JUNE 24, 1974 A regular meeting of the City Council of the City of Delray Beach, Florida, was held in the Council Chambers at 7:30 P.M., Monday, June 24, 1974, with Mayor James H. Scheifley presiding and City Manager J. E!don Mariott, City Attorney G. Robert Fellows, Council members Grace S. Krivos, David E. Randolph, J. L. Saunders and Leon M. Weekes present. 1. The opening prayer was delivered by Father Skehan of St. Vincent Ferrer Catholic Church of Delray Beach. 2. The Pledge of Allegiance to the Flag of the United States of America was given. 3. The minutes of the regular meeting of June 10, 1974, were approved on motion by Mrs. Krivos and seconded by Mr Randolph, said motion passing unanimously. 4.a. Mr. Randolph stated that his request for a traffic light be- denied by +~ne County Traffic Department. n~ wante~ ~ ~ ~= '~ - publicly that he will continue his efforts to obtain this traffic light and ':~ ' w~z~ do it as a cm~=~ of ~ .... =~=~ =~ not in his official capacity as a Councilman. ~v~r Ech~iflev read a Proclamation Droclaimin~ Thursday, zens to recognize this special day. 5.a. ~s. The City Manager reported that the Delray Beach Police De- partment has approximately 40 bicycles which are unclaimed and recom- mended that Council authorize by motion the sale of thes.-= bicycles at auction. Mr. Saunders so moved, seconded by Mr. Randolph, said motion passing unanimously. Mr. Weekes suggested that in addition to the required Public Notice, perhaps a news release could be prepared to create more interest. 6.c. City Manager Mariott reported that at the regular Council meeting of May 13, 1974, Counci!· authorized submittal of a City-owned tract of land consisting of approximately two acres in Section 18, Township 46 South, Range 43 East, adjacent to the 1-95 right-of-way, for sale at public auction in City Hall o.n June 13, 1974. Mr. Byron R. Cameron, the only bidder, submitted his bid in the amount of $6,000 which amount has been deposited in full with the City. The City Mana- ger recommended Council approve by motion the sale of this property, so moved by Mr. Weekes, seconded by Mrs. Krivos, said motion passin~ unanimous ly. 6.d. City Manager Mariott stated that a request has been received that the zoning of the south side of S.W. 12th Street (Linton Boulevard) between S.W. 4th Avenue and 1-95 in Section 29, Township 46 South, Range 43 East, be changed from RM-15 (Multiple Family Dwelling) zoning to SC (Specialized Commercial), the applicant being Boca Raton Yacht and Tennis, Inc. It is recommended that the request be referred to the Planning and Zoning Board for study and recommendation. Mr. Weekes moved for referral to the Planning and Zoning Board, seconded by Mrs. Krivos, said motion passing unanimously. 7.c. The City Manager stated that a request has been received that the zoning on the north side of Audubon Boulevard between Linde!t Boulevard and 1-95, west quarter Section 29, Township 46 South, Range 43 East, be changed from R-bAA (Single Family Dwelling) zoning to R14-15 (Multiple Family Dwelling) zoning, the applicant being Boca Raton Yacht and Tennis, Inc. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AUTHORIZING NEGOTIATION OF A CITY CONTRACT FOR REHABILITATION OF SPRINKLER SYSTEM FROM ATLANTIC AVENUE TO THE NORTH END OF BEACH. (Copy of Resolution No. 40-74 is attached to the. official copy of these minutes.) The City Manager stated this resolution authorizes the award of a City contract for rehabilitation of sprinkler system on the beach from Atlantic Avenue to the north end of the beach and also for the replacing of all sprinkler system pipes that have been destroyed, and recommended that the contract be awarded to the low bidder, Rohrbaugh Sprinkler Service in the amount of $2,700.00. The City Manager stated that the Planning and Zoning Board at a meeting some time ago reco~ended in two separate actions that this ordinance be adopted. These items were two of the 11 items that were referred to Professor Ernest Bartley of the University of Florida for review and recon~endation. It was Professor Bartley's opinion that he could see no possible conflict in the' future by passing this ordinance. The prime intent of this ordinance is to separate the RM-10 and the ~xi-15 zoning districts. The uses in all zones would remain the same in this ordinance as are reflected now in the City Zoning Ordi- nance. It is reco~ended C~uncil pass this ordinance on first reading and prior to consideration of passage on second reading, further study could be made at a workshop meeting. Mayor Scheif!ey commented that when Council approved the Master Plan and adopted the supplementing ordinances he was under the impression that in ~q-6 zoning 6 units per acre were permitted, in RM-10, 10 units permitted, etc,, but that the computations are so technical that this does not necessarily hold true '-~ ...... Council .me, ers expressed their willing- ness to meet with the Boynton Council and reiterated their feelings that it would be to the best interest of the communities being served to have a contractural agreement. The C~ty Manager snated he wanted to make two points for clarification, 1 - Delray Beach owns the land - 7 - for the plant but it will be necessary to acquire additional land to accommoda, tea Regional-Plant and 2 - that the plans for this Plant belong to both Boynton Beach and Delra~ Beach. Mayor Scheifley ex- plained that Council could not meet as a group to discuss this matter under the Sunshine Law, but individual members of Council could dis- cuss it with the City Manager prior to the.meeting. Mr. Frank Ellis, 553 Jaeger Drive, Tropic Palms, Delray Beach, spoke from the floor concerning the difficulty he had when he had taken a neighbor to £~unicipal Court in violation of City Ordinance No. 25-72 in regard to building and construction work on'Sundays. The matter was referred to the City Attorney for his study with the request that he report his findings to Council at the next regular meeting to determine if the ordinance is unconstitutional.
