NOVEMBER 24, 1975
A regular meetin~ of the City Council of the City of Delray
Beach, Florida, was held in the Coung~l Chambers at 7:30 P.M., Monday,
November 24, 1975, with Mayor James H.. Scheifley presiding, and City
Manager J. Eldon Mariott, City Attorney Roger Saberson, and Council
members Andrew M. Gent, Grace S. Krivos, David E. Randolph and Ron I.
Sanson, IV, present.
1. The opening prayer was delivered by Dr. Warren Nubern of
Lakeview Baptist Church of Delray Beach.
2. The Pledge of Allegiance to the Flag of the United States of
~r~erica was given.
3. The minutes of the regular meeting of November 10, 1975, were
not delivered to Council until November 24, 1975. Mr. Gent moved to
table approval of the minutes, seconded by Mr. Sanson, said motion
passing unanimously.
4.a. Mr. Randolph reported as a result of the last regularly
scheduled Housing Board meeting, it was asked that Manpower, under Title
VI, fund three positions for the Housing Board. The positions would
be Housing Director, Community Field Service Coordinator and a Secretary.
This proposal has been approved by the Palm Beach County Manpower Board.
4.b. Mr. Sanson asked why repairs had not been made to the Heidel-
berg Restaurant which had been partially destroyed by fire. The City
Attorney stated one wall of the building is owned by two tenants; a
dispute is ensuing between the tenants since one wishes to tear it down
and the other wishes to erect a wall. At present, it is in abeyance
until the dispute is settled.
4.c. Mayor Scheifley stated the South Central Regi'onal Wastewater
Treatment and Disposal Board has hired an Executive Director for the
plant. Mr. Anthony J. Canon from Massachusetts was the final selection
of the Board. Mayor Scheifley introduced Mr. Canon and welcOmed him.
4.d. Mayor Scheifley stated the National League of Cities will
meet in Miami Beach next week. He stated he would attend and requested
Council's authority to represent the City. Mrs. Krivos moved that if
any business comes before the National League of Cities that requires
voting as pertains to the City of Delray Beach, Mayor Scheifley be
authorized to vote on behalf of the City of Delray Beach, seconded by
Mr. Randolph, said motion passing with Mayor Scheifley abstaining.
5.a. Mr. Mike Considine, High Point, Delray Beach, read a resolution
protesting the installation of softening eqnipment to soften the water
in Delray Beach. The resolution requested that Council fully investigate
all aspects of the use of soft water before expanding the plant to create
soft water. Mayor Scheifley stated Council is aware of the problems
that can occur from the use of soft water. Several years ago, Council
appointed a committee of three cardiologists to study the problem and
report to Council. They unanimously recommended against soft water.
Mayor Scheifley stated there are strong indications, wherever extensive
studies have been made, that the incidence of cardiovascular disease
is much higher where soft water exists. Mr. Sanson stated he had dis-
cussed this question with several knowledgeable people and requested a
workshop be set up to discuss this matter. After discussion, it was
decided to set up a committee which would be discussed at the next work-
shop meeting.
6.a. The City Manager requested that the.subdivision plat of the
new section of Pineridge Cemetery be approved. The plat has been
recommended by unanimous vote by the Planning and Zoning Board for appro-
val. Mr. Sanson questioned whether or not the plat had been approved
by the Beautification Committee since it showed no landscaping at all.
Mr. Kotulla stated it had not. The City Manager stated it was not cus-
tomary for plats to go through the Beautification Committee; site plans
were considered by that committee. Mrs. Krivos expressed the hope that
that the cemetery would have some landscaping. Mr. Gent moved that
Council approve the plat of Pineridge, Unit B, Subdivision, seconded
by Mr. Randolph. Mrs. Krivos asked if landscaping could be discussed
at a later time if the plat were approved at this meeting. The City
Attorney replied in the affirmative. The motion passed unanimously.
Mrs. Krivos moved that the question of the plat of the new cemetery
and also the existing cemetery be st~'died by the Beautification Com-
mittee and recommendations be brought to Council, seconded by Mr.
Sanson, said motion passing unanimously.
6.b. The City Manager reported in compliance with Chapter 15 of
the City's Code of Ordinances, the description of the parcel of land
in violation of the City's nuisance laws be corrected and the City Clerk
be directed to comply with Chapter 15 of the Code, as applicable, in
order to provide for abatement of the nuisance determined to exist. The
City Attorney reported Mr. Roy Reid, Chief Building Official, has taken
some pictures of the property today. Mr. Reid presented the pictures
to Council and reported the tree stumps and fallen trees remain, but the
property has been mowed. He said the stumps and trees are hazardous
and are harboring rodents. Mayor Scheifley asked Mr. Reid for an esti-
mate of the value of the stumps. Mr. Reid stated there is no value to
the stumps. He estimated they have been sitting there for approximately
six months. The City Attorney reported he had three letters concerning
the value of the timber on the property; he requested the letters be
entered into the record.

