06-12-72 JIINE..12, 1972. A regular meeting of the City Council of ~the City of Delray Beach, Florida, was called to order in the Council Chambers at 7:30 P.M., Monday, June 12, 1972, by Mayor James H. Scheifley, with City Manager J. Eldon Mariott, City Attorney G. Robert Fellows, and Council Members Grace S. Martin, J. L. Saunders, and Leon M. Weekes present. Councilman O. F. ¥oungblood was not present for this meeting. 1. The opening prayer was delivered by Reverend Whitney Church, St. Matthew's Episcopal Church, Delray Beach, followed by-the Lord's Prayer. 2. The Pledge of Allegiance to the Flag of the United States of America was then given. 3. The minutes of the regular meeting of May 22, 1972, and the special meetings of May 24, 1972, and June 8, 1972, were unani- mously approved on motion by Mrs. Martin, seconded by Mr. Sau~ders. Presentation of items by Council members. None. 5. Rev. Semmie Taylor expressed his concern regarding the potential school problems in Delray Beach. He asked for a joint workshop meeting with the Council to go into the problems in more detail. The Council agreed to invite Rev. Taylor to the next City Council workshop meeting. 6.a. The City Manager explained that the Easement Deed involved in this item was for the East six (6) feet of Lot 12, Delray Beach Shores, which is approximately 300 feet West of A1A on Rhodes-Villa Avenue and will provide for adequate drainage of this area. He explained that the easement would not result in any cost to the City as Delray Beach Shores Subdivision will furnish the material and the City will install same. Mr. Weekes moved to accept the Easement Deed, seconded by Mr. Saunders and unanimously carried. 6.b. The City Manager informed Council that the Planning and Zoning Board required dedication of an 80-foot right-of-way in Section 30, Township 46 South, Range 43 East, that is not covered in the proposed plat of Sabal Pines Subdivision. He projected a sketch of Sabal Pines Subdivision and explained that the right-of- way begins at the North boundary of the proposed Sabal Pines plat and extends Southerly and Easterly to Congress Avenue right-of-way. There would be no cost to the City. City Manager Mariott stated that an Easement Deed had been prepared for acceptance by the Couhcil. Mr. Weekes moved for the acceptance of this Easement Deed, seconded by Mrs. Martin, and unanimously carried. 6.c. The City Manager explained that this Easement Deed covers the Southerly extension of S. W. 21 Avenue and is adjacent to the Easterly line of Lot 1, Block 6, Delray Beach Highlands, Section 3. The Planning and Zoning Board had understood that when Delray Beach Highlands, Section 3, was accepted, the streets would be in different locations from that shown on the original plat. As a result of the change, this easement is required to carry the water to Delray Estates, a new subdivision to the South. City Manager Mariott recommended acceptance of this Easement Deed. Mr. Saunders made a motion to that effect, seconded by Mrs. Martin, and unani- mously passed. -1- lO0 6.d. The City Manager informed Council that an easement is required from the City of Delray Beach by Florida Power & Light Company on the East two (2) feet of the South fifteen (15) feet of Lot 12, Block 80, for the purpose of anchoring ~ relocated pole to permit extension of an electric wire South from $. E. 4 Street. Following a discussion, Mr. Weekes made a motion to grant the easement, as requested by Florida Power & Light Company, seconded by Mr. Saunders, and unanimously carried. 6.e. Concerning a survey of parcels of land in violation of the City Nuisance Laws, the City Manager reconu?,ended that Council authorize the City Clerk to provide for the abateraent of the nuisances in question, in compliance with Chapter 15 of the City's Code of Ordinances. Mrs. Martin so moved, seconded by Mr. Weekes, and unanimously carried. (Copy of Nuisance List is attached hereto.) See: Page 104-A 7.a. Mayor Scheifley acknowledged receipt of the minutes of the Beautification Committee for its May 2, 3, 12 and 22, 1972, meetings. 7.b. City Manager Mariott informed Council that a request from Mr. Jeff Searfoss, 182 N. E. 5 Avenue, Delray Beach, for a gratis occupational license for watch and jewelry repairing had been received. He stated that satisfactory evidence as per Section 16-4 of the City Code and Section 205.162 of the Florida Statutes had been submitted and recommended approval of the request. Mr. Saunders so moved to grant the request, seconded by Mr. Weekes, and passed unanimously. 7.c. The City Manager informed Council that a letter dated May 17, 1972, had been received from Mr. Merlin L. Doughty, Real .Estate Broker, which offered to sell to the City a tract of beach front land located in Ocean Ridge which would be used for public beach purposes. Mr. Mariott stated that, inasmuch as this property is located outside the corporate limits of Delray Beach, combined with the fact that the City is not presently in the market for additional public beach property, he recommended that the offer be rejected. Mr. Weekes made a motion to that effect, seconded by Mr. Saunders, and carried unanimously. 8.a. The City Manager presented RESOLUTION NO. 27-72. