A regular meeting of the City Council of the City of Delray
Beach, Florida, was held in the Council Chambers at 7:30 P.M., Monday,
January 14, 1974f with Mayor James H. Scheifley presiding, City
Manager J. Eldon Mariott, City Attorney G. Robert Fellows and Council
members Grace S. Krivos, David E. Randolph, J. L. Saunders and Leon
M. Weekes present.
The opening prayer was delivered by Mr. Ben Krivos.
2. The Pledge of Allegiance to the Flag of the United States of
'America was given.
The minutes of the special Council. meeting and Organizational
meeting of January 7~ 1974, were approved unanimously on motion by
Mrs. Krlvo= and seconded by Mr. Weekes.
4oa. Mrs. Krivos welcomed Mr. Saunders back to Council. She then
asked the City Manager what had happened to the trash collection. She
observed the trash had not been picked up in the majority of the City.
The City Manager stated several major pieces of equipment had broken
down and were now repaired; he said the backlog should be caught up
within a week. Mrs. Krivos reported there was a For Sale sign in the
middle of the traffic circle of the City at N.E. 14th Street. The
city Manager replied this would be taken down.

and expressed his anticipation in working with him. Mr. Randolph
referred to the memorandum sent by the City Manager concerning the fire
at 3910 Sherwood Boulevard. He commended the City Manager for the
contents of the memorandum.
4.c. Mr. Saunders asked Mr. Randolph to read the memorandum for the
benefit of'the public. Mr. Randolph read the memorandum expressing
the City Manager's interest and urging that the Police Department and
the State Fire Marshall's office utilize all avenues to locate the
culprits and bring them to justice. Mr. Saunders thanked all those
who had sent cards, calls and offered prayers for his recovery and
r~turn. He stated he hoped he would be able to finish out the year
as Councilman.
4.do Mr. Weekes echoed the thoughts concerning Mr. Saunders and his
return, and stated all present prayerfully hoped he would finish his
term as Councilman.
4.~eo 'Mayor Scheifley also expressed his sentiments concerning the
re'turn of ~r. Saunders. ~ie announced the engagement of the City Clerk,
Mrs. Hallie Yates, and Mr. Bob Worthing and wished them all happiness
in the future.
5.a. Mr. Stephen Holmes, 1010 NoE. 9th Avenue, Ap~. 9, Delray Beach,
spoke from the floor as both a citizen of Delray Beach and a patrolman
on the Delray Beach Police Force. He stated he represented a group of
police officers who chose to remain anonymous due to fear of reprisals
because of an alleged unwritten rule which prohibits City employees
from speaking to CJ.'Ey Council meT~ers concerning employee working

conditions. He apologized for having to bring these matters to the
public record, but stated too many inequities now exist and too many
promises have been broken, necessitating this action. He listed the
statistics, complaints and problems faced by the policemen on a
mimeographed memorandum which he passed to each Councilman and the
members of the press. Mr. Holmes asked the City Council to meet with
the policemen to discuss th~se matters sometime before January 31st.
He also suggested bargaining bodies from the Fraternal Order o.f Police
and/or the Police Benevolent Association be contacted. He requested
the public to show their concern by writing to the City Council in
support of improvements for policemen and police equipment.
In his report, Mr. Holmes presented the following subjects as -~
major issues to be considered:
1. Inequities in startin9~ salaries for Delray Beach
policemen compared to surrounding communities.
2. Inadequate cost of living raise.
3. Lack of any overtime pay.
4. Pay which should be received by the patrolmen
from the State during training periods..
5. Pay for an officer when he must appear in court.
6. Need for higher education in police work and
lack of cooperation in helping Delray Beach policemen ~
to obtain this goal.
7. Total lack of first aid equipment and training
for patrolmen.
8. Shot guns needed in police cars.
9. Replace sirens so they can be heard by the public.
Mayor Scheifley thanked Mr. Holmes for sharing his views with
the Council and thanked him for the temperate manner in which he pre-
sented such a sensitive subject. He stated the City Manager would
analyze the report and it would be considered in a workshop in the
very near future. Mr. Weekes suggested that at such a workshop repre-
sentatives of the Police Department be re'quested to .attend. Mrs. Krivos
suggested representatives of the Fraternal Order of Police and the
Police Benevolent Association also attend a workshop dealing with the
subject. The City Manager stated he had the utmost confidence in Polic~
Chief Grantham. He stated no one from the Police Department had pre-
sented him with any written communication or verbal contact concerning
the items in the documents presented. He further stated he would in-
vestigate the matter thoroughly.
Mrs. H. Ruth Pompey, 1122 NoW. 2nd Street, Delray Beach, spoke
as a representative of the De!r~y Civic Association, Inc. concerning
the Police Department. She complained of the reference of Lt. Kilgore
to black members of the Police Department as "boys". She stated in
the Palm Beach Post on December 28, 1973, he was quot¢~ as saying ~'We
have got a 60 man department with 12 colored boys". The City Manager
was provided with a copy of the letter from the Delray Civic Association.