"On November 20th, I have examined the downed trees located
on the above property. These consist of about 20 Australian
Pines averaging about 12 ~nches in diameter, bulldozed out in
a land-clearing operation. The trunks have been cut from the
stump and sawed into random length logs. Australian Pine is
not considered a commercial timber species. To my knowledge,
there is no market for these.logs and I would consider them
to have no commercial value."

"After surveying the above site, it is my opinion that the
fallen trees on the site have no appreciable value as lumber."
The City Attorney reported he had asked the County Legal Depart-
ment to put this matter on a Board of County Commissioners' agenda to ask
the County to also declare this property a nuisance since the property is
in litigation regarding the validity of the annexation into the City of
Delray Beach. He stated he received a letter dated November 5, 1975,
from Warren Dill, Assistant C~nty Attorney, Palm Beach County, whereih
he states as far as he is concerned, Palm Beach County has no legal
standing in the matter and will take no action. The City Attorney stated
any motion should state specifically that Council move for declaring a
nuisance on this property. Mrs. Krivos moved that the City Clerk be
directed to comply with Chapter 15 of the Code to provide for abatement
of the nuisance as determined to exist on Lots 20 and 21, Delray Beach
Shores Subdivision owned by Mr. Donald Glassman whose address is 3017
Spanish River Road, Boca Raton, Florida; the nuisance is to be declared
under the City Code of 15-3 as a hurricane hazard and 15-4 as a haven
for rodents, seconded by Mr. Randolph. The motion passed unanimously.

6.c. The City Manager stated the South Central Regional Wastewater
Treatment and Disposal Facility Board appointed Mr. Anthony J. Canon
as the Chief Executive Officer of this facility. As provided by the
Interlocal Agreement under which the Board operates, it is recommended
that Council give consideration to the approval of Mr. Canon's appoint-
ment to the position. Mr. Gent moved in accordance with Section 5 of
%he Interlocal Agreement by and bet~'en the City of Boynton Beach and
the City of Delray Beach made and entered into the 26th day of December,
1974, that Council approve the appointment of Mr. Anthony J. Canon as
Chief Executive Officer of the South Central Regional Wastewater Treatment
and Disposal Facility, seconded by Mrs. Krivos. The motion passed
unanimously. Mr. Gent moved in accordance with Section 3(C) (1) of the
Interlocal Agreement by and between the City of Boynton Beach and the
City of Delray Beach made and entered into the 26th day of December,
1974, that Council approve the creation of an employee position of
Secretary-Bookkeeper to be appointed by the Chief Executive Officer as
permitted in Section 6(A), seconded by Mr. Randolph. The motion passed
unanimously.
6.d. The City Manager stated Council discussed the appointment of
Mr. Norris Rickey to the position of Assistant Prosecuting Attorney
to replace Robert Thomas who resigned. Mr. Rickey resides at 40 S.E.
1st Avenue, Boca Raton, Florida. Mr. Randolph moved for the appointment
of Mr. Norris Rickey to the position of Assistant Prosecuting Attorney,
seconded by Mrs. Krivos. The motion passed unanimously.
6.e. City Manager Mariott reported there are seven expired outstand-
ing site plans to be handled; four of these are on the agenda this evening
for Council to consider. The three remaining site plans will be considered
at the next regular meeting of Council. The City Manager stated the
Lu-Ro-Ca Corporation, Bris Mar and Lakes Phase I developers have no
objection to cancellation of the site plans'by Council. Treaty Point
development has been foreclosed and is in the hands of the Industrial
Bank of Rhode Island. Mr. Jerry Kline, attorney who is handling the
matter, stated his clients are not interested in the original site plan
since the zoning has been changed. They will be presenting a revised
site plan at a future date. The City Attorney suggested that the motion
be phrased in terms of no longer accepting any applications for exten-
sions of these site plans. Mr. Randolph moved for the cancellation of
expired ~ite plans and to no longer accept any extension requests for
Lu-Ro-Ca Corporation, initially approved 1-22-70; Bris Mar, initially
approved 12-10-73; Lakes Phase I, initially approved 8-12-74; and Treaty
Point, which is under foreclosure, initially approved 11-13-72, seconded
by Mr. Gent, said motion passing unanimously.
Mr. Sanson asked if the owners of Treaty Point would volunteer
to remove the billboard on the property. Mr. David Levy, Lauderhill,
Florida, representing the owners of Lakes Phase I, thanked Council for
the consideration they gave on the. firs% site plan. Mr. Levy offered
the site to'Delray Beach as a possible park area for considerations to
be discussed.
7.a. The City Manager stated a communication'has been received
from the Lions Club of Delray Beach requesting permission to solicit
funds on December 6, 1975, approval of which is recon~ended by the
Solicitations Committee. Mr. Sanson moved that permission be granted
to the Lions Club to solicit funds on December 6, 1975, seconded by Mr.
Gent, said motion passing unanimously.
7.b. The City Manager stated a communication has been received
from the South County Foster Parents Association requesting permission
to solicit funds from December ].st through December 9, 1975, approval
of wklch is recommended by the Solicitations Con~ittee. Mr. Gent stated
better than 99% of any funds received will be used to subsidize the foster
parents who take in approximately 85 children in this area. Mrs. Barbara
DeSanta~ is the director; the association is part of the Division of
Family Services of the State of Florida. Mrs. Krivos moved that the
South County Foster Parents Association be permitted to solicit funds
'from December 1 through December 9, 1975, seconded by Mr. Randolph, said
motion passing unanimously.