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, ORDERING THE CONSTRUCTION OF STORM DRAINAGE AS SHOWN ON PLANS MARKED "STORM DRAINAGE- SOUTH~rEST AREA, PROJECT NO. 5964-9a", TOGETHER WITH THE INSTALLATION OF INLETS, ~LAN-HOLES AND APPURTENANCES IN CONJUNCTION WITH SUCH STORM DRAINS. (Copy of RESOLUTION NO. 27-72 is attached to the official copy of these minutes.) See: Pages 104-B to 104-KK He explained in detail the recent developments in con- nection with this Resolution and also outlined future plans and steps that would have to be taken. Upon motion of Mr. Saunders, seconded by Mr. Weekes, RESOLUT_TON NO. 27-72 was unanimously passed. 8.bo A Public Hearing was held, as advertised, in compliance with the City Charter, on the Assessment Roll concerning the open- ing, grading and paving of a portion on N. E. 3 kvenue, lying North -2- 6-12-72 101 of N. E. 22 Street, and there being no objections to said Assessment Roll, ORDINANCE NO. 10-72 was presented. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, ANNEXING TO THE CITY OF DELRAY BEACH CERTAIN LANDS LYING IN THE NORTHWEST QUARTER OF SECTION 28, TOWNSHIP 46 SOUTH, RANGE 43 EAST, AND IN THE NORTHEAST QUARTER OF SECTION 29, TOWNSHIP 46 SOUTH, RANGE 43 EAST, WHICH LANDS ARE CONTIGUOUS TO EXISTING MUNICIPAL LIMITS OF SAID CITY; REDEFINING THE BOUNDARIES OF SAID CITY TO INCLUDE SAID LANDS; PROVIDING FOR THE RIGHTS AND OBLIGATIONS OF SAID LANDS; AND PROVIDING FOR THE ZONING THEREOF. The City Manager presented ORDINANCE NO. 12-72. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH AMENDING SECTIONS 14-9, 14-10 AND 14-11 PERTAINING TO RECLASSIFICATION OF PROPERTY INTO FIRE ZONES I, II AND III OF CHAPTER 14 FIRE DEPARTMENT, FIRE PREVENTION AND FIRE REGULATION. The City Manager presented a new application by Dallas E. Dailey, owner, and Edward O'Cleary, applicant, for rezoning from C-2 to RM-2 of the following described property: The West Quarter (W 1/4) of Lot 29, Section 20, Township 46 Sout~h~ Range 43 East, Palm Beach County, Florida; LESS: The East 70 feet of the South 155 feet, as measured along the boundary lines of said West Quarter of Lot 29, and ].ess the North 50 feet thereof for road right-of-way~ He stated that a prior zoning application had been submitted re- questing C-3 zoning and the Planning and Zoning Board, at its May 16, 1972, meetin~ r~commended denial of same, since the zoning did not conform with the proposed Land Use Plan. The City Manager recommended that the new request be referred to the Planning and Zoning Board for study and recommendation. Mr. Weekes made a motion to that effect, seconded by Mr. Saunders, and unani- mously passed. 9.b. The City Manager explained that the site plan in this instance referred to the property annexed by Ordinance No.. 11-72, which was previously passed and adopted at this meeting. This property is located in the Northwest corner of Section 28-46-43 and in the Northeast corner of Section 29-46-43. He informed Council that the Planning and Zoning Board, at a meeting held on May 16, 1972, by unanimous vote recommended that Council approve the site plan for development of an office building at the S. E. corner of Linton Boulevard and Dixie Highway, 100 East Linton Boulevard. Mr. Weekes moved for the approval of the site plan, seconded by Mr. Saunders, and this motion was carried unanimously. 9.c. City Manager Mariott stated that the Planning and Zoning Board, at a meeting held on June 6, 1972, unanimously voted tc recommend to City Council that the final plat of Greensward Village, a subdivision of 5%e Hamlet, in the Northeast quarter of Section 24-46-42, be approved. He displayed the subdivision plat to COuncil and pointed out the location of the subject property. Following a general discussion, in which Attorney John Ross Adams participated, representing The Hamlet, Mr. Saunders moved that the final plat of Greensward Village, a subdivision of The Hamlet, be approved, said motion being seconded by Mrs. Martin and unanimously carried. 10.a. The City Manager stated that Mr. Emil Danciu, Vice President of Southways Development Company, had requested per- mission to use a construction trailer as a sales office, same being located at 620 S. W. 7 Street. Following a general dis- cussion, Mr. Mariott recommended that this request be referred to the Planning and Zoning Board for study and recommendation. Mr. Saunders made a motion to that effect, seconded by Mrs. Martin and unanimously passed. 10.c. AN ORDIN~JCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, ANNEXING TO THE CITY OF DELkAY BEACH CERTAIN LANDS LYING IN THE NORTHWEST QUARTER OF SECTION 28, TOWNSHIP 46 sOUTH, R3LNGE 43 EAST, AND IN THE NORTHEAST QUARTER OF SECTION 29, TOW%;SHIP 46 SOUTH, RANGE 43 EAST, WHICH LANDS ARE CONTIGUOUS TO EXISTING MUNICIPAL LIMITS OF SAID CITY; REDEFINING THE BOUNDARIES OF SAID CITY TO INCLUDE SAID LANDS; PROVIDING FOR THE RIGHTS AND OBLIGATIONS OF SAID LANDS; AND PROVIDING FOR THE ZONING THEREOF. WHEREAS, it has been recommended by the City Administration that the fire zoning districts of Delray Beach be updated; and, WHEREAS, the City Council deems it to be in the best in- terests of the City to update the fire zoning districts established in 1948; NOW, THEREFORE, be it ordained by the City Council of the City of Delray Beach, as follows: Section 1. That Sec. 14-9, Fire Zones Created-Zone I of Chapter 14, Fire Department, Fire Prevention and Fire Regulation be amended to read as follows: "Sec. 14-9. Fire Zones Created - Zone I. Fire Zone I of the City shall include all property in the city zoned C-l, C-2, or C-3." Section 2.
