City ~qa~ager J. Eldon ~larictt, Ci[~y Attorney G. Robert Fellows, and
Council mem!~ers Grace S. t(rivos, J. L. Saunders, Leon M. Weekes and
O. F. Youngbiood present.
Mayor Scheifley called the meeting to order; all present
stood, recited the Lord's Prayer and gave the Pledge of Allegiance
to the Flag of the United States of America. ~layor Scheifley
~nounced the meeting had been called for the purpose of awarding
a sewer contract.
The City M~ager presented Resolution No. 22-73.

The City Manager reported the City had plans ~d specifi-
cations prepared and had received bids for the construction of a
s~%itary sewer line on S.W. 12th Avenue connecting with ~ existing
line on s.W. 10th Street leading to qbe Stewart A~as project now
under construction. He stated the sewer line is designed to serve
Stewart Arms and the twelve .homes on S.W. 10th Street along which
the sanihary sewer line will pass. The City i~ianager reported the
bids as follo~.gs:

The City Manager reported this particular sewer line is a
part of the $9,000,000 water ~d sewer improvement program of the
City of Delray Beach. Rq~e City he.s sufficient funds from the
$5,000,000 Water and Sewer Revenue Bond Issue %0 finance construCtion
of the project. He further stated Stewart Arms has deposited its
, share of tb~e cost of construction of this line in the amount of $6,000
with the City. The difference between the $6,000 deposited by Stewart
Arms and the construction costs would come from the Bond Issue Funds.
Mr. Saunders asked if this project would make it possible for Stewart
Ar~ns to meet the de~dline on housing. The City Manager state~ it
would ~ke it possible, but expressed doubt that any units would be
ready for occupancy in June as was previously discussed. He also
stated the work would take ten days to complete. Mr. Saunders moved
that Resolution No. 22-73 awarding the contract to the low bidder,
Underground Utility Consol-ruction Company, in the amount of $12,91.2.00
be adopted. The motion was seconded by Mr. Youngblood and passed
un an imo u sly.

RESOLUTION NO. 22-73.
A RESOLUTION OF T~E CITY COUNCIL OF T}IE CITY
OF DELRAY BEACH, FLORIDA, AUTHORIZING A CITY
CONTRACT FOR THE EX~fENSION OF A SANITARY
SEWER TO SERVE STEWART AR/v~S APART~LENTS.
WHEREAS, it is the recommendation of the City Manager
that the Council, acting by authority of provisions in Section
78 of the City's Charter, award a contract for the installation
of approximately six hundred sixty-seven (667) lineal feet of
eight (8) inch Sanitary Sewer [~_ain together with all required
appurtenances, as required to extend a sewer along S.W. 12th
Avenue from the existing sewer on SoW. 10th Street to S.W. 8th
Street, to the low bidder, Underground Utilities Construction
Company, for the lump sum amount of $12,912.00; and
WHEREAS, said sewer line is included in the sewer exten-
sions approved by the State Board of Health, and is included in
the list of extensions previously approved by Council, and for
which the City has money in hand from the sale of bonds; and
WHEREAS, said sewer line will serve twelve (12) residences
along S.Wi 12th Avenue as well as the Stewart Arms Apartments; and
WHEREAS, the said Stewart Arms Apartments have provided
an Escrow Agreement for off-site facilities with the City National
Bank of Miami in the amount of $6,000.00 to cover their share of
the cost; and ~
WHEREAS, time is of the essence in accomplishing this
work; and
WHEREAS, it is the Council's opinion that such action would
be in the best interest of the City;
NOW, TPr~REFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DEI~RAY BEACH, FLORIDA, AS FOLLOWS:
That the said contract for the installation of approximately
667 lineal feet of 8 inch sewer, including all required appurten-
ances, be awarded to the low bidder, Underground Utility Construc-
tion Company, for the lump sum amount of $12,912.00.
PASSED AND ADOPTED in special session on this the 30th
day of April, 1973.
