our property assess-
ment we should be seeing a substantial reduction in millage; the Stewart
Arms complex completed; improvement in the substandard housing in the City
nd that Council should ask for a full report from the Housing Authority
s to what is going on because the City is indirectly responsible for their
ctions; Council to spend some time with the Financial Advisory Board,
efining their duties an~ allowing them to feel more'of a part of the
~inancial affairs of the City. Mr. Sanson also stated that the City of
Delray Beach needs a change in its consulting enginsering firm.
(Mr. Randolph left the meeting at 7:45 P. M. to attend the
memorial services for Dr. Martin Luther King, Jr. already in progress.)
3.d. Mr. Weekes stated that he would like to see the construction of
a Public Works complex which he feels is vitally needed in this'City and he
looks forward tQ working with Mr. Chapin. Mr. Weekes stated that the members
of the Council should be commended for the whole-hearted representation that
they give to the interest of the citizens.
3.e. Mayor Scheifley stated the Council.has been extremely cooperative
in se~ting rules of procedure and the meetings have been going very well.
He stated that another procedure that has been very helpful is that when new
subjects come up they are referred to workshop and then formalized at
Council meetings.
The Mayor reiterated some of his goals mentioned last year, some
-of which have been accomPlished;namel~ the elimination of the municipal
pool and beach bathhOuse, and the establishment of a mini-PERC. The
consideration of building a mausoleum was explored thoroughly and was noted
that it is no% financial feasible at this time. Another goal was the com-
pletion Of Miller Park and the invitations have been mailed for the dedication
of Miller Park on Friday night, April 22, 1977. Other goals, not necessarily
in order of priority, are beach renourishment, annexation of pockets,
Public Works complex, complete sewage treatment plant, reduce density,
reduce crime, beautify the City, the purchase of the Delray Beach Country
Club, and enlargement of the water infiltration plant.
Mayor Scheifley stated that the City is extremely fortunate to
have men of the caliber that are on Council and with the addition of Mr.
Chapin the quality of the Council is very high.
4. Mr. Weekes moved that the Council meetings remain the same for
the coming years as they have been in the past years, seconded by Mr. Chapin.
The Council meeting dates will remain on the second and fourth Monday nights
at 7:00 P. M.; however, Mr. Sanson stated that the next Council meeting
scheduled for Monday, April 11, will be held on Tuesday, April 12, 1977
because of the Easter holiday. Said motion passed unanimously.
5. The CitY Manager called for the appointments of Committee and
Board members with the first being the Beautification Committee. He stated
that the full compliment Of the committee is ~twenty-two in number; twenty
appointments were recommended by the Beautification Committee with two
vacancies remaining. The City Manager stated that Mr. Randolph, who left
the meeting at 7:45 P. M. to attend another meeting in progress at Carver
Middle School, has given him names of three persons to be considered for
appointment to the Beautificaticn Committee. The three persons recommended by
Mr. Randolph for appointment to the Beautification Committee are Frances
Martin, Toby Beaudin and Myra Jones.

Mr. Sanson moved that the following names be accepted for tile
7~eautification Committee and that the three additional names be referred
'i~o the Beautification Committee for their consideration at the next available
time, seconded by Mr. Weekes. Mr. Chapin asked the City attorney if there
%~ould be any conflict of interest if he voted for his sister to serve on the
)~eautification Committee; the City Attorney.answered no to this question.

The City Manager called for the appointment of the following

Mr. Sanson stated that it had been determined previously that a
member of the Housing Authority cannot serve on any other City boards and
asked the City Attorney if there is any problem with Mr. Durden serving on
l~he Community Relations Committee. The City Attorney stated that he'did not
think that determination had been made; however, the Community Relations
Committee is not a board which takes any official actions as such. The
City Attorney stated this is a board maintaining relations throughout the
community and in view of that there would be no problems but he will look
~nto. it.
Mr. Chapin mQved for the appointment of the names.listed by the
City Manager to the Community Relations Committee, seconded by Mr. Weekes.