7.c. The City Manager reported a communication has been received
from the American Cancer Society requesting permission to solicit funds
from March 15 through March 28, 1976, approval of which is recommended
by the Solicitations Committee. Mr. Randolph so moved, seconded by Mr.
Gent, said motion passing unanimously.
7.d. The City Manager reported a 'request has been received that the
City execute a quit-claim easement deed to the County for the right-of-way
abutting the Rock Pit on Sims Road. The County has agreed to maintain
the road and the surrounding property owners deeded the necessary right-
of-way to the County. The owners wish to have the street improved. The
City Attorney stated if the County does not maintain the road, then it
will be their obligation to convey the easement back to the City. The
City Attorney stated the motion should authorize the execution of the
easement deed with the addition that if the County does not maintain the
road, they would convey the'easement back to the City. Mr. Gent so
moved, seconded by Mr. Sanson. The motion passed unanimously.
8.a. The City Manager presented Ordinance No. 47-75.

SAID BOARD BY ORDINANCE NO. 27-75.
City Manager Mariott read the caption of the ordinance. The
City Attorney stated an addition should be made to the ordinance making
· it effective upon second and final reading. This is necessary to
schedule the special Council meeting on December 11, 1975 at 7:00 P.M.,
pursuant to instructions from Council at the last workshop meeting.
The wording to be added is as follows: "This ordinance shall be effective
upon passage on second and final reading". Mr. Sanson moved for the
passage of Ordinance No. 50-75 as amended by the City Attorney, seconded
by Mr. Randolph. Mayor Scheifley commended the committee that devoted
many hours to the preparation of the criteria contained in ~the ordinance.

The City Manager read the caption of the ordinance. A sketch was shown
depicting the location of the property. The property lies between Congress
Avenue on the east and Davis Road on the west. Mr. Gent moved for the
passage of Ordinance No. 54-75 on first reading, seconded by Mrs. Krivos.
Upon roll call, Council voted as follows: Mr. Gent - Yes; Mrs. Krivos -
Yes; Mr. Randolph - Yes; Mr. Sanson - Yes; Mayor Scheifley - Yes. The
motion passed with a vote of 5 to 0.
10. The following Bills for Approval were approved on motion by

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AMENDING SECTION 7(2) (a)
OF THE CHARTER OF THE CITY OF DELRAY BEACH AND
CREATING AN EXCEPTION TO THE REQUIREMENTS OF SAID
SECTION WHEN REAL PROPERTY IS BEING SOLD TO ANOTHER
GOVERNMENTAL AGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH,
FLORIDA, AS FOLLOWS:
Section 1. That Section 7(2) (a) of the Charter of the City of Delray
Beach, Florida, be amended as follows:
Sec. 7 (2)
(a) That any real property sold by the City except real property
~eing sold to another governmental agency shall be sold upon
the following conditions:
(1) That a base bid of a minimum of three-quarters of the
City's assessed valuation on any lot or parcel of land
proposed to be purchased, shall be deposited with the
City Clerk.
(2) The terms of such proposed sale and the base bid shall be
advertised once a week for at least two weeks in a
newspaper of general circulation published in the City of
Delray Beach.
(3) That any such lot or parcel shall be sold at public
auction at the City Hall of the City of Delray Beach.
(4) That all such sales shall be subject to approval by the
City Council, and in each case the bid of the highest
bidder complying with the terms and conditions set forth
in the notice of sale shall be accepted, unless the City
Council shall reject all bids.
(5) That the City Council may provide such other provisions as
it may deem necessary, provided such are not inconsistent
with the foregoing provisions.

SECTION 1. That Section 29-6.1 (B) Community Commercial District

amended by adding:

SECTION 2. All ordinances or parts of ordinances in'conflict herewith
be and the same are hereby repealed.
SECTION 3. If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or unconstitutional
by any court of competent jurisdiction, such portion shall be deemed a
separate, distinct, and independent provision and such holding shall not
affect the validity of the remaining portions hereof.