Rev. Semmie Taylor, 1437 S.W. 3rd Street, Delray Beach, spok~
welcoming Mr. Saunders back to Council. He stated he has had calls
from adjoining cities complaining about the statement in the news-
papers calling black policemen "boys". tie agreed with the statements
made concerning the Police Department, but said problems also exist in
other departmen~ of the City. The sanitation employees have told him
of promises made by the Administration,'bu~ not kept, such as esta-
blishing a grievance committee to cover overtime work, etc. He said
this would probably result in a union being developed within several
departments. He further felt city employees should be able to approach
the Administration without feeling their jobs are in jeopardy. He also
disagree~ with the apparent policy of bringing people in over those
employees who have several years of experience. He referred to the
Fire Department controversy which cause the City to lose a. trained
paramedic because of the way he looked. Rev. Taylor also referred to
the vandalism in the City including the recent incident of the burning'
of the Dobson's home.
A member of the audience requested the photographers to cease
taking pictures claiming it was a distraction. Council requested the
photographers to use discretion in their activities, acknowledging
that the Council Chambers are public.
Mr. Pete Gordon of the Ft. Lauderdale Sun Sentinel expressed
h. is dissatisfaction concerning Council's attitude toward newspaper
people recently. He stated the newspaper personnel who covered Delray
Beach are as sincere and ethical as any City employees.
6.a. The City Manager state~ .in the allocation of funds from the
Federal Revenua Sharing Funds, $6,000 had been allocated for imDrove-
ments ~ko ~e made in the Civic Center, consisting p~imarily of th~
construction of an addition to the building° Roy Simon, A1A, completed
the d~esign of the addition and certain other renovations such as ~he
replacement of a number of doors. ~o bids were received by the City,
the low bidder being Trieste Construction Corporation with a low bid
in the amount of $16,750.00.' The other bid was submitted by Roth
Construction, Inc. in the amount of $18,435.00. A review of the plans
by the architect resulted in a reduction of construction costs to
$12,980.00 which is considered a good price. It is recommended that
Council authorize the award of the contract to Trieste Construction
Company, and by separate motion, allocate $15,000 for the renovation
work at the Civic C~nter which would pay construction costs, the
architect and any minor contingencies that might develop. Mrs. Krivos
asked what the addition would be. The City Manager stated it would be
an addition of 8' x 31' on the south side of the building and the
addition of a small storage area on the north side of the building.
Mrs. Krivos asked what $15,000 would accomplish in an addition to the
presently cramped Building Department. The City Manager replied
$15,000 would not be sufficient to make any substantial difference.
He further stated the project at the Civic Center needed to be completed
since virtually no storage exists at present. Mrs. Krivos stated she
would prefer to enlarge the Police Department prior to making any
renovations in the Civic Center or entering into other projects of
le-ser importance. This was echoed by several members of Council.
Mrs. Krivos moved to table the bid for the construction addition to
the Civic Center since other projects are needed more urgently. Mr.
Randolph seconded the tabling of the project. The motion passed by
a 4 to 1 vote with Mr. Saunders voting no.

