A special meeting of the City Council of the City of Delray
Beach, Florida, was held in the Council Chambers at 7:30 P.M. on
Tuesday, January 2, 1973, for the purpose of finalizing any
business of the outgoing Council, with Mayor James H. Scheifley
presiding, City Manager J. Eldon Mariott, City Attorney G. Robert
Fellows, and Council members Grace So Krivos, J. L. Saunders, Leon
H. Weekes and O. F. Youngblood present.
1. The opening prayer was delivered by Elder Parker Ho Sye.
2. The Pledge of Allegiance to the Flag of the United States of
America was given.
3. The minutes of the regular Council meeting of December 26,
1972, were unanimously approved on motion by Mrs. Krivos and
seconded by Mr. Saunders.
4. Mrs° Grace Krivos introduced her family, all of whom were
warmly welcomed by Mayor Scheifley.
Each Council member commented briefly on the experiences of
the past year and all agreed it had been a pleasure to work with
the congenial and dedicated people of the Council and of the City
Administration. Each also expressed his desire for fruition of
projects that would benefit the city of Delray Beach in the coming
year. Mayor Scheifley summarized the attitude of the Council by
thanking his colleagues for working together so well and for the
cooperative spirit shown for the good of the city. He also thanked
the appointed officials, committees and city administration for
their work of the past year.
5. The Council adjourned at 7:45 P.M.
ANNUAL ORGANIZATIONAL MEETING OF COUNCIL
1~ Councilmen-elect J. Lo Saunders and Leon M. Weekes subscribed
to the Oath of Office administered by City Clerk Hallie E. Yates.
2. The opening prayer was delivered by Elder Parker H. Sye.
3. Mayor Scheifley stated that the Council would follow the
policy of selecting a Vice-Mayor by nominating the Council candidate
with one year of experience on the Council who had received the
highest number of votes in the General Election. Mrs. Grace Krivos
was unanimously elected to the position of Vice-Mayor for 1973 on
motion by Mr. Weekes and seconded by Mr. Saunders, with Mrs. Krivos
abstaining.
4. Mrs. Krivos thanked the Council for being selected as Vice-
Mayor of Delray Beach and expressed her desire to serve a productive
term with the fine cooperation of the Council members.
Mayor Scheifley stated that two major projects the Council
would like to see completed are the beach restored and the sewage
treatment plant well under way in 1973.

5. Mrs. Krivos moved that the regular Council meetings be held
on the second and fourth Monday nights of each month at 7:30 P.M.
during 1973. The motion was seconded by Mr.~ Youngblood and
unanimously passed. This action complies with Section 26 of the
City Charter in establishing meeting dates for the regular Council
meetings.
.6. Mr. J. Eldon Mariott was unanimously appointed as City
Manager for the year 1973 on motion by Mr. Saunders and seconded
by Mr. Youngblood.
7. Attorney Ernest G. Simon was unanimously appointed as Muni-
cipal Judge, and Attorneys Paul E. Gringle and James W. Nowlin, Jr.
were unanimously appointed as Judges Ad Litem for 1973 on motion
by Mr. Weekes and seconded by Mr. Saunders.
8.... Attorney G. Robert Fellows was unanimously appointed as
City Attorney for 1973 on motion by Mrs. Krivos and seconded by
Mr. Youngblood.
9.-. Attorney I. C. Smith was unanimously appointed as City
Prosecutor and Attorney Robert L. Thomas was unanimously appointed
as Assistant Prosecutor for 1973 on motion by Mr. Saunders and
seconded by Mr. Youngblood.
1..0. Mayor Scheifley suggested that each committee member be
named and appointed individually as a matter of record.
The following persons were unanimously appointed to the
Barbers Board of Examiners for the year 1973 on motion by Mr.
Weekes and seconded by Mr. Youngblood:

Mrs. Krivos moved that the following persons be appointed to
the Beautification Committee for the year 1973. She stated that
this would leave the Board short of the number of members designa-
ted by resolution, but others would be appointed at a later date.
The motion was seconded by Mr. Saunders and passed unanimously.
Mayor Scheifley confirmed the third through the eighth members
named would serve in an honorary capacity.

The City ~anager reported that the Traffic and Parking
Committee would be discontinued for the present time and be
reinstituted should it become necessary as decided in the Council
workshop meeting.
10.a. Mr. J. C. Collier, Jr., Local Manager of the Florida Power
and Light Company, presented the City with a check in the amount
of $159,238.14, covering franchise tax payment to the City of
Delray Beach for the year ending December 4, 1972. Mr. Collier
stated as a matter of interest that ten years ago, the check
presented to the city was for $52,000, indicating an increase of
over 30~ in the growth of the city.
10.b. Mayor Scheifley stated that if anYone in the audience had
anything to bring to the attention of the Council, they were
welcome to do so at this time.

Mr. Charles Russell, 1023 Bay Street, Delray Beach, spoke
to the Council concerning the use of the red flag denoting "Danger-
No Swimming" at the public beach in Delray. He complained that
the flags were used to discriminate against him~ It was pointed
out to him by Mayor Scheifley and the other Council members that
the personnel in charge of the beach were specialists and were
hired by the city to protect the~ health of the persons utilizing
the beach facilities. He further stated that safety was the
primary objective of the city program and if, in fact, Mr. Russell
were being discriminated against, it would certainly be rectified
by the City Manager.
The City Manager reported to the Council that the city's
application to the State Pollution and Control Department for a
temporary operating permit for a sewage treatment system would be
considered in a hearing in Tallahassee by that Board on January
15, 1973, at 10:00 A.M. ge announced that the city would make a
presentation at that time and await the Board's decision.
Mr. Saunders informed the Council that he had been contacted
concerning the sidewalk in front of Neal's Farm Market on I~.E.
1st Street. The sidewalk is broken and-~:- =- hazard to ~-~= elderly
people who live in that area. Mr. Saunders requested that the
Public Works Department check the area to determine if it could
be replaced.
~lr. Weekes reported that the County Sanitation trucks are
~till collecting garbage early 'in the morning; the last complaint
he received reported collection at 4:58 A.M. ge strongly requested
that som~ action be taken to stop the disturbance of collection
at this hour in the residential areas of Delray.
The meeting was adjourned at 8:25 P.M.
