A special meeting of the City Council of the City of Delray Beach
was held in the Council Chambers at 7:30 P.M. This was also the Annual
Organizational Meeting, with Mayor J. L. Saunders in the chair, city
Manager J. Eldon Mariott, city Attorney G. Robert Fellows and Council
Members Grace S. Martin, James H. Scheifley, Leon M. Weekes, and O. F.
Youngblood being present.
1. ~ The Opening Prayer was delivered by Rev. Marvin Sweat.
2. ~'~ The Pledge of Allegiance to the Flag of the United States of America
was given.
3. ~ The minutes of the regular meeting of December 27, 1971, were unani-
mously approved, on motion by Mrs. Martin and seconded by Mr. Weekes.
4.~· Outgoing Councilwoman Martin stated that she had enjoyed serving on
Council for the past two years and was looking forward to the next two
years. She said she has found it rewarding in many ways and feels there
are many things to accomplish in the future.
X. Mayo~r Saunders introduced Mrs. Martin's brother and his wife, from
Pennsylvania, and also introduced his wife, Edna.
4. ~Outgoing Councilman Scheifley said that he also had enjoyed serving
on the Council, and with respect for each other, has made it a real
privilege to serve with this group.
4. 3~-Councilman Weekes commented that serving on Council has been an educa-
tional experience for him and that he was looking forward to the coming
year.
4. ~Outgoing Councilman Youngblood said that he was pleased by the coopera-
tion among City residents and the City government, and is looking forward
to working hard for the betterment of the community during the next two
years.
4 ..... ~-Outgoing Mayor Saunders con%~ented that he had enjoyed serving as Mayor
and that he was confident that the new Mayor and Council would do a fine
job. He said that he is disappointed that the Southwest Drainage Project
has not been completed and that he is very much interested in the beach
erosion problem being solved.
This Council adjourned at 7:45 P.M.
ANNUAL COUNCIL ORGANIZATIONAL MEETING
1. Mayor-Elect James H. Scheifley and Councilmen-Elect Grace S. Martin
· and O. F. Youngblood subscribed to the Oath of Office given by city Clerk
Hallie E. Yates.
2. The Opening Prayer was delivered by Rev. Marvin Sweat.
3. The city Manager reported that the City Charter provides a procedure
by which a vacancy on the city Council is filled and read the following
Memorandum prepared by the citY Attorney:
"Pursuant to Section 14 of the Charter of Delray B<~ach and
the resignation submitted by Councilman James H. Scheifley
pursuant to Florida Statute 99.012, effective January 3, ].972
there exists a vacancy in the Council of the city of Delray
Beach of one councilman whose term expires this year.

Pursuant to Section 14 of the Charter of Delray Beach, Council
shall fill the vacancy until the next general election by three af-
firmative votes at its regular meeting either on January 10th or
January 24th, otherwise, a special election shall be held for the
purpose of filling such vacancy."
The City Manager said it is recommended that the Council declare a
vacancy to exist on the City Council by passing a motion to that effect.
Mr. Weekes moved to declare a vacancy on the city Council of the
City of Delray Beach, the motion being seconded by Mr. Youngblood and
unanimously carried·
X. Mayor Scheifley presented RESOLUTION NO. 1-72 to Mr. Saunders, which
was unanimously approved on motion by Mrs. Martin and seconded by Mr.
Weeke s.
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF DELRAY BEACH, FLORIDA, COMMEND-
ING RETIRING MAYOR JACK L. SAUNDERS.
WHEREAS, JACK L. SAUNDERS, has unselfishly given of his
time and ability as Mayor for the past four years, and has
served as Mayor and Councilman for six years during the period
between 1950 and 1966,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DELRAY BEACH:
That JACK L. SAUN-DERS be and is hereby commended for his
great contribution to the general welfare of the city of Delray
Beach, Florida, as Councilman and Mayor.
Unanimously adopted this 3rd day of January, 1972.
X. Mayor Scheifley announced that there would be a workshop meeting Tues-
day evening, January 4th, at 7:00 P.M. for discussion Of the Council vacancy
as well as other subjects·
4./~Mayor Scheifley explained that it is Council' S policy that the Counci'3~?.~
receiving the highest number of votes in the General Election, following
one year of experience on the Council, will be selected as Vice-Mayor.
Councilman Leon M. Weekes was unanimously selected as Vice-Mayor for
1972, on motion by Mrs. Martin and seconded by Mr. Youngblood, with Mr.
Weekes abstaining.
5. Mayor Scheifley and Council Members Martin, Weekes and Youngblood aga~r
stated that they were looking forward to the coming year.
Mr. Weekes said that he appreciated the honor of being selected Vice-
Mayo r.
Mayor Scheifley said that he feels the two major problems facing
Beach are the tragic situation at the Beach, and the control of the growt.%,
of the City..
Mrs. Scheifley was present and was introduced by Mayor Scheifley.
6. To. comply with Section 26 of the city Charter in establishing meeting
dates for the regular Council meetings, Mr. Youngblood moved that the
regularly scheduled meetings during 1972 be held on the second and fourth
~.~cndays of each month at 7:30 P.M., the motion being seconded by Mrs.
Martin and unanimously carried·
X. It was stated that in compliance with Section 12 of the city Charter,
that persons appointed to serve as set out in Agenda Items 7, 8, 9 and 10,
~uring the year 1972 ~nould be appointed with the understanding that all