7.a. City Manager Mariott reported there is an existing Council
approved site plan for 214 Gleason Street located in the North half
of Block 159 which expired on September 25, 1973. Roy Simon~ A1A,
has requested the City to approve an extension of the site plan for
six months ending March 25, 1974. The City Manager stated the reasons
for the requested extension are beyond the control of the developer
and the architect, and he recommended approval of the extension. It
was ascertained that the needs for the extension were indeed the after-
math of a good faith effort on the part of the developer and the
architect. Mr. Saund. ers moved to approve the extension of the site
plan approval until M~:rch 25, 1974, seconded by Mr. Weekeso The motion
passed unanimously.
7.b. City Manager Mariott reported the City's Solicitation Committee
has recomm, ended approval of a request of the American Cancer Society
to solicit funds in the City from March 17 through March 30, 1974.
Mrs. Krivos questioned the solicitation of funds on Sunday in the City.
Discussion evolved concerning the solicitation of groups on any Sunday.
It was decided to approve the dates as requested and discuss the
Ordinance at workshop for a final decision on the interpretation of
the Ordinance. Mr. Weekes moved approval of the recommendation of the
Solicitations Committee, seconded by Mr. Saunders. The motion passed
unanimously.
7oC. Mayor Scheifley acknowledged receipt of the minutes of the
Beautification Committee for their meeting of December 5, 1973.
7.d. City Manager Mariott stated a request has been received that
that zoning on the south 43 feet of Lot 115 and the north 67 feet of
Lot 116, Plumosa Park, Section A. 1405 - 1413 N.E. 3rd Avenue.. be
changed from R-lkA (Single F~mily Dwelling) to ~M-10 (Multiple Family
Dwelling). It is recommended that the request be referred to the
Planning and Zoning Board for study and recommendation. Mr. Saunders
so moved, seconded by Mr. Randolph, said motion passing unanimously.
7.e. The City Manager stated a petition has been received for an'aexa-
tion, subject to CC (Community Commercial) zoning of 0.95 acres to
permit expansion of the Delray Mall, said property being in the SW¼
of Section 21-46-43, lying adjacent to and west of South Federal
I{ighway in an area north of Linton Boulevard. ~e applicant is Mr.
Ellis Chingos. It is recommended the request be referred to the
Planning and Zoning Board for study and recommendation. Mrs. Krivos
so moved, seconded by Mr. Weekes, said motion passing unanimously.
7.f. .City Manager Mariott reported a petition has been received for
annexa'~ion, subject to RM-20 (Multiple Family Dwelling) zoning, of 52
acres on the east side of Congress Avenue north of Lake Ida Road, said
property being in the W¼ of Section 8-46-43 lying north of Lake Ida
Road adjacent to and East of Congress Avenue and South of Lake Worth
Drainage District Lateral No. 30. It is recommended the request be
refer~ed to the Planning and Zoning Board for study and recommendation.
The City Manager stated the land consists of an "L" shaped tract of
land, the bulk of which is adjacent to and immediately south of the
sewage plant site extendin% southward to Lake Ida Road. A portion
of this land includes the 200' buffer strip between Congress Avenue
and the sewage plant site. The City Manager stated the City has tWo
access ways across the 200' strip from Congress Avenue to the sewage
plant site. Question was raised as to the intended use of the 200'
buffer strip, but it was recommended that the request be referred to
the Planning and Zoning Board for study and recommendation. Mr.

8.a. The City Manager presented Ordinance No. 42-73'.

A Public Hearing was held~ having been legally advertised in
compliance with the laws of the State of Florida and the Charter of
the City of Delray Beach. There being no objections, the Public
Hearing was closed.
Mrs. Krivos moved for passage of Ordinance No. 42-73 on second
and final reading, seconded by Mr. Weekes. Upon roll call, Council
voted as follows: Mrs. Krivos '- Yes; Mr. Randolph - Yes; Mr. Saunders-
Yes; Mr. Weekes- Yes;
9.a. City Manager Mariott reported the Planning and Zoning Board at
a recent meeting acted upon the request of Mr. John H. Adams, Attorney,
to abandon N.E. 7th Court between N.E. 6th Avenue and N.E. 7th Avenue
subject to three items: 1 - an easement be given back to the City
between 6th Avenue and 7th Avenue as determined by the City to be needed;
2 - the needs and/or easements of the various utility companies be taken
into consideration; and 3 - Council be convinced by staff that the
proposed abandonment would not take away anything that was required by
the City. A sketch was projected depicting the location of the property
in question. Letters of No Objection have been received by the three
utility companies agreeing to the abandonment; however, the City needs
to reserve a strip of land 150.5 feet in an east-west direction be-
ginning at the western right-of-way line of 7th Avenue extending west
with a 40' north-south dimension for city utility purposes. This
action is acceptable to the applicant. After discussion, it was deter-
mined the street is not presently being used by vehicles. The City
Manager stated the Planning and Zoning Board and the City Engineer had
approved the abandonment of this street. Mr. Weekes asked whether or
not the abandonment request is acceptable, to the abutting property
owners. The City Manager replied this was not 'knoWn at this time;
however, despite previous controversies in this area, the Planning and
Zoning Board unani~nously approved the request° Ma~or Scheifley ex-
pzessed reservations on the matter asking whether or not the public
interest would be best served by abandonment or by opening the street
as a ~ublic right-of-way. Mr. Weekes pointed out the street immediately.

