12-05-73SpMtg 203 DECE~,TBER 5, 1973 A special meeting of the City council of the city of Del_ray Beach, Florida, was held in the Council Chambers at 12:].5 P.M., Wednesday~ Decem3per 5, 1973, with Mayor James 1-i.' Scheifley presiding, City Manager J. Eldon Mariott, City Attorney G. Robert Fellows and Council members Grace S. Krivos, Leon M. Weekes and O. F. Youngblood present. Mr.. J. L. Saunders was absent. The Lord's Prayer was repeated in unison. The Pledge of Allegiance to the Flag of the United States of America was given. Mayor Scheifley called the. meeting to order and announced that same had been called for the purpose of canvassing the returns of the General Election held on Tuesday, December 4, 1973, and for any other business that may come before this meeting. The City Clerk reported the results of the General Election held on Tuesday, December 4, 1973, for the office of Mayor for the term of two years and for the offices of two Council members for the te~nn of two years were as follows: OFFICE OF Glenn L. Campbell 1,242 James H. Scheifley 2,437 OFFICE OF COU£qCIIi~EN Grace S. Krivos 2,752 Maurice F. Power 1,085 David E. Randolph 2,302 Semmie Z. Taylor 1,088 TOTAL VOTES CAST 10,906 TOTAL VOTEtlS 4,056 The City Clerk further stated in the abser~ce of any declaration of contest by any of the Candidates in this election, Council should accept the report of the Election returns submitted by the Clerks and Inspectors of the Election. As a result of the votes cast, Council should pass a motion declaring James H. Scheifley duly elected to serve as Mayor for a two year term for 1974 hud 1975, and declaring Grace So Krivos and David E. Randolph duly elected to serve as Council members for two year terms for 1974 and 1975. Mr. Weekes moved Council accept the report of the City Clerk as to the results of the General Election and as a result thereof, Mr. J~mes H. Scheifley be declared Mayor and Mrs. Grace So Krivos and Davi~l E. Randolph be declared as Council me~'?eers. [4r. Youngblood seconded the motion, said motion passing unanimously. A RESOLUTION OF T}[E CITY COUNCIL OF THE CITY OF DELP~A¥ BEACII, FLOi-tiDA, IN CONSIDERATION OF ESTABLISII~3NT OF REGIONAL WASi'E~ATER TF, EAT~.[ENT AN/} DISPOSAL. Ile stated the Resolution authorized a joint Public Hearing to be held by the Cities of Delray Beach nnd Boynton Beach at Atlantic High School on December 17, 1973, for the purpose of considering the establishment of a regional pollution control facility for treatment and disposal of wastewater from their respective service areas. Passage of the Resolution is recommended. Mr. Youngblood moved the passage of Resolution No. 57-73, seconded by Mrs. Krivos. Upon roll call, Council voted as follows: Mrs. Krivos - Yes; Mr..Weekes - Yes; Mr. Youngblood - Yes; Mayor Scheifley - Yes. ' The City Manager stated Christmas Eve falls on a Monday and asked if Council would approve City Hall closing all day on the Monday preceding Christmas instead of the half-day that is usually observed. He reported Boynton Beach, Deerfield Beach and Pompano would be closed, and, at present, the only City remaining open is Boca Raton. Mayor Scheif!ey asked what effect this would have on the Police and Fire Departments. The City Manager stated the holiday would be applicable to non-emergency personnel ~?nich would mean all necessary operations would continue; the persons involved in necessary procedures would be fairly compensated. Mrs. Krivos moved City Hall be closed and the City employees with the exception of emergency personnel have a holiday December 24, 1973, seconded by Mr. Youngblood. The motion passed unanimously. City Manager Mariott reported the con.tested access to the refuse transfer station site, the extension of 4th Avenue southward, has finally be.eh won in court with the court deciding in favor of the County. The ruling was handed do~.~a on November 30th and the Jones family has 30 days in which to file an appeal. The City Manager stated he had been contacted by ]~en Eliingsworth, Manager of the Chamber of Commerce, regarding the City's and the Cham- ber's invitation to Ben Simpson of the Department of Transportation to attend a luncheon meeting to be held at the Delray Beach Club at 12:00 noon on December 19, 1973. Mr. Simpson has asked what subjects the City of Delray Beach is most interested in so he can prepare material on those subjects. The topics listed were as follows: Lintcn Avenue Bridge, completion of 1-95, plans for A1A for traffic and parking, changes on Atlantic Avenue, and the paving that is due on A1A. Mr. Weekes stated he felt the Christmas lighting on Atlantic Avenue should be ]_it for a specified time sinc.e he believed the mood of 'the country was such that the lights would be beneficial to the ~blic ~nd wou]~ not use a significant amount of fuel Mayor Scheifiey :;ugc-csted they be lit f~om the 17th ~of December through the 25th Council agreed and Mr. Weekes moved the City Manager be authorized to turn on the Christmas decoration lights in the City for a period of 8 days from December 17 through December 25, 1973. Mr. Youngblood seconded the motion which passed unanimously. The City Manager reported the Pollution Control Department held a workshop , .... '-' ~ _, m~.<.~].n~ in Jacksonville on Friday November 30th, for the [,~rpose of developing a formula to be used in the allocation of points to determine each city and county's position on the priority list for the 1975 Federal Grant Funds for sewage treatment construction. Mr. Klinck and the City Manager attended the workshop meeting in Jacksonville at which the City Manager made several recommendations which were in- corporated into the plans. The first recommendation adopted was the -2- 12-5-73 205 suggestion regional designations be included in the priorities listed by the Federal Government Secondly, ~:,tA will not permit the Depart- ment of Pollution Control to give any points to places that have shown good faith: the City Manager's recommendation was adopted that only those places who have met all requirements by the agency, such as Delray, be placed on the list which would give Delray Beach a higher priority.. The City Manager reported that he and Mr. Klinck would attend another meeting of the Pollution Control Department at Orlando on December 7, 1973. Mayor Schei~lev stated he had been informed by Pat Hogan that the Beach Property Association was having a meeting this afternoon and he would like to read a letter from the City Manager to the Palm Beach County Commissioners dated December 4, 19'73, pertaining to the beach parking north of Atlantic Avenue in order to keep the public better informed.