The City Manager called for the appointment of the following

Mr. Chapin asked the City Manager what the Plumbing Board does.. -'
~he City Manager stated that the Plumbing Board acts on applications for
.t~ermits for licenses and also assists in settling disputes of a plumbing
nature. He stated that there are several boards that serve with the
Building Department and the Plumbing Board is one of them. Mr. Chapin stat£
he would question the need for a board, that doesn't meet and has little,
if any function, particularly when many of these things are handled by State
law. Mr. Chapin stated that he would urge the City Attorney to advise the
Council whether or not the~Plumbing Board is a needed board and if not, he
would like to see the talent of these people in other, more 'productive
areas of the'City government. ·
Mayor Scheifley suggested that if it is agreeable With the other
Council members that Mr. Chapin's suggestion be in the form of a request
to the City Attorney to check it out and see whether it is required by
Charter, ordinance or desirable and bring it to' the next workshop so that
action could be taken. Mr. Sanson stated that last year the Council went

was determiend at that time that i'L woul~!~, t:,e discu~sed at a future date.
The City Attorney asked Council. if they would like to have a work-
shop discussion on nothing but city boards in conjunction with the recom-
mendation which will. involve other city pe.rsonnel to be at the meeting to
explain the function of-the board. The City Attorney stated there are
about fifteen to twenty boards and it will take at least one full meeting
to comprehensively go over that list. Mayor Scheifley stated that this
would be referred to workshop in the future.
Mr. Weekes moved that the Plumbing Board be reappointed for a
one year term and the persons to serve on the Board be those as outlined
by the City Manager, seconded by Mr. Sanson. Said motion passed unanimously.
The City Manager called for the reappointment of the City Physi-
cians Dr, Edward Doyle and Dr. Edward White. Mr. Sanson requested that the
2ity Manager supply the Council with an approximate amount the City Physicians
~arned from the City. Mayor Scheifley stated that all this would not be
in the City's records because Drs. Doyle and White are also the physicians
for the Policeman's Pension Board and they are constantly doing work for them
and this is paid by the Pension Board. The City Manager stated he would
get the information requested by Mr. Sanson.'
Mr. Chapin moved for the reappointment of Drs. Doyle and White
as the City's Physicians, seconded by Mr. Weekes. Said motion passed
unanimously.
6. Mayor Scheifley presented Resolution No. 22-77.

Mr. Chapin moved for the passage of Resolution No.'22-77,
seconded by Mr. Sanson. Upon roll call Council voted as follows:
Mr. Chapin - Yes; Mr. Sanson - Yes; Mr. Weekes - Yes; Mayor Scheifley - Yes.
The motion passed with a 4 to 0 vote.
Mayor Scheifley stated he feels that the City was extremely
fortunate in having the services of Mr. Gomery. He stated that he feels
Mr. Gomery has been very sincere, extremely conscientious, and a person
of high integrity.
Mayor Scheifley presented a plaque to Mr. Gomery 'commending' him
on his services as Councilman.
7. Mayor Scheifley presented a plaque to Mrs. Lens Brunner as a
Special Service Award for her conscientious and dedicated service on the
Beautification Committee for the years 1967 to 1977.
Mayor Scheifley presented a plaque to Robert Stafford as a .
Service Award for his dedicated services on the Beautification Committe~
for the years 1975 to 1977 and for his services on the Community Appearance
Board for the year 1976 to 1977. The Mayor stated the City is very sorry
to lose Mr. Stafford but wishes him health, happiness and success in New
Hampshire.
8. Mr. Willard Young, 220 MacFarlane Drive, Delray Beach, newly
~Pointed president of the Beach Property Owners Association read a docu-
ment, a copy of which was given to the Council, prepared, by the Association.
This document outlined problems, immediate and anticiFnted, on the beach
as a recreation area under three main categories: Increased Use of Our
Beach; Financial Effect on Taxpayers of Delray Beach; and Inequitable
Burden on Nearby Homeowners. This document also offered some suggestions
for meeting the needs of the community of Delray Beach in solving' these
p~oblems. ,