way. Mr. Weekes moved the item be tabled until the next Council meet-
ing, seconded by Mr. Saunders, said motion passing unanimously.

9.b. City Manager Mariott reported the Planning and Zoning Board at
a meeting held on December 18th recommended by unanimous vote that
Council approve the site plan for John Thomas Dolvin's dental office.
The property is located at the northeast corner of the intersection
of N.E. 4th Street and Swinton Avenue, Lot 4, Block 6, Del-Ida Park.
Mr. Saunders moved to approve the site plan, seconded by Mr. Randolph,
said motion passing unanimously.
9.c. The City Manager reported the Planning and Zoning Board at a
meeting held on December 18th by unanimous vote recommended that
Council approve the site plan for an addition to St. Paul's Episcopal
Church. The property is located on the north side of S.W. 2nd Street
between Swinton Avenue and S.W. 1st Avenue, Lots 5, 6, 7, 8, 12, 13,
14, 15 and 16, Block 62. Mr. Saunders moved the site plan be approved,
seconded by Mrs. Krivos, said motion passing unanimously.
9.d. City Manager Mariott reported the Planning and Zoning Board at
a meeting held on December 18th recommended by unanimous vote that the
CBD (Central Business District) be established following the legally
described boundaries of the Downtown Development' Authority Taxing
District. This would represent a change in zoning from P~-15 (Multiple
Family Dwelling) district and C-~I (Limited Commercial) district to the
new CBD zone. The area in question lies between the east right-of-way
line of the Intracoastal Waterway and Swinton Avenue and between N.E.
1st Street and S.E. 1st Street. The Planning and Zoning Board then
unanimously passed a second motion recommending to Council that if the
1.ega[ boundary of the taxing district is the easterly right-of-way
line of the Intracoastal Waterway, City Council request the State
Legislature to change said boundary to the westerly right-of-way 'line
of ~be Intr~co~s~a! Wa~.~erw~y~ ~.~yor ~eh~f]ey q,~-s~o~ed the reasoning
for the proposed change of the boundary line ~o the western side of the
Intracoastal Waterway. Discussion continued Concerning the usages to
be allowed in this district. It was agreed to approve the first motion.
Mayor Scheifley stated the second motion would require going before the
local, delegation and offering reasons for the requested change. Dis-
cussion ensued with Mr. J. W. Dunbar spe~aking from the audience stating
the Planning and Zoning Board had proposed the boundary line on the
west side of the waterway for the purpose of docking excursion boats
on the west side.
Mr. Weekes moved that the City Attorney be authorized to draft
an Ordinance to establish the CBD zoning district boundaries as
recommended by the Planning and Zoning Board, seconded by Mr. Saunders,
sai~ motion passing unanimously.
Mr. Randolph moved to table the second motion regarding the
legal boundary of the taxing district until a later Council meeting,
seconded by Mr. Weekes, said motion passing unanimously.
10.a. The following Bills for Approval were unanimously approved for
pa}~ent on motion by Mr. Weekes and seconded by Mr. Saunders.