such appointments and terms of office are at the pleasure of the City
Council.
7. Mr. J. Eldon Mariott was unanimously appointed as City Manager for
the year 1972, on motion by Mr. Youngblood and seconded by Mr. Weekes.
8. Ernest G. Simon was unanimously appointed as Municipal Judge for
1972, on motion by Mr. Weekes and seconded by Mr. Youngblood.
Paul E. Gringle and James W. Nowlin, Jr., were unanimously appointed
as Judges Ad Litem for 1972, on motion by Mrs. Martin and seconded by
Mr. Youngblood.
9. Attorney G. Robert Fellows was unanimously appointed as City Attorney
f-'~ifor 1972, on motion by Mr. Weekes and seconded by Mr. Youngblood.
10. Attorney I. C. Smith was unanimously appointed as City Prosecutor
and Attorneys John W. Spinner and H. Cassidy Sumrall, Jr., were unanimous-
ly appointed as Assistant Prosecutors for 1972, on motion by Mr. Youngblood
and seconded by Mr. WeekeB.
11. Regarding the appointments of the Boards and Committees for 1972,
Mayor Scheifley reported thatat a recent workshop meeting it had been
decided to defer consideration of such appointments until the next regular
meeting on January 10, 1972.
X. The City Manager reported that at a recent workshop meeting Council
indicated that it wished the City Attorney to appear before the Legisla-
tive Delegation at the January 4th meeting with respect to possible pro-
posed legislation during the upcoming session of the Legislature. Also,
the Legislative Delegation has requested Council to officially designate
the City Attorney as Council's representative at that meeting. He said
the.City Attorney has prepared the following communication, dated January
3, 1972, to the Legislative Delegation, approval of which should be con-
sidered by Council at this time.
"Pursuant to action taken at a meeting of the City Council of
Delray Beach on January 3, 1972, G. Robert Fellows, as City
Attorney, is authorized to appear before the delegation on the
following matters:
1. Amtrak ~'
2. Extension of Reserve Area
3. Miscellaneous Charter Amendments
(a) Removal of Unsafe Buildings
(b) Voting- Registrations ~
(c) Tax Assessing and Collections, Board of Equalization
(d) Control Over Reserve Area as to Zoning and Building Codes."
After general discussion, the City Attorney ~was unanimously authorized
to appear before the Legislative Delegation on behalf of the City Council
of Delray Beach with regard to the matters as outlined in the above communi-
cation, on motion by Mr. Weekes and seconded by Mr. Youngblood.
X.+ Mayor Scheifley announced that he and the City Manager are planning to
leave City Hall on January 4th at 8:15 A.M., to attend the Executive Com-
mittee meeting of the Palm Beach Municipal League in West Palm Beach-and
that any of the Council Mer~J0ers desiring to attend this meeting or some of
the Legislature hearings are welcome to go with them.

Mrs. Martin pointed out that while attending a meeting of the Palm
Beach Municipal League, she discovered that many cities intend to ask
the Legislature to return tax assessing and collecting to the municipal-
ities.