Mr. Sanson stated in past years Council has usually scheduled
a workshop session for considering the BPOA's recommendations line by line.
]~t should be done so this year, with one suggestion, that the City Attorney
do all necessary research before this item is scheduled for workshop to
avoid rescheduling it for him to get additional information, because this
document has a lot of complicated legal questions in terms of beach access
and controls on parking. Mayor Scheifley stated he would like for the
administration to make suggestions on some of the points presented in this
document.
Mayor Scheifley stated this item would be scheduled for work-
shop as soon as it is practical and as soon as some work can be done on it.
9. The City Manager presented modifications to the Firefighters
L~'cal 1842 Contract that was previously approved by Council. The City
Manager stated that the motion on the Firefigh%ers Local 1842 Contract
should be to approve the substitution of Exhibit B for Exhibit A along with
the addition of the word "day", page 17, art~cle 11.
Mr. Weekes moved that Exhibit B be substituted for Exhibit A
with the inclusion of the word "day" as appearing on Exhibit A in the
Firefighters Contract, seconded by Mr. Sanson. Said motion passed unanimously.

Mr. Sanson stated that the Firefighters Contract is one that
~as totally debated, and adopted in a spirit of compromise. Although there
was a tremendous amount of disagreement, it was a fine example of what
two bodies can do when they want to come to some kind of agreement and willing
-~o give a little. Mr. Sanson stated he appreciates this very much and
~hanked the Firefighters. Mr. Sanson stated the City did not have to spend
~ch, if any, additional monies for this collective bargaining process
~hich has not been the case in other sessions of bargaining that the City
~as had. Mr. Sanson stated that Council does appreciate the spirit of
compromise of the Firefighters and he hopes the relation between the Council
~nd the Firefighters will continue to be as harmonious, all things consi-
dered, as it was _this time.
Mr. Weekes mentioned that Mr. Sanson appeared before a House
~ub-committee in Tallahassee relative to maintaining mini-PERC and carried
7~ith him a letter from the Firefighters union expressing satisfaction with
the~idea of mini-PERC and, if the mini-PERC is maintained, we can thank the
Local Firefighters union for a big assist in keeping it intact.
!0. The City Manager stated that the Sheriff's office requested per-
:i~'S~sion for use of the City's property north of the Police station for landing
~f the Sheriff's helicopter on occasion when needed. The City Manager
~ecommended that the Council give its sanction to this request with the
:~roviso that the permission for such use may be revoked immediately by
i~ouncil should that determination come about by Council at a future date.
'?he City Manager stated that Sheriff Wille, by his actions during the short
~.ime he has been in office, has exhibited a fine spirit of cooperation and
l~aw'enforcement professionalism throughout the county, and he, the City
~anager, would like to extend this courtesy to the Sheriff as a matter of
~ooperation.
Upon question by Mr. Chapin as to the purpose of the Sheriff
landing at this spot, the City Manager replied that when the helicopter is
in this area on business at the police station it might need to.land; it
might be on an emergency situation and as far as the number.of landings
and the times, day or night, can only be determined after the helicopter
5as been in use for a while. An assessment can then be made to determine
whether or not the Practice should be continued.
Mayor Scheifley questioned this request due to the fact that the
lot is unpaved and a helicopter landing there would stir up quite a bit of
dust. Mr. Chapin stated he would be in favor of trying this on an~ experi-
mental basis but has reservations about the noise and the dust factor to the
residenCs living nearby. Mr. Chapin stated he would like the town to co-
operate with the Sheriff but he would like this temporary'use to be conditione~
on emergency basis. Mr. Sanson stated he has given it some thought as to