10.b. City Manager Mariot% reported that James W. Nowlin, Jr. is
willing to serve during the year of 1974 as Judge Ad Litem as he has
in previous years. It is recommended that Mr. Now!in be appointed as
a Judge Ad Litem to serve during 19'74. Mr. Weekes so moved, seconded
by Mrs. Krivos, said motion passing unanimously.
10.c. Mayor Scheifley stated he would make every effort to help to
beautify the City and to eliminate eyesores on both residential and
commercial property.. He stated he has discussed this problem with the
Directors of the Chanfl~er of Commerce asking for the cooperation of
their Executive Committee. A meet.i~g is scheduled with this group
along with the Beautific~.tion committee to determine what they can do
to help in this program. He said he was also asking for cooperation
from the newspapers; the City Manager has stated any violations will
be corrected. Letters will be forwarded to property owners who have
unsig]~,~tly areas, but are not in direct violation of City Ordinance.
Action has already been taken in several instances. Maintenance on
large developments will also be taken into consideration.

There is hereby adopted by the city for the purpose of
prescribing regulations governing conditions hazardous to life
and property from fire 'or explosion, ehae.those certain
codes kno~ as the &ggL 1970 Edition of the Fire Prevention Code
and the 1972 Revision of the Fire Prevention Code, Article 31,
recommended by the American Insurance Association and the Ten (!0)
Volume Set of the 1973 - 1974 Editions of the N~tional Fire Codes,
recommended by the National Fire Protection Association, including
all revisions, save and except such portions as are hereinafter
deleted, modified or amended, of which codes not less than three
(3) copies have been and are now filed in the office of the Clerk
of the City and the same are hereby adopted and incorporated as
fully as if set out at length herein, and from the date on which
this article shall take effect, the provisions thereof shall be
controlling within the limits of the city.
Section 2. That the Code of the City of Delray Beach, Florida,
as amended, be further amended by deleting'the foll~wing section of
Chapter 14 "Fire Department, Fire Prevention and Fire Regulations":

Section 3. That the Code of the City of Delray Beach, Florida,
as amended, be further amended by amend~n~ the following section of
Chapter 14 "Fire Department, Fire Prevention and Fire Regulations" to
read as follows:
Sec. 14-5. Establishment of limits in which bulk storage of
liquefied petroleum gases is to be restricted.
The limits referred to in Section ~9~86a 21.6 of the Fire
Prevention Code, in which bulk storage of liquefied petroleum
gas is restricted, shall be in accordance with the zoning ordi-
nances.
Section 4. That all ordinances or parts of ordinances in conflict
herewith ]De and the same are hereby repealed except when in conflict
with the Southern Standard Building Code and the Southern Standard
Housing Code as adopted, in which event the Southern Standard Building
Code and the Southern Standard Housing C'ode shall prevail.
Section 5. That should any section or provision of this ordi-
nance or any portion thereof, any paragraph, sentence or word be
declared by a court of competent jurisdiction to be invalid, such de-
cision shall not affect the validity of the remainder hereof as a whole
or part thereof other than the part declared to be invalid.
Secu~on 6. That any person who violates the provisions of Sec-
tions 1 or 3 above shall upon conviction be punished as provided in
Section 1-6 of the Code of ordinances of Delray Beach.

Section 1. ~at the Code of the City of Delray Beach Florida,
as amended, be' further amended ~y g the following section of
Chapter 14 "Fire Department, Fi~ ~vention and Fire Regu].ations" to
read as follows:
Sec. 14-1. Adoption of F Prevention' Code.
There is hereby adc ted t~e city for the purpose of
prescribing regulatioqs 'overn '~qonditions hazardous to life
and property from fire ~r explo %hae those certain
codes knov~ as the Lg~ 1970 of the Fire Prevention Code
and the 1972 Revision f the Fir( Code,. Article 31,
recommended by the ~ssociation and the Ten (10)
Volume Set of the 1~ 3 - 1974 EdJ_t~ )f the ~z~;_.~.~.~] Fire Codes,
recommended by the 'ational Fire Pro Association, including
all revisions, say. and except such ~ )ns as are hereinafter
deleted, modified amended, of whi not less than three
(3) copies have ben and are now filed office of the Clerk
of the City and same are hereby ado] incorporated as
fully as if set ut at length herein, an( the date on which
this article .1 take effect, the provi thereof shall be
controlling the limits of the city.
Section 2. the Code of the City of Del each, Florida,