what'Would happen if Council was confronted with this question, after
notiCing the discussions about helicopters landing and flying in the
City of Boca Raton. Mr. Sanson stated he has v~ry serious reservations
about allowing this to take place in the location being specified; there
are far better ar~as in the City of Delray Beach with a larger area of
Vacant land that the helicopter could land.~ Mr. Sanson stated he cannot
approve of a condition that would provJ.de inconvenience to the residents
of Delray. Furthermore, this particular area is teaming with children
and, as soon as they see a helicopter, they are going to be climbing all
over it. It is going to take a full time person to keep them away from
it and quite possibly somebody can get seriously hurt. Mr. Sanson also
stated that he would always have reservations about somebody flying a
machine approaching or being.near a residential area where an accident
could occur and the helicopter could plunge into a house and cause bodily
~njury to someone. Mr. Sanson stated he would be in favor of allowing
~he helicopter to land in the City of Delray Beach but at a different
.ocation.
Mayor Scheifl~Y~stated'if the'helicopter had to land in some
other location it would not accomplish its purpose and, instead of prejudging
the request, suggested to give it' a trial period. Mr. Sanson stated he
could not'go along with a trial Period and stated that in an emergency
Situation who was going to stop anybody from landing there.
Police~chief-Cochran Stated~that~h~feels the emergency situation
Would get the job done, if this is what Council wishes. He pointed out
that this was simply a request from the Sheriff's office after having looked
the area over and found no wires in the area that would keep them from
setting a helicopter down. He further stated he did not think it would
create any particular problem between the Police Department and the sheriff
if Council agrees that an emergency-basis is-all that is needed.
The City Manager stated '%hat h~ doesn't think that the Sheriff's
office asked whether the Council would approve it or not, their main con-
--cern is whether or not they would be ~llowed to use the land by whatever
approval or non-approval.
Mr. Chapin asked the City Manager to enlighten the'Council and
citizens of Delray why the request has been presented and what reason the
Sheriff wants to have access to land a helicopter.on this particular
property. The City Manager stated we have a new Sheriff and he is doing a
lot of things that has not been done in the past and he would assume that
this was another instance of trying to extend the services of his department
around the county. Mr. Chapin asked what-the zoning is on this particular
property and the City Attorney advised it is zoned General Commercial.
Mr. Chapin then asked the City Attorney if it is possible to land a heli-
copter in a General Commercial zoning district to which the City Attorney
replied, the City has no restrictions that address itself to this issue
at all. The City Attorney stated he talked to the City Attorney of Boca
Raton about the problems they were having with helicopters landing in a
residential area and their zoning did not address this particular problem
either. They subsequently introduced an ordinance dealing.with helicopter
landings. -'
It was agreed that no official action be taken on this particular
~ssue.
11. The City Manager stated that the Multi-Agency Investigative Unit
is another activity instituted in the county and he is hearing very good
reports about it. This is an agency with sixteen personnel in a unit with
eight being furnished by the Sheriff's office and one each by the communi-
ties in Palm Beach County.. The City Manager recommended that Council give
its approval for entering into this agency.
The City Attorney stated that the City of Delray Beach is parti-
cipating in this agency at the present time and his principle concern is
that of the insurance coverage and whether or not the fact that the Delray
Police officer working outside tne City limits would give grounds for our
insurance carrier to deny coverage. He further stated that the Sheriff's
Department has agreed to take these officers under their coverage; however,

a copy of the Sheriff's policy needs to be obtained and the matter needs
to be discussed in general with the City's insurance consultant to determine
if their policy would give adequate coverage, and if it does no~ whether the
location of the police officer would have a bearing on the coverage.
The City Manager stated that there are unquestionably some
details that would have to be worked out, and the insurance detail is one
of them, but the other cities in the county have the same details to get
worked out. If they can work it out, the City of Delray Beach can work it

Mr. Weekes moved that Council agree in principle to participate
in the Multi-Agency Investigative Unit proposed by the Sheriff's Department
subject to working out the problems as raised by the City Attorney, seconded
by Mr. Sanson. Said motion passed unanimously.
12. John J. Smith, President of the Banyon House Condominiums, 1225
South Ocean Blvd., Delray Beach, read a letter voicing their opposition to
the proposed parking area on South Ocean Blvd., between Rhodes Villa Avenue
and White Drive, which has space for 122 cars and suggesting conditions to
be followed, if and when this parking area is completed. Mayor Scheifley
asked the City Manager to duplicate the letter so that each member of
Council may get a copy for consideration.
Mr. Chapin moved for the adjournment'of the meeting, seconded by
Mr. Weekes. Said motion passed unanimously. The meeting adjourned at 8:55
